- January 06, 2016 Requisition #: 16-003412 Notice of Intent to Sole Source THIS IS A PRE-SOLICITATION NON-COMPETITIVE (NOTICE OF INTENT) SYNOPSIS TO AWARD A CONTRACT OR PURCHASE ORDER WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME). The National Institute of Health Office of Purchasing and Contracts intends to negotiate and 1 year plus 2 option year contract to PROMEGA CORP, WI, 53711 to provide PowerPlex(R) 16 HS System Kits for the PowerPlex Instrument located in the Clinical Center for which the government intends to solicit and negotiate with only one source under the authority of 6.302-1. REGULATORY AUTHORITY The resultant contract will include all applicable provisions and clauses in effect through the Federal Acquisition Circular (FAC) 2005-84, September 3, 2015. This acquisition is conducted under 41 U.S.C. 1903, the simplified acquisition procedures authorized in this subpart may be used for acquisitions that do not exceed $13 million when the acquisition will be treated as an acquisition of commercial items in accordance with 12.102(f)(1). STATUTORY AUTHORITY This acquisition is conducted under the authority of the Federal Acquisition Regulation (FAR) Part 13-Simplified Acquisition Procedures, Subpart 13.500 (b) (1), Soliciting from a single source and is not expected to exceed the simplified acquisition threshold. Contracts awarded using FAR Part 13-Simplifeid Acquisition Procedures are exempt from the requirements of FAR Part 6-Competition Requirements The North American Industry Classification System (NAICS) code for this acquisition is 325413, and the size standard is 500 employees This notice of intent to award is not a request for competitive quotations. Interested concerns capable of providing the same or similar products or services as described in this notice may submit a capability statement outlining their capabilities. No solicitation is available. Information received will be evaluated for the purpose of determining whether to conduct a competitive procurement. Capability Statements must be received within the time set forth in this synopsis to be considered by the Government. A determination to compete this proposed contract based on responses to this notice is solely within the discretion of the Government. Background The Clinical Center is a clinical research hospital providing medical services for patients participating in human research protocols at the National Institutes of Health (NIH). The Clinical Center provides patient facilities, services for clinical investigations, research in related areas, and training programs for residents. The Department of Laboratory Medicine provides laboratory services for the NIH Institutes. As part of the DLM, the Molecular Hematology section provides Chimerism testing on various cell populations from bone marrow and stem cell transplant patients. Purpose The purpose of this purchase agreement is to obtain the kits needed to do Chimerism testing on our bone marrow and stem cell transplant patient. These kits are used with the PowerPlex instrument located in the Clinical Center Description DC2100 POWERPLEX(R) 16 HS SYSTEM, 400rxn CONTRACTING WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME) DETERMINATION The determination by the Government to award a contract without providing for full and open competition is based upon the market research conducted as prescribed in FAR Part 10-Market Research. The subject award will be a continuation to previous testing conducted by the subject contractor. CLOSING STATEMENT This synopsis is not a request for competitive proposals. However, interested parties may identify their interest and capability to respond to this notice. Responses to this notice shall contain sufficient information to establish the interested parties' bona-fide capabilities for fulfilling the requirement and include a proposal, the period of performance, the Dun & Bradstreet Number (DUNS), the Taxpayer Identification Number (TIN), and the certification of business size. All offerors must have an active registration in the System for Award Management (SAM) www.sam.gov." A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement. All responses must be received by January 20th, 11:00 AM Eastern time and must reference solicitation number 16-003412.
