- Sources Sought Notice INTRODUCTION: In accordance with Federal Acquisition Regulation (FAR) 52.215-3, "Request for Information or Solicitation for Planning Purposes" The attached Sources Sought (SS) Notice/Request for Information (RFI) is for information and planning purposes only at this time and shall not be construed as a solicitation or as an obligation on the part of the Department of Veterans Affairs (VA). REQUIREMENT: The Department of Veterans Affairs, Veterans Integrated Service Network (VISN) #4 is in the process of planning procurement for, for the disposal and/or recycling of hazardous and specialized waste materials, as outlined in this specification. PURPOSE: The VA is conducting market research and is seeking written responses with information to assist the Government with identifying potential sources that are interested in and capable of performing the work described in the draft Statement of Work (SOW) below. If your company is licensed and capable of providing services described, please respond electronically to timothy.russell@va.gov with company capabilities, business size, and Dunn's number. The Government is also seeking to obtain industry comments and questions regarding the planned PWS. DISCLAIMER: This SS/RFI notice is issued solely for information and planning purposes and does not constitute a solicitation or obligation on the part of the Government. Per FAR 15.201(e), responses to this notice are not considered offers, shall not be used as a proposal, and cannot be accepted by the Government to form a binding contract. Neither unsolicited proposals nor any other kinds of offers will be considered in response to this notice. No evaluation letters and/or results will be issued to the respondents; however, the Government does reserve the right to contact any respondent and/or respondent reference to obtain additional information. At this time no solicitation exists; therefore, please do not request a copy of the solicitation. Statement of Work Hazardous Waste VISN 4 I.SCOPE OF SERVICES: A.Contractor shall provide services to Department of Veterans Affairs Medical Centers in Veterans Integrated Service Network (VISN) #4, for the disposal and/or recycling of hazardous and specialized waste materials, as outlined in this specification. Waste disposal from each facility will be requested by the point of contact or designee at each site. The contract does not include disposal of infectious or radioactive wastes. Specified services shall be provided by the contractor for all ten (10) VA Medical Centers (note: Pittsburgh has 2 sites) for the contract period and during the option renewal years should the Government choose to exercise the option. (Contractor is advised renewal is at the Option of the Government. Refer to FAR 52.217-9.) The sites of the VA Medical Centers where pickup will occur, points of contact, alternates and telephone numbers for each are listed on the next page. B.Services to be provided: Contractor shall furnish all services, material and equipment necessary for sorting and packaging of wastes, to include providing appropriate containers and qualified personnel necessary for the preparation, labeling, manifesting, transporting and disposal of waste materials specified in this contract. The Government will not provide any material handling equipment or packing supplies. All services shall be provided in accordance with local, state and federal regulations. C.Schedule: Contractor shall schedule disposal pick-ups in advance by contacting the Medical Center point of contact or alternate. Disposal pick-ups are to be scheduled during normal business hours of the Medical Centers, at a mutually agreeable time between the Medical Center and the contractor. Normal business hours are 8:00 a.m. to 4:00 p.m., Monday through Friday. Pick-ups outside of normal business hours will only be done with the approval of the Medical Center point of contact or alternate. NOTE: "Monday - Friday" excludes Government Holidays for all locations. Government Holidays include New Year's Day, Washington's Birthday, Martin Luther King Jr. Day, Memorial Day, Independence Day, Labor Day, Columbus Day, Veterans' Day, Thanksgiving and Christmas. D. Multi-Site Complexes:Medical Centers may require waste to be picked up at multiple buildings or sites that are part of the medical center complex (i.e., 2 divisions/sites in Pittsburgh). E.Definition of Hazardous Waste: For purpose of this contract, hazardous waste shall be as described below or as identified in the references shown: 1.CFR 40, The Resource Conservation and Recovery Act. 2.The Pennsylvania, Delaware and West Virginia hazardous waste regulations. 3.Materials which exhibit characteristics of reactivity, ignitability, corrosiveness or extraction procedure toxicity. 4.Materials which are regulated and referenced by federal and state regulations regarding specialized disposal. The services of this contract do not include special handling wastes such as infectious, chemotherapeutic, radioactive waste or explosives. 5.All wastes listed in Sections II and III of this specification, and additional materials which any of the medical centers wishes to dispose of as hazardous in order to ensure safety and health. 