- JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION 1. Contracting Activity:Department of Veterans Affairs (VA) Office of Acquisition Operations Technology Acquisition Center 23 Christopher Way Eatontown, NJ 07724 2. Description of Action: The proposed action is to include brand name specifications in a firm-fixed price (FFP) contract for Unify OpenScape Voice Core system hardware, software, licensing, upgrades, and services. 3. Description of the Supplies or Services: VA, Office of Information and Technology, Veterans Integrated Services Network (VISN) 7, requires a software upgrade of its Unify OpenScape Voice Core system, a conversion of the existing 4-digit telephone extensions to 6-digit extensions, and an optional task to install a centralized call recording application on the Unify OpenScape Voice Core system. Unify OpenScape Voice Core system provides telephone capabilities throughout VISN 7 and is a proprietary Public Branch Exchange (PBX). The Unify OpenScape Voice Core software upgrade brings the Unify communications application up to the current software Version 7, which enables more user features such as follow-me capability, and support for teleworking. The conversion of the existing Unify PBX extensions from four to six digits will allow for current and future projected expansion of the phone system; and the optional task for the installation of a call recording application will provide centralized recording of authorized conversations with storage of the calls in a secure centralized location. The period of performance shall be 12 months from award. The estimated value of the proposed action is $266,774.24, including the optional task. 4. Authority: The statutory authority permitting other than full and open competition is 41 U.S.C.3304(a)(1) as implemented by the Federal Acquisition Regulation (FAR) 6.302-1 entitled, "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements." 5. Rationale Supporting Use of Authority Cited Above: Based on market research, as described in section 8 of this document, it has been determined that limited competition is available for this procurement. Accordingly, this is a brand name justification in accordance with FAR 11.105, Items Peculiar to One Manufacturer. Unify OpenScape Voice Core system provides telephone capabilities throughout VISN 7. Unify is the manufacturer of both the hardware and software and is the sole proprietor of Unify PBX hardware and software. Only Unify brand name PBX hardware and software can be fully integrated with the existing Unify OpenScape Voice Core system. The installation of another manufacturer's PBX hardware and software would result in interoperability and compatibility issues resulting in the loss of all telephone capabilities. Additionally, only Unify certified technicians are authorized to make changes to Unify systems, to include the installation of telephony applications, in order to comply with the terms of the maintenance agreement, or the warranties will be void. 6. Efforts to Obtain Competition: Market research was conducted, details of which are in the market research section of this document. This effort did not yield any additional sources that can meet, or whose solutions can be modified to meet, the Government's requirements, other than Unify or authorized Unify resellers. It was determined however that limited competition is viable among authorized resellers for this brand name item. Additionally, the proposed action will be synopsized on the Federal Business Opportunities (FBO) Page in accordance with FAR 5.201, and the justification along with the solicitation will be made publicly available in accordance with FAR 6.302-1(c). 7. Actions to Increase Competition: The Government will continue to conduct market research to ascertain if there are changes in the market place that would enable future actions to be competed. 8. Market Research: Market research efforts were conducted by Government technical experts July 2015 to determine if other manufacturers' products could be integrated into the Unify OpenScape Voice Core system. While other sources, such as Avaya, NEC, and Cisco, products and services have the general capabilities needed to fulfill the proposed effort, only Unify brand name hardware, software, and services can meet all of VA's needs. It was determined that no other brand is interoperable with the existing Unify OpenScape Voice Core system. Additional market research was conducted in August 2015 to determine if limited competition is available for this effort. A review of Unify's website yielded two large business resellers, confirming that limited competition is viable for this acquisition. 9. Other Facts: VISN 7 has standardized on the Unify PBX Platform for all sites. This standardization has enable VISN 7 to lower PBX costs by providing first line support by VA Unify trained staff. VISN 7 telecommunication staff can provide support services to the other Unify sites across the VISN thus reducing costs and mean time to issue resolution. ? 10.
