- Wage Determination 2005-2059 Wage Determination 2005-2059 Emergency Response for Hazardous Waste Service Supplier is required to comply with the Service Contract Act, Wage Determination No. 2005-2059 Rev 17 and 1996-0223 Rev 35, dated July 8, 2015 (attached). Scope of Work 1.Emergency Response Services The Subcontractor must have the capability to respond within two (2) hours to any occurrence, such as a chemical spill, at SLAC on a twenty-four (24) hour per day, seven (7) day per week basis, as required. The Subcontractor's personnel will respond to chemical spills onsite, assist the SLAC Technical Representative (and any other SLAC personnel, i.e. Security, SLAC Emergency Response Team (SERT), ESH&Q delegate, etc.) in the analysis of the situation and development of a plan to mitigate circumstances and will clean up spills/hazards to the satisfaction of the SLAC Technical Representative or its delegate. The Subcontractor shall furnish all labor, materials, equipment, tools, supervision and workmanship free of defects, to perform emergency response services on an as needed basis as described below. •Environmental Releases - Environmental releases that may require emergency response will include but not limited to hazardous materials - oil, toxic substances, hazardous substances and hazardous wastes or substances that may be deemed by environmental statutes and regulations to pose harm to the public, environment or structures, or those substances which require cleanup because they will potentially have an impact on the environment and will be considered reportable to regulatory agencies. Cleanup activities will not begin until the Incident Commander (IC), member of SERT, SLAC Technical Representative or designated project manager/Facilities Construction Manager (FCM) has declared the scene sufficiently under control to precede with measures to clean up the environmental release. In the event a SLAC representative mentioned above is not available, a member of any Fire and/or Police agency is authorized to initiate clean-up work with the Subcontractor on behalf of SLAC. It is the Subcontractor responsibility to ensure that: Each employee performing emergency response work has been trained and properly equipped to address the identified hazards. The employees performing emergency response services shall be in compliance with all federal, state and local laws and regulations for Occupational Health and Safety, Environmental Protection, and Hazardous Material Transportation. The Subcontractor shall provide the proper PPE for subcontractor employees to protect to the proper level of hazard. Each employees should be fully trained, and certified (when applicable) with the usage of all PPE (including respirators, dust mask, etc.). The Subcontractor shall provide the necessary equipment, tools, spill cleanup materials (i.e. absorbent, pigs, neutralizers, etc.) and personnel required to clean the spill to the satisfaction of the SLAC Technical Representative or its delegate. That any Sub-Tier Subcontractor used for providing services under this agreement also follows all the requirements of this BOA. The waste generated from the spill could be managed and disposed by SLAC or in some cases handed over to the Subcontractor for proper disposal. 2.Safety The Subcontractor shall perform all operations in a safe, prudent, conscientious and professional manner. Subcontractor's personnel, equipment, and materials shall comply with applicable federal, state, local, safety regulations and procedures, and Subcontractor will ensure its agents, employees and subcontractors perform in a safe manner. The Subcontractor shall ensure that all personnel involved in providing the services set forth in this Blanket Order Agreement be trained for the level of expertise required for the performance of the task. Personnel protective equipment shall be provided the Subcontractor and must be appropriate for the tasks at hand. The Subcontractor agrees that his personnel, materials and equipment are subject to safety inspections by SLAC personnel while at the SLAC facility. The Subcontractor may be required to prepare other safety documentation, such as a job safety analysis (JSA) and site-specific safety plan (SSSP). This documentation will be reviewed for completeness and quality by SLAC personnel. The Subcontractor shall ensure that all personnel providing onsite services review and comply with all safety documentation, when warranted. 