6.Unidentified waste materials. F.Characterizing Unknown Materials: The contractor shall identify or characterize unknown material(s) and will indemnify and hold harmless the Department of Veterans Affairs Medical Centers for any and all damages resulting from material(s) labeled as unknowns. No analytical work, other than on-site characterizations, will be performed without the consent of the medical center point of contact. The medical center point of contact may elect to submit a sample of the unknown material(s) to the contractor in advance of the scheduled pickup for detailed classification. This material would then be included with the next scheduled pickup at the cost provided under Item #55 Chemist Fee. G.Classification and packaging of wastes for transportation, labeling of containers and providing a list of containers along with their assigned container numbers and hazard classifications shall be performed by the contractor's personnel in accordance with all applicable laws and regulations in effect at the time of the contract award and in accordance with all applicable laws and regulations that become effective during the term of the contract. Contractor shall provide all materials necessary for safe packaging in compliance with the applicable regulatory requirements. A detailed inventory of the contents of each drum shall be prepared as the wastes are packaged. A copy of this inventory shall be left with the DVA Medical Center. H.Disposition of materials shall be by recycling, incineration, fuel blending or acid base neutralization. Any chemicals which cannot be processed by these methods must be processed according to EPA's best demonstrated available technology procedure (BDAT). I.A minimum of two (2) workers shall be provided for each lab pack project. J.In non-emergency situations, contractor shall initiate packaging and removal of wastes as follows: 1.Initiate packaging of hazardous wastes for disposal within ten (10) business days of receiving telephone notification that waste disposal services are needed. Telephone requests for waste disposal may be made by any VA Point of Contact or their alternate, or the Contracting Officer. 2.Packaged wastes shall be removed from the facility and transported to a TSD (temporary storage and disposal site) or point of final disposition within five (5) business days after packaging. 3.If any waste requires a special permit to be issued before it can be transported to a TSD site, the Contractor shall immediately notify the Contracting Officer or his designee that a special permit is required to move the waste, and of the approximate length of time that will be needed to obtain the necessary permit. The contractor will be permitted to leave only the special permit waste at the medical center until the necessary permit can be obtained, but in no case for more than 45 calendar days. Wastes which require special permits for disposal, but not for transportation, shall be removed from the medical center within five business days after packaging and taken to a TSD for holding until the necessary disposal permits can be obtained. II. GENERAL REQUIREMENTS: A.Contractor shall perform services at VA Medical Centers in Pennsylvania, West Virginia and Delaware. Contractor represents and warrants that it and any subcontractors shall comply with all federal, state and local laws, rules or regulations concerning the packaging, removal, transportation and disposition of hazardous wastes. B.Subcontractor Requirements: Where subcontractors are employed, the subcontractor shall meet the requirements of the contract. Disputes involving the performance of the contractor or subcontractor shall be referred to the Contracting Officer. C.Contractor and all of its subcontractors shall have at least three (3) years' experience in hazardous waste operations and disposal. Contractor warrants that it and all of its subcontractors understands the currently known hazards and risks which are presented to humans, property and the environment by the handling, packaging, receipt, transportation, storage and disposal of all material accepted for disposal. Contractor also warrants that it and all of its subcontractors are engaged in the business of providing the services specified in the proposed agreement and has the requisite expertise in the conduct of that business. D.Contractor and all of its subcontractors shall indemnify, defend and hold the Department of Veterans Affairs harmless from all loss, damages, liabilities, fines, penalties, claims, suits, costs and expenses incidental thereto arising out of, directly or indirectly, contractor's or subcontractor's breach of its warranties, obligations, representations hereunder, or for contractor's or subcontractor's negligence in the performance of services hereunder. E.Contractor agrees that each party is and shall perform this Agreement as an independent contractor, and as such, shall have and maintain complete control over all of its employees, agents and operations. Neither party nor anyone employed by either party shall represent, act, purport to act or be deemed to be the agent, representative, employee or servant of the other party. F.Use of Approved Facilities: The contractor