- JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION 1. Contracting Activity:Department of Veterans Affairs (VA) Office of Acquisition Operations Technology Acquisition Center 23 Christopher Way Eatontown, NJ 07724 2. Description of Action: This proposed sole source action is for a firm-fixed- price effort with Frontier Communications, 3303 West Commercial Blvd, Fort Lauderdale, FL 33309. 3. Description of the Supplies or Services: The proposed action is for Local Exchange Carrier (LEC) telecommunication services at the Capital Region Readiness Center (CRRC), Information Technology Workforce Development (ITWD), and National Service Desk (NSD) sites in West Virginia. These LEC services include plain old telephone services, Analog Voice Services, Primary Rate Integrated Services Digital Network (ISDN) service, and Basic Rate ISDN. The Contractor shall provide telecommunication services at each facility 24 hours per day, seven days per week with maximum service availability. The period of performance is three months, with three, 1-month option periods. 4. Statutory Authority: The statutory authority permitting other than full and open competition is 41 U.S.C. 3304(a)(1) as implemented by the Federal Acquisition Regulation (FAR) Subsection 6.302-1 entitled, "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements." 5. Rationale Supporting Use of Authority Cited Above: Based on market research which can be found in section 8 of this justification, it was determined that currently Frontier Communications remains the only responsible source capable of satisfying VA's requirements. No other contractor can provide the required services because they do not have access to the proprietary technical data within the existing Frontier Communications infrastructure. Only Frontier Communications possesses the necessary proprietary data for the existing Frontier Communications infrastructure to complete the services, such as pushing upgrades, etc.. VA does not own the proprietary data. Failure to access the Frontier Communications infrastructure would result in an inability to access the CRRC, ITWD, and NSD. 6. Efforts to Obtain Competition: Market research was conducted, details of which are in section 8 of this justification. This effort did not yield any additional sources that can meet the Government's requirements. There is no competition anticipated for this acquisition. Additionally, the proposed action will be synopsized on the Federal Business Opportunities Page in accordance with FAR 5.201. Any proposals that are received shall be evaluated. 7. Actions to Increase Competition: Future requirements shall be competed under the National LEC indefinite delivery, indefinite quantity contract which was awarded on February 27, 2015. 8. Market Research: Market research consisted of the VA Designated Agency Representative (DAR) conducting extensive research from September 2014 through March 2015 using the General Services Administration (GSA) Portals Washington Interagency Telecommunications System 3 and Networx to search for the telecommunication services that are needed at the three sites in West Virginia. The DAR also contacted all GSA contracted telecommunication providers such as AT&T, Century Link, Verizon, and Level 3 to inquire if LEC service was available in Martinsburg and Falling Waters, WV. It was determined that, while there were other sources that could provide similar services, no other sources were available with the technical services and proprietary data to support the Frontier communications infrastructure. Based on this market research the technical team determined that no other LEC has the ability to provide telecommunication services required to support for three VA Central Office facilities in Martinsburg and Falling Waters, WV. 9.
