- KO Brand Name Determination Applicable FAR Clauses Statement of Work This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in the Federal Acquisition Regulation (FAR) Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. Under this requirement, the US Army, Corps of Engineers (USACE) intends to award a commercial, firm fixed price contract. This solicitation document incorporates provisions and clauses of those in effect through Federal Acquisition Circular 05-50. The associated North American Industrial Classification Standard (NAICS) Code is 334111 Electronic Computer Manufacturing. USACE intends to purchase Apple "Brand Name" hardware and software, in accordance with the Statement of Work (SOW) listed as Attachment 1, dated 4 Aug 2015, entitled COMPUTER EQUIPMENT for CLINs 0001-0010 and "Brand Name or Equal" for CLIN 0011. DEADLINE: Responses to this solicitation must be signed, dated, and received via electronic mail to the USACE Contract Specialist, Kimberly Wheeler at kimberly.wheeler@usace.army.mil. Quotes are due no later than 2:00 PM (Central Standard Time) on 17 Aug 2015. Responses should be marked with solicitation number W912DY-15-R-6514; these and all other correspondence may be directed to the above POC. All responsible sources may submit a quote. All offerors must register in the System for Award Management (SAM) database before they can be awarded a contract. You may register at http://www.sam.gov. SAM information, or help, is also available by calling 1-866-606-8220. The completed Offeror Representations and Certifications-Commercial Items (FAR 52.212-3) must be submitted along with each Quote. Offerors that fail to furnish the required representation information via submission, may be excluded from consideration. The Government will award a contract resulting from this solicitation to the responsible offeror whose offer, conforming to the solicitation, will be most advantageous to the Government, price and other factors considered. The contract will be awarded on a Lowest Price Technically Acceptable (LPTA) basis. Evaluation factors are listed under FAR 52.212-2 on Attachment 2. It is incumbent upon the offeror to submit sufficient information for the Government to determine technical acceptability and price. Failure to submit sufficient information for the government to determine technical acceptability or price may be cause for rejection of your quote. The Government intends to award without discussions. However, reserves the right to hold discussions, if necessary. Therefore, offerors should provide their best possible quote from a technical and pricing standpoint. NOTE: Vendor must provide, at time of submission, their Apple Authorized distributor information (POC, Phone Number, Reseller ID #) and/or any documentation supporting that the items are actually coming from that distributor, i.e. certification, letter or copy of invoice. Failure to provide such proof will be treated as non-responsive and your quote(s) will not be considered for award. To be considered for award, the offeror certifies that the product(s) being offered are original, new and Trade Agreements Act (TAA) compliant product, and that the subject products are eligible for all manufacturer warranties and other ancillary services or options provided by the manufacturer. Offeror further certifies that it is authorized by the manufacturer to sell the products that are the subject of this action in the US (i.e., that the products are TAA compliant and that the offeror is authorized to sell them in the US). Offerors are required to submit documentation with the offer identifying its supply chain for the product, and certifying that all products are new, TAA compliant, and in their original packaging. By making an offer, offeror also consents to no cost cancellation of the non-compliant awarded items if, upon inspection after delivery, any products provided are not recognized or acknowledged by the manufacturer as new and original products that are eligible for warranties and all other ancillary services or options provided by the manufacturer or that offeror was not authorized by the manufacturer to sell the product in the US, or that the product is in some manner not TAA compliant.