shall transport waste only to approved, properly licensed and permitted facilities. If wastes require the use of a subcontracted waste disposal facility, the contractor shall be responsible for assuring that the subcontracted facility meets all applicable regulations for licensing and permits. G.When documents of waste shipments from any of the medical centers are required to be submitted to regulatory agencies, the contractor shall provide a copy of the documentation to the designated medical center point of contact. H.Spills/Leaks Occurring During Processing: The contractor shall be responsible for cleanup of all spills or leaks that occur during the packaging or transportation process. Clean up shall be in accordance with all applicable regulations. Decontamination shall be to background levels. The contractor shall report all spills/leaks that occur on the medical center property immediately to the designated medical center point of contact. Spills or leaks that occur during transportation of the materials shall be reported to the medical center point of contact within 24 hours of the occurrence. A written report of the circumstances of the leak/spill shall be sent to all regulatory agencies, as outlined by the regulatory agencies' spill notification procedures/guidelines. A copy of the written report shall also be furnished to the medical center point of contact. I.The contractor shall ensure that vehicles used for transportation of hazardous materials are stocked with sufficient supplies to handle hazardous materials that require special packaging, spills, leaking drums or other conditions that could occur while performing a routine pick-up. J.All permits and licenses required by local, state or federal regulation, or by this specification, shall be made available to the Contracting Officer within five (5) days of request. K.Termination: The Contracting Officer or his designee shall have the right to terminate this Agreement immediately without any further obligations to the contractor in the event that the contractor breaches any of the terms and conditions of this Agreement, commits any illegal or wrongful act, or no longer has in effect the required insurance coverage. L.The Contracting Officer reserves the right to reject the use of any transporter or waste disposal site based on a history of environmental fines or violations issued against the transporter or the disposal site. The contractor shall notify the Contracting Officer, in writing, of the closure of any approved disposal site, or the deletion or proposed addition of any disposal site. All waste materials shall be handled and disposed of in full compliance with existing permits and restrictions governing each disposal facility. M.Invoices: Contractor shall submit all invoices in arrears and addressed as follows: Department of Veterans Affairs Financial Service Center P.O. Box 149971 Austin, TX 78714 Each invoice shall include the following information: 1.Identification of the Medical Center receiving services to include appropriate purchase order number as provided by each facility. 2.Date of service and an itemized description of all services performed, including quantity and classification of waste according to this specification (example, organic wastes, inorganic wastes) and a description of all additional fees and transportation charges. 3.Copy of waste manifest(s) N. Recycling: Contractor shall use recycled content or post-consumer content products the fullest extent possible in execution of this contract. Contractor is also responsible to recycle as much of the waste and by-products of these services as possible. Examples of products that might be recycled include but are not limited to steel, copper, recyclable electronic devices, etc. The contractor shall keep a manifest of all recycled content products used in execution of this contract. The manifest shall identify recycled content products used in execution of the work with approximate quantities. Contractor shall also keep a manifest of all wastes and by products recycled as a result of the execution of this contract. The manifest shall identify products recycled along with approximate quantities. Contractor shall submit copies of manifests reflecting all recycled products used in the contract or recycled as a result of work done under this contract to the COTR. Manifests shall be submitted by the fifth workday of each calendar quarter (January, April, July, October) and shall cover the previous calendar quarter. Negative reports are required. III. DOCUMENTATION: The following documentation must be provided before contract award and may be submitted with contractor's bid. The Contracting Officer reserves the right to verify the reported violation history as well as all other information provided for the contractor and its proposed subcontractors. A.Description of Firm: Contractor shall submit a description of the firm, its general nature and background, and experience (including the number of years) in the hazardous waste business. B.Name and addresses of the firm and its parent company, if applicable. C.Name, address and telephone number of the particular office that will be responsible for the field personnel and operations