- This is a NOTICE OF INTENT TO AWARD A SOLE SOURCE CONTRACT using Federal Acquisition Regulation (FAR) Part 13 Simplified Acquisition Procedures and FAR Part 12 Acquisition of Commercial Items. The Nuclear Regulatory Commission (NRC) intends to make a sole source award to Low-Level Radioactive Waste Forum, Inc. (LLWRF). The NRC has a requirement for the "Federal Associate" Membership with LLWF for a period of performance of a base year and two option years. LLWRF is the sole source available for such membership, as it is a one of a kind, independent, non-profit corporation dedicated to information sharing regarding low-level waste issues. The Forum's objectives include: facilitating state and interstate compact implementation of the federal Low-Level Radioactive Waste Policy Amendments Act; educating policy makers and the public about the management and disposal of low-level radioactive waste and about the aims of the federal legislation; fostering information sharing among state and interstate compact officials; providing opportunities for state and interstate compact officials to exchange views with federal officials and other interested parties; and supporting the goals of interstate compacts. The proposed contract is for supplies for which the Government intends to solicit and negotiate with only one source, under Simplified Acquisition Procedures (SAP), authorized by FAR Subpart 13.106-1(b)(1). For purchases not exceeding the simplified acquisition threshold, contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source responsibly available. Interested parties may identify their interest and capability to respond to the requirement. Any response to this notice must show clear and convincing evidence that competition would be advantageous to the Government in future procurements. TELEPHONE RESPONSES WILL NOT BE ACCEPTED. This notice is not a request for competitive proposals or a solicitation of offers. A determination by the Government not to compete this proposed effort on a full and open competition basis, based upon the responses to this notice, is solely within discretion of the Government.
