Description
SUBJECT: Notice of Intent to Award a Contract Modification Using Other than Full and Open Competition Synopsis: The United States Agency for International Development's Mission to Jordan (USAID/Jordan) intends to award a contract modification to Engicon for continued provisions of Construction Management Services for the Upgrade of Mafraq Wastewater Treatment Plant. The modification will provide a 12-month extension of these services at an expected cost of $442,992.01 which will increase the total estimated ceiling of the contract from $1,957,135.69 to $2,400,128.50 for USAID/Jordan Contract No 278-C-00-012-00003-00 awarded June 25, 2012. The additional funds will be used for continued construction management services of the Construction of the followings: • The Construction Contract of Mafraq WWTP Project: The host country contract for the construction of Mafraq WWTP was awarded to the U.S. firm N.A. Water Systems, for a total cost $23,354,662. • The construction of the Mafraq sewer trunk line: The construction of the $5.6 million trunk line was awarded by the Water Authority of Jordan as a variation order to the host country contract of the upgrade of Mafarq WWTP. • The Reuse Project for the Mafraq WWTP. The $3.0 million reuse construction contract. Due to the delay in the construction of the WWTP, the delay in awarding the reuse construction contract and the delay in the negotiation of the trunk sewer line variation order, the construction of these activities will not be completed by the time anticipated when the Engicon contract was awarded, hence the need to extend the Construction Management Contract becomes essential. The Authority permitting Other Than Full and Open Competition is FAR Subpart 6.3 "Other Than Full and Open Competition," paragraph 6.302, specifies the circumstances permitting other than full and open competition, including paragraph 6.302-1, "Only one responsible source and no other supplies or service will satisfy agency requirements." Paragraph 6.302-1(a)(2)(ii) states "Supplies may be deemed to be available only from the original source in case of a follow-on contract for the continued development or production of a major system or highly specialized equipment, including major components thereof, when it is likely that award to any other source would result in (A) Substantial duplication of cost to the Government that is not expected to be recovered through competition; or (B) Unacceptable delays in fulfilling the agency's requirements. A competitive process for delivery of these highly specialized services for a 12-month period would result in both substantial additional cost and unacceptable delays which would affect the construction contractor resulting in claim for damages as a result. The award of this contract modification is planned for July 5, 2015. Interested organizations may identify their interest and capability to respond to the requirements or submit proposals. This notice of intent is not a request for competitive proposals. A determination by the Government not to compete this proposed contract modification based on responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