of this contract. D.Name, address, Federal I.D. number and E.P.A. identification number for each of the following that will be utilized in the performance of this contract: 1.Disposal contractor and subcontractors 2.Waste haulers 3.Disposal sites E.A list of at least three references which utilized the services of the firm for lab packing within the past three (3) years. For each reference, include a description of the services provided, the name of a contact person familiar with the service and his/her telephone number. References associated with healthcare institutions are preferable. F.A list of any environmental fines, violations, indictments or convictions which have been levied against the firm or its parent company, and any of the its officers or employees during the period of 01/01/13 through 12/31/2014. This list must include dates, names, location where violation occurred, charges, amounts and final dispositions, including those presently being appealed. 1.If the contractoror any of its proposed subcontractors has received three (3) or more Class I violations in the States of Pennsylvania, West Virginia or Delaware during the period of 01/01/2013 through 01/31/2014, the contractor may not be eligible to be considered for award. 2.If no violations have been issued to the contractor or any of its proposed subcontractors, the contractor shall submit a statement to that effect. G.Proof that contractor carries insurances required by the section, General Requirements. Certificates listing the VA Medical Centers covered by this agreement shall be provided within thirty (30) calendar days of contract award as specified in the section, General Requirements. H.If any subcontractors will be used, the information required by Section VI. B. paragraphs 1 - 8 shall also be provided for each subcontractor. I.Verification of Training: A letter verifying that all current employees of the contractor and its subcontractors have received training in the handling and disposal of hazardous wastes. The letter shall also verify that the company has a program in place to assure that newly hired employees are trained. J.A statement verifying that all vehicles are appropriately permitted and registered, and that all operators are currently licensed. IV. POST AWARD SUBMITTALS: The successful bidder shall submit the following documentation to the Contracting Officer within thirty (30) calendar days of contract award: A.Contractor shall provide certificates of insurances listing each of the medical centers covered by this specification. In the event that an option year renewal is executed, certificates of continuing coverage through the period of the renewal agreement shall be provided within thirty (30) calendar days of award of the option year renewal. Contractor shall not reduce or cancel this insurance nor allow it to expire during the term of the contract. If for any reason any of the insurance required by this contract is reduced, canceled or expires, contractor shall so notify the Contracting Officer, in writing, within 24 hours. B.Disposal Sites: Within thirty calendar days of contract award, the contractor shall submit to the Contracting Officer a list of all disposal sites the contractor plans to use in the execution of this contract. The list shall include the facility's name, address, EPA identification number and the type of treatment provided. The list shall also include a description of any environmental fines or violations issued against the disposal site during the past two years, including date(s), nature of violation, amount of fine and final disposition. 1.This information is in addition to the requirement that the Contractor provide the name, location, Federal and EPA Identification numbers for the landfill. V.SPECIAL SITUATIONS: A.Additional Hazardous Waste Disposal: The chemical product classifications listed in this specification are not all inclusive and special situations that require hazardous waste disposal services may occur at any of the medical centers. If such services are required, the fee for service will be negotiated by the contracting officer (or designee) at the time the service is needed. B.Emergency Situations: If an emergency occurs at any of the medical centers, contractor shall be required to respond within eight (8) hours to provide services for clean-up, manifesting, and transport of hazardous materials to the disposal site. The cost for emergency services will be negotiated at the time such services are used and will be based on reasonable and customary charges in effect at the time of the emergency. A separate Purchase Order will be issued for the services. Response time is critical and will be STRICTLY enforced. VI.TRAINING REQUIREMENTS: A.The contractor shall comply with all regulatory requirements, and standards regarding the packing, transporting, and disposal of hazardous waste that are current or that become effective during the term of the contract.. VII. MANIFEST AND CERTIFICATE OF DESTRUCTION: A.The contractor shall manifest all hazardous waste shipments in accordance with the applicable laws and regulations in effect at the time of contract award, or that become effective during the term of the contract. The contractor