Description
INTRODUCTION This is a pre-solicitation non-competitive (notice of intent) synopsis to award a contract without providing for full or open competition (including brand-name). THIS IS A NOTICE OF INTENT, NOT A REQUEST FOR PROPOSAL. A SOLICITATION WILL NOT BE ISSUED AND PROPOSALS WILL NOT BE REQUESTED. The National Institute on Drug Abuse (NIDA), Consolidated Station Support and Simplified Acquisitions (CSS/SA) Branch intends to negotiate and award a purchase order to Terason, a division of Teratech Corporation, for an ultrasound system without providing for full and open competition (including brand-name). NORTH AMERICAN INDUSTRY CLASSIFICATION SYSTEM (NAICS) CODE The intended procurement is classified under NAICS code 334516 with a Size Standard of 500 Employees. REGULATORY AUTHORITY The resultant contract will include all applicable provisions and clauses in effect through the Federal Acquisition Circular (FAC) 05-83 dated July 2, 2015. This acquisition is for a commercial item or service and is conducted under the procedures as prescribed in FAR subpart 13-Simplified Acquisition Procedures. This acquisition is NOT expected to exceed the simplified acquisition threshold. STATUTORY AUTHORITY This acquisition is conducted under the authority of the authority of FAR Subpart 13.106-1. DESCRIPTION OF REQUIREMENT Background: The National Institute of Neurological Disorders and Stroke (NINDS) is a part of the National Institutes of Health (NIH), conducting research into the causes, treatment, and prevention of neurological disorders and stroke. The NINDS mission is to seek fundamental knowledge about the brain and nervous system and to use that knowledge to reduce the burden of neurological disease. The NINDS Electromyography Section provides neurodiagnostic services to the NINDS and the NIH Clinical Center delivering vital information about the peripheral nervous system and muscles for both diagnostic purposes and use in clinical trials. A large portion of this work includes use of ultrasound equipment. The NINDS Electromyography Section is currently performing joint research studies using Terason uSmart ultrasound equipment with the NINDS Neuromuscular and Neurogenetic Disorders of Childhood Section. Purpose and Objectives The purpose of this acquisition is to provide the National Institute of Neurological Disorders and Stroke (NINDS) Electromyography (EMG) Section with one (1) Terason uSmart Ultrasound System, including a 12 MHz probe and a 7.5 MHz probe, to upgrade the EMG laboratory's capabilities to evaluate nerve and muscle disorders. To ensure continuity of science, only a Terason uSmart Ultrasound System is acceptable to meet the needs of this requirement. Project Description The Contractor shall provide the following: 1. One (1) Tersaon uSmart 3200 Ultrasound System [Manufacturer's Part No. 21-0001] 2. One (1) Terason uSmart 3200T Ultrasound Tablet [Manufacturer's Part No. 10-3232] 3. One (1) Terason uSmart 3200T Multi-Purpose Docking Station [Manufacturer's Part No. 10-3231] 4. One (1) Terason uSmart 3200T Accessories Kit [Manufacturer's Part No. 10-3230] 5. One (1) Terason Enhanced Needle Visualization (ENV) [Manufacturer's Part No. 10-3293] 6. One (1) Terason 15L4 uSmart Linear Array Transducer with system [Manufacturer's Part No. 10-3289] 7. One (1) Terason Standard 60-month warranty for the Ultrasound System [Manufacturer's Part No. WTY-60] 8. One (1) Terason 5C2 uSmart Curved Array Transducer [Manufacturer's Part No. 10-3278] 9. One (1) Terason One-Day One-Site Terason System Training in Bethesda Maryland [Manufacturer's Part No. 20-0007] 10. One (1) Terason uSmart 3200T Cart [Manufacturer's Part No. 15-38000] 11. The contractor shall provide shipping on a FOB Destination basis. Delivery Requirements/Period of Performance Delivery and installation of the above detailed equipment is required within sixty (60) days after contractor receipt of order. All equipment, including equipment shipped separately, must be received within the sixty day period. The above detailed equipment training is required within three (3) days following delivery and installation of the equipment. CONTRACTING WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME) DETERMINATION The determination by the Government to award a contract without providing for full and open competition is based upon the market research conducted. Specifically, only Terason, Inc. is capable of meeting the needs of this requirement to ensure continuity of science. Specifically, the NINDS EMG Section is currently working with the NINDS NNDC Section on joint research efforts and the NNDC Section utilizes a Terason uSmart® 3200T Ultrasound System for this work. In order to ensure standardized research data between the two labs for joint research efforts, the EMG Section must have the exact same system. It is imperative that the EMG Section and the NNDC Section utilize the same equipment because use of different equipment would skew data between the laboratories, jeopardizing scientific data and invalidating any research conclusions stemming from the data. Accordingly, only a Terason uSmart 3200T Ultrasound System is acceptable for this requirement. CLOSING STATEMENT THIS SYNOPSIS IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. However, interested parties may identify their interest and capability to respond to this notice. Responses to this notice shall contain sufficient information to establish the interested parties' bona-fide capabilities for fulfilling the requirement and include: unit price, list price, shipping and handling costs, the delivery period after contract award, the prompt payment discount terms, the F.O.B. Point (Destination or Origin), the Dun & Bradstreet Number (DUNS), the Taxpayer Identification Number (TIN), and the certification of business size. All offerors must have an active registration in the System for Award Management (SAM) www.sam.gov." A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement. All responses must be received by the closing date and time of this announcement and must reference the solicitation number.
