Description
The U.S. Fish and Wildlife Service has a requirement for a road maintenance contract to maintain approximately 60 miles of dirt/gravel road on the Hakalau Forest Unit and Kona Forest Unit, Hilo HI (Hawaii County). Performance period is for a base year and project includes four option years to be exercised solely at the discretion of the Government. Project is a small business set-aside. Applicable NAICS code is 237310. Small business size is defined as $36.5 million or less annually when averaged over a three year period. If a site visit is desired, please contact Cashell Villa at (808) 443-2300, ext 229. Work is identified as follows: SPECIFICATIONS AND GENERAL CONDITIONS I. SUMMARY OF WORK Hakalau Forest National Wildlife Refuge is located approximately 39 road miles in a northwesterly direction from Hilo, Hawaii, and situated between 2,500 and 6,500 feet in elevation. The Kona Forest Unit, includes 5,300 acres on the drier, leeward side of the island and is approximately I 00 miles from Hilo and 25 miles from Kona. Proposals are requested for provision of equipment (crawler-dozer, wheel loader, all-wheel drive or articulated big-wheel dump trucks, etc.), with operators to maintain approximately 60 miles of dirt/gravel roads on the Hakalau Forest Unit and Kona Forest Unit. 2.DESCRIPTION OF TERRAIN AND EXISTING ROADS The terrain is rolling with gentle to steep slopes and is bisected with numerous gulches, streambeds, and channels. Both units have a substrate of rock and scattered rock with deeper soil found on the Hakalau Unit. On both units the rainfall is high to moderate, so there are muddy and marsh areas; the lower elevations are forested with koa and ohia trees and a scattered understory of native plants. On the Kona Unit the lower elevations also contain a lot of invasive non-native weed species. The existing roads were created during the past 50 years by cattle ranchers with minimal effort, mostly by repeatedly driving over the same track with a 4x4 pickup or a bulldozer hauling a cattle trailer. A few of the roughest and steepest areas have been cut or filled by a bulldozer. Some stretches have been surfaced with gravel that has been pushed from nearby ridges or hauled from bon'ow pits or streambeds, but most sections are dirt surface which makes them impassable during the frequent rainy periods. The boundary roads found in Kona were constructed in 2009 prior to construction of the fence. Most of the roads run upslope and downslope to minimize gulch crossings which are especially subject to erosion. Approximately 40 miles of road on the Hakalau Unit and 25 miles on the Kona Unit 3.EQUIPMENT AND LABOR The Contractor will provide operators and heavy equipment including but not limited to: bulldozer, excavator, loader, dump truck, roller, grader and other equipment deemed necessary for the job. Some projects may require the use of ground crews with machetes, weed eaters, and/or chainsaws to clear brush, trees and other vegetation away from sensitive structures or vegetation hanging over the roadways. The Contractor is also responsible for mobilization and demobilization of equipment, as well as fuel maintenance. 4.PROJECT DESCRIPTION The project will involve cut-and-fill work by a bulldozer to reduce grades, fill mudholes and marshy areas, cut rock outcroppings, and control erosion. Gravel will be mixed from designated areas by pushing it into stockpiles with a bulldozer or pulling it up with an excavator. The gravel will be loaded using a screen or other similar equipment provided by the Contractor loaded into a dump truck(s) and hauled for distances generally less than three miles to road sections where it will be dumped, then spread and graded with a bulldozer. For stretches where the roadbed is especially soft or wet, the Government may provide "road stabilization fabric" which the Contractor will lay down and then spread gravel over. Work will be done under the general direction of the Project Engineer and the Refuge Manager, who will designate the gravel sources and give weekly or daily work assignments. The Contractor is expected to perform the work without detailed instructions and without direct or constant supervision. The Government may, on an infrequent basis, require the Contractor to provide additional labor or equipment, other than that specified in the bidding schedule, which may be necessary for the successful completion of a project. When this occurs, the Government will request a proposal from the Contractor and negotiate as equitable price for accomplishing the additional work. 5.WORK SCHEDULE Since the weather tends to be drier during the summer and fall, most work will be scheduled during these periods. 6.DRAWINGS Drawings for specific road maintenance segments will be available when task order is assigned. 7.PROTECTION OF ENVIRONMENT a.All contract operations shall be conducted within compliance of all federal, state, and local environment laws and regulations. This condition applies to, but is not limited to, laws and regulations governing noise levels, air and water quality standards, and cultural resources. Compliance with cultural resources requirements will be approved by the Regional Archeologist, designated elsewhere in this contract. b.If the Contractor fails or refuses to promptly comply with the requirements of subparagraph a. above, the Contracting Officer or his authorized representative, shall notify the Contractor of any noncompliance and indicate to the Contractor the action to be taken. The Contractor shall, after receipt of such notice, immediately correct the conditions to which attention has been directed. Such notice, either oral or written, when served on the Contractor or his representative(s) at the site of the work, shall be deemed sufficient. c.In the event the Contractor fails or refuses to promptly comply with the compliance issued under subparagraphs a. and b. above, the Contracting Officer may issue an order to suspend all or any part of the work. d.When satisfactory corrective action is taken, an order to resume work will be issued. The Contractor shall not be entitled to any extension of time, nor to any claim for damage or to excess costs by reason of either the directive or the suspension order. 8.OPERATORS The Government shall have the right to object to the assignment of any operator who fails to perform competently on any of the equipment, and the Contractor shall replace any personnel deemed unsatisfactory. The Contractor shall assure that all operators are competent and will exercise good judgment in the operation of the equipment. The Contractor shall assume all responsibility for any equipment that is unable to operate because of machine breakdowns or becoming stuck because of soft or unstable terrain. It is the Contractor's responsibility to ascertain that the equipment being used is able to traverse or work the area in question. If in this opinion the equipment is incapable of doing the work, the Contractor must notify the Contracting Officer. 9.COMMENCEMENT, COMPLETION OF WORK AND NOTICE TO THE CONTRACTOR Work must commence within 10 calendar days after receipt of notice to proceed. The Government Engineer designated as the authorized representative of the Contracting Officer will select work sites, direct all work which shall be done in accordance with his instructions and to his satisfaction, maintain records of operating and moving time and time lost because of breakdowns, and notify the Contractor of the time that work shall cease for any and all of the equipment to be rented.. When any piece of rented equipment is no longer required by the Government, the representative of the Contracting Officer will notify the Contractor of the time that work shall cease, and no payment will be made by the Government for any work performed after such notification is given. Notice to the operator of the particular piece of equipment shall constitute notice to the Contractor. 10.RECORDS OF HOURS WORKED A working service hour meter with a removable chart shall be installed on the crawler/dozers, excavator and loader and the chalis shall be removed, dated, and signed by the equipment operator or foreman at the end of each day and shall be given to the Government representative. This record of hours of operation shall determine the amount due for the day's operation. The operator of the equipment will not be required to work more than eight hours per day. 11.SUSPENSION OF WORK a.Weather The Contracting Officer may suspend the work for such period or periods as are necessary because of extended unsuitable weather conditions or for such other conditions as may be unfavorable for the prosecution of the work. b.Equipment/Operation The Contracting Officer shall also have the authority to suspend operations for such time as is necessary because of either faulty equipment or inefficient operation procedures of the Contractor as well as the failure to maintain the stakes, grades, and slopes. c.Archeological and Historical Discoveries The Contractor shall immediately stop work if paleontological, archaeological, or historical remains (including burials or skeletal material) are encountered during performance of this contract. The Contractor should promptly notify the designed Inspector or the Contracting Officer (if the Inspector is absent or one was not designated for this contract). After receiving such notification, the Contracting Officer will contact the Regional Archaeologist. so that the provisions of 36 CFR 800.7 (Resources Discovered During Construction) and other relevant laws are followed. Work will cease in the immediate vicinity until permitted by written order form the Contracting Officer. The Contractor may proceed with work in other areas approved by the Regional Archaeologist. SPECIAL CONTRACT REQUIREMENTS 1.RENTAL RATE The rate per hour of operation of the equipment described in the schedule shall include the rental rate of each piece of equipment to be furnished, the services of all operating or other personnel, cost of all fuel, oil, grease, operating supplies, repair parts, and maintenance or repair of the equipment. Cost of moving the equipment to the first site of operation and the cost of moving the equipment from the work site at the completion of the rental period shall be paid as a move-in, move-out cost item for each piece of equipment and not be included in the hourly operating rate. 2.OPERATING RATE For payment purposes, the term "operating rate" in the schedule shall have the following interpretations: The hourly rate for equipment operation will be stablished by individual task orders specific to applicable segments of work as determined at the time of task order implementation. The rate to be paid by the Government for the equipment, while such equipment is actually engaged in the performance of work or time involved in moving equipment from one work site to the next. The cost of moving equipment from one work site to the next shall not exceed the total of the move-in and move-out cost for the particular piece of equipment. The time utilized for maintenance, servicing or repair to equipment, equipment being unable to operate due to being stuck because of soft or unstable terrain, or equipment assisting an inoperable machine, shall not be considered as work performance and will be deducted. Two equipment stops per day of up to ten minutes each will be allowed. All other equipment stops will be deducted. 