3.Provisions/Requirements a.Regulations/Requirements: The subcontractor is responsible for complying with all applicable local, state, and federal regulations in performing all work associated with this request. The subcontractor must be familiar with the applicable regulations/requirements associated with this work including but not limited to the following: •Title 29, Code of Federal Regulations, Section 1910 & 1926 •Title 40, Code of Federal Regulations, Parts 260-270; Parts 700-789 •Title 49, Code of Federal Regulations, Parts 100-199 •California Code of Regulations Title 22, Division 4.5, Chapter 11 In addition, any work performed onsite must be conducted in accordance with the applicable requirements of DOE and SLAC. b.Warranties and Guarantees: The Subcontractor warrants that they have the capability to respond within two (2) hours to any Emergency Response occurrence, such as a chemical spill, at SLAC on a twenty-four (24) hour per day, seven (7) day per week basis, as required. Seller warrants that all personnel performing tasks associated with this Subcontract are properly trained, certified (when applicable) and capable of providing the required services. The Subcontractor warrants that all PPE and equipment used to perform tasks under this Subcontract are: (i)Appropriate for the task (ii)Free of any defects (iii)Inspected, maintained and calibrated as regulated and/or required by the manufacturer Seller warrants that any TSDF sites and transporters utilized under this Subcontract are in compliance with any and all applicable federal, state and local laws and regulations. Subcontractor agrees to notify SLAC if: I.Subcontractor is served with notice of violation of any law, regulation, permit or license. II.Proceedings are commenced which could lead to revocation of permits or licenses, which relate to services. III.Permits, licenses or other government authorization relating to services are revoked. IV.Litigation is commenced against Subcontractor, which could affect the services. V.Subcontractor becomes aware that its equipment or facilities are not in compliance with applicable laws, regulations, permits or licenses. Subcontractor must be qualified and desirous of performing the tasks stated in the work statement and shall perform the services in a manner compatible with the standard of Subcontractor's profession. Subcontractor must have a demonstrated work experience/history involving all tasks associated with this Subcontract. Subcontractor must demonstrate the ability to comply with all federal, state and local laws and regulations, which pertain to the services performed under this Subcontract. c.Spill Responsibility: The Subcontractor shall take whatever actions necessary to prevent spills and to provide contingency measures for cleanup of potential spills during performance of this Subcontract. The Subcontractor is solely responsible for any spills, leaks, discharges, or releases during the performance of this Subcontract which occur as a result of or are contributed to by the actions of its employees, or subcontractors, or which occur at any time while waste or containers removed under this Subcontract are under the control of the Subcontractor or subcontractors. The Subcontractor agrees to expeditiously clean up such spills or leaks to the satisfaction of SLAC and in a manner that complies with federal, state, and local laws and regulations. The cleanup shall be at no cost to SLAC. The Subcontractor agrees to hold SLAC harmless and indemnify it for any costs it incurs as a result of, or incident to, any handling, transportation, storage, treatment, or disposal of waste performed by the Subcontractor or subcontractors. Subcontractor shall only permit appropriate personnel within its Company to make public statements, or issue news releases regarding the accidental discharge, and Subcontractor specifically agrees that on all such occasions, he/she shall consult SLAC before making any public statements or issuing any press releases, which would identify SLAC by name. The Subcontractor shall report all such spills or leaks, regardless of their quantity, to SLAC immediately (within one hour) upon discovery to discuss contact (if warranted) of the federal, state or local agencies. A written follow-up report shall be submitted to SLAC no later than 24 hours after the initial telephone report. The written report shall at a minimum include the following: description of material spilled, time and location of spill, amount spilled and whether it is a reportable quantity, containment procedures initiated, description of clean-up procedures and disposal decision of spill residue. 4.Materials, Equipment and Documentation All equipment and materials required to perform emergency response services shall be provided by the Subcontractor. Containers for collection of waste materials may also be provided by WM as agreed upon between the Subcontractor and WM or designated delegate on arrival of the Subcontractor to the SLAC site. All documents and markings (i.e. Manifests, DOT Labels, LDR's) for the storage and/or shipment of waste containers that are completed by the Subcontractor, shall be reviewed and approved by WM personnel. Shipping documents may also be prepared by WM as agreed upon between the Subcontractor and WM. 5.Rates A schedule of labor rates will be provided for •Straight Time (7:30AM - 3:30PM) Monday - Friday •- Overtime (3:30PM - 7:00AM) Monday - Friday •- Overtime (All day Saturday and Sunday) A rate of material and equipment costs will be provided for all materials and equipment supplied.