shall verify that all information is accurate and correct before completing the document and before the generator signs the manifest. Copies of the manifest shall be provided to the medical center point of contact, in accordance with applicable state, local and federal regulations within 45 calendar days of waste shipment. B. In addition to the waste manifest, Contractor shall provide "Certification of Disposal/Destruction" upon destruction/disposal within 45 calendar days. The Certification of Destruction will indicate facility, date and time of destruction of hazardous waste. VIII.TRANSPORTATION: A.The contractor shall be responsible for the transportation of hazardous waste in accordance with all local, state and federal regulations. The contractor shall possess documentation of current hazardous waste transportation permits and/or licenses for all states which may be traversed in route to the transfer, storage and disposal facilities. B.When hazardous wastes must be transported through jurisdictions which require special permitting, the contractor shall obtain all necessary permits. C.Contractor shall assure that all vehicles used for the transportation of hazardous wastes are properly registered and that operators are currently licensed for the Class of vehicle being operated. D.All contractor vehicles shall be placarded and equipped in accordance with Department of Transportation regulations of the applicable state and of the US DOT. Vehicles shall contain all emergency equipment required by DOT. IX.RIGHT TO INSPECT: The contractor agrees to allow representatives of the Department of Veterans Affairs the right to inspect transportation vehicles and containers and to inspect the transportation, storage, treatment and disposal operations conducted by the contractor in the performance of this contract. X. COSTS FOR DISPOSAL SERVICE PROVIDED DURING CONTRACT PERIOD AND SUBMISSION OF BID PRICE FOR CONTRACT AWARD: A.The Contractor shall package material in the most economical container size for the volume of hazardous waste generated. The contractor shall put the maximum amount of material allowed by DOT in the smallest container possible before moving up to the next size container. The cost shall be based on the DOT maximum quantity per container. Numbers listed in parentheses designate the minimum quantity to be placed in the particular container. B.Disposal includes all material, transportation, equipment and documentation, unless otherwise specified. C.Volume pricing is per individual V.A medical center pickup and is not based on the combined pickups of several medical centers. D.Waste descriptions are based on hazardous waste classifications given in EPA Publication EPA/530-SW-66-019, Understanding the Small Quantity Generator Rules, A Handbook for Small Business and waste classifications given in 40 CFR, Parts 261 and 262. E.Costs for Disposal Service Provided During Contract Period: 1.Submit price for disposal of each item listed in Section E, Columns A - C. Submit a separate price for the initial contract period, and for each of the option years. These prices shall be the price that contractor will be paid for disposal of any of the listed items during the specified contract period. 2.Payment shall be made only for actual quantities of waste that are disposed of during each specified contract period. Contractor shall provide all labor, materials and services including but not limited to, classification, packing, labeling, manifesting, and transportation required to dispose of hazardous materials in accordance with local, state and federal regulations. Pricing is per disposal. Wastes from facilities with different or separate EPA ID numbers will not be grouped together for volume pricing. Upon request of the Department of Veteran Affairs, the contractor will provide an accounting of the fees paid by each facility and categorized by the various types of waste. XI. PRIVACY AND CONFIDENTIALITY: Contractors to the Department of Veteran Affairs may be unintentionally exposed to sensitive information that could potentially violate the privacy and confidentiality of our veterans, employees, volunteers and their families. Regulations such as, but not limited to the Health Insurance Portability and Accountability Act of 1996 (HIPAA), Freedom of Information Act (FOIA) and Privacy Act of 1974 have been enacted to protect sensitive information from being improperly disclosed. Information should not be divulged or released to anyone unless specifically authorized by this contract or its attached documents in accordance with the contracted services. Failure to comply with applicable statutes and regulation can result in the termination of this contract and civil and criminal penalties, including fines and imprisonment. All suspected or actual breaches of privacy and confidentiality should be reported immediately to the Contracting Officer, Contracting Officer's Technical Representative (COTR) or the Facility Privacy Officer. In the event that confidential information is incidentally disclosed in the performance of this contract, destruction of such material is required by an acceptable process such as incineration to ensure that any Protected Health Information (PHