Description
JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION (OVERSEAS CONTRACTING ACTIVITIES) 1. I recommend that U.S. Embassy Moscow use other than full and open competition for the acquisition of Honeywell alarm parts/sensors for subsequent installation in Rosinka housing complex by the Russian company "OOO Perviy Spezmontazh". The estimated cost of equipment/parts purchase is 16,080.00 U.S. dollars. 2. Nature and/or description of the action being approved: Forego Foreign Acquisitions Regulation Part 6 - Competition Requirements 3. A description of the supplies or services required to meet the agency's needs. The new residential security standards updated in October 2014 require the Post to install alarms in all residences throughout the housing pool. The management of Rosinka residential complex already facilitates installation and monitoring of the alarms through the locally contracted company for non-Embassy units. The Embassy must provide Honeywell alarm equipment/parts - the only sensors that fit the contractor's technical specifications in all (44) Embassy residences in Rosinka and which will be connected to the Central Alarm Monitoring Station located in Rosinka. An identification of the statutory authority permitting other than full and open competition. Circumstances permitting other than full and open competition: The following statutory authorities (including applications and limitations) permit contracting without providing for full and open competition. Requirements for justifications to support the use of these authorities are in FAR 6.303. a. Only one responsible source and no other supplies or services will satisfy agency requirements. (i) Authority - Citations: 10 U.S.C. 2304(c)(1) or 41 U.S.C. 253(c)(1). (ii) When the supplies or services required by the agency are available from only one responsible source, and no other type of supplies or services will satisfy agency requirements, full and open competition need not be provided for. (iii) Limitations: (1) Contracts awarded using this authority shall be supported by the written justifications and approvals described in 6.303 and 6.304. (2) For contracts awarded using this authority, the notices required by 5.201 shall have been published and any bids, proposals, quotations, or capability statements must have been considered.] The alarm equipment/parts must meet the technical specifications and frequency standards of the alarms monitoring system established by local vendor in Rosinka. Local vendor uses alarm equipment/parts manufactured by Honeywell Company. No other vendor's equipment will work with the master alarm system. Thus, the required alarm parts fall under the "Only Responsible Source" category. 6. A demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited (for sole source acquisitions; also required for unusual and compelling urgency where more than one offer will not be solicited). Not applicable. The limitation applies to the brand name only, while supply sources may vary. The required alarm equipment/parts must be Honeywell alarm sensors. 7. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable. The description should include whether a FedBizOpps notice was or will be publicized, as required by FAR 5.2, and if not, which exception under FAR 5.202 applies. It is expected that the requested supplies (Honeywell alarm sensors) are advertised in FedBizOpps to ensure that the supplies offers are solicited from as many potential sources as possible. 8. A determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable. The comparison with similar items searched in the Internet demonstrates that the prices for alarm transmitters vary in the range of $35-50, and therefore stay within 10% of the Honeywell transmitters prices. 9. A description of the market survey conducted and the results or a statement of the reasons a market survey was not conducted. Not applicable. 10. Any other facts supporting the use of other than full and open competition. Not applicable. 11. A listing of sources, if any that expressed, in writing, an interest in the acquisition. None. 12. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required. Not applicable.