3.ACCIDENT PREVENTION The Contractor shall at all times exercise reasonable precautions for the safety of persons, whether his employees or not, and property in the performance of this contract, and shall comply with all applicable provisions of federal, State, and Municipal safety codes and building and construction codes, provided, that if such laws and codes are inapplicable by reason of the location of the contract site or for some other reason, the Contractor shall maintain the safety standards and practices equal to those that would apply except for such location or other reason. If the Contractor shall fail to exercise reasonably safety precautions or comply with any applicable safety law or code, the Contracting Officer may, by written order, suspend all or any part of the work under the contract, as in his judgment may be necessary for the protection of persons and property, until the unsatisfactory conditions are corrected. In the event of failure of the Contractor to promptly correct an unsatisfactory safety condition or continued failure of the Contractor to observe reasonable safety precautions or comply with any applicable safety law or code, the contract may be terminated. The Occupational Safety and Health Act (OSHA) will be our guide on all matters involving safety and accident prevention. All employees will be required to wear hard hats while working on this project. 4.ADDITIONAL SAFETY REQUIREMENTS In addition the Safety and Health requirements of clause 52.236-13 in Section I of this solicitation, roll-over protection and seatbelts required by 29 CFR 1926 shall be extended to include all equipment regardless of year of manufacture. 5.LIABILITIES OF THE CONTRACTOR The Contractor shall save the Government and all its representatives harmless from all suits, actions, or claims of any character arising out of the injuries to any person or damage to any property resulting from any neglect in safeguarding the work, and from any claim arising or recovered under the Workman's Compensation Laws or any other law, bylaw, ordinance, order or decree, or on account of any other act or omission by the Contractor or his employee while carrying on operations under this contract. The responsibility shall terminate when such suits, actions, claims have been satisfied. 6. ACCESS TO SITE Access to the work site from existing roads will be provided by Contractor at his own expense. The Government assumes no responsibility for the condition or maintenance of any road or structure thereon that may be used by the Contractor in performing the work under these specifications or in traveling to and from the site of work. No payment will be made to any contractor by the Government for any work done in improving, repairing, or maintaining any road or structure thereon for use in the performance of the work under these specifications. Roads subject to interference by the work shall be kept open. The Hakalau Forest Unit is approximately 2 hours from Hilo and the Kona Forest Unit is approximately 3 hours from Hilo. A 4-wheel drive vehicle is required to access both Refuge Units from the state highway. Both units are located in isolated areas with no public amenities available such as restaurants, repair, shops, etc. 7.PROTECTION OF PROPERTY The Contractor shall not enter upon private property for any purpose without first obtaining permission from the owner or his duly authorized representative, shall be responsible for the preservation of all public and private property along and adjacent to work contemplated under the contract, shall use every precaution necessary to prevent damage or injury thereto. He shall exercise due care in preventing, and shall be responsible for damages to structures of all kinds, whether owned by the Government or privately, and shall protect from disturbance or damage all land monuments until they have been properly referenced by the Engineer. 8.SPECIAL NOTICE The area where the work is to be performed may be wet and/or soft. It is the responsibility of the Contractor to select equipment which is capable of performing under the existing conditions. Contractors should submit any questions on this project directly to Karl Lautzenheiser at Karl_Lautzenheiser@fws.gov later than close of business on August 27, 2015. Questions will be consolidated and answers provided by issuance of an amendment the following week. Source selection process will be best value. Evaluation criteria is defined as follows: The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers; 1) Technical capability of the item offered to meet the Government requirement (not-to-exceed 3 pages); 2) Past performance (not-to-exceed 3 pages); and 3) Price (no page limit). Technical and past performance, when combined, are significantly more important that price.
