- It is the intent of the National Library of Medicine (NLM) to enter into a sole source procurement with Truven Health Analytics, Inc., 777 E. Eisenhower Parkway, Ann Arbor, MI, 48108 for the purpose of licensing the Hazardous Substances Data Bank (HSDB) emergency medical treatment information. The provided supplies and services are proprietary and commercial as defined in Far Part 2. Truven Health Analytics, Inc. is the only known source capable of providing the required supplies and services. This action is under the authority of 41 U.S.C.253 (c) (1), as set forth in FAR 6.302-1 and HHSAR 306.302-1. Only one responsible source and no other supplies or services will satisfy agency requirements. Since its creation, HSDB has included an emergency medical treatment (EMT) section The EMT section contains information such as clinical effects, laboratory test data and treatment overview based on the level of toxicity. The treatment overview contains various subsections including specific exposures, decontamination, airway management, antidote, toxicokenetics and more. This acquisition will be processed under FAR Part 12 - Acquisition for Commercial Items and will be made pursuant to the authority in FAR Part 13.5 to use simplified acquisition procedures for commercial acquisitions. The North American Industry Classification System Code (NAICS) is 511210 and the business size standard is $35.5 million. This solicitation incorporates provision and clauses in effect in the Federal Acquisition Circular (FAC) 2005-84 Revision effective September 3, 2015, including all FAR Circulars issued as of the date of this synopsis. The period of performance is anticipated to be twelve (12) months, with options to extend the term for two (2) twelve (12) month periods. The Base Year period of performance is anticipated to be January 15, 2016 through January 14, 2017, Option Year 1 period of performance is anticipated to be January 15, 2017 through January 14, 2018, and Option Year 2 period of performance is anticipated to be January 15, 2018 through January 14, 2019. Inclusion of options does not commit the Government to exercise the options and is subject to available funding. NLM anticipates that an award will be made on or about January 15, 2016. Truven Health Analytics, Inc. is the only known source that is capable of fulfilling this requirement due to the proprietary software previously purchased. This is not a solicitation for competitive quotations, nor is a RFQ available. However, if any other interested party believes that it can meet the requirement it may submit a statement of capabilities. The capability statement and any other information furnished must be in writing, and must contain material in sufficient detail to all NLM to determine if the party can meet all of the foregoing requirements. Quotations must be accompanied by descriptive literature, warranties, and/or other information that demonstrates that the vendor is capable of successfully performing the requirement. Vendors shall comply with all applicable Federal, State and Local laws, executive orders, rules and regulations applicable to its performance under this order. The following clauses and provisions cited herein are incorporated by reference into this announcement: FAR 52.212-1, Instructions to Offerors-Commercial Items (October 2015), FAR 52.212-2, Evaluation-Commercial Items (October 2014). Offerors are advised to provide with their offer a completed copy of the following provisions: FAR 52.212-3, Offeror Representations and Certifications- Commercial Items (November 2015)-With DUNS Number Addendum [52.204-6 (July 2013)]. The following FAR clauses apply to this acquisition: FAR 52.212-4, Contract Terms and Conditions-Commercial Items (May 2015)-With Addenda [Stop Work Order, FAR 52.242-15 (August 1989) and Year 2000 Compliance (July 1997)]; FAR 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders-Commercial Items (December 2015), as well as the following clauses cited therein: FAR 52.232-18, Availability of Funds (April 1984); FAR 52.242-15, Stop Work Order (August 1989) with Alternate I (April 1984); FAR 52.242-17, Government Delay of Work (April 1984); and FAR 52.232-33, Payment by Electronic Funds Transfer-System for Award Management (July 2013). All capability statements must be submitted electronically, attn.: Keturah Busey, no later than 12:00pm local prevailing time on December 21, 2015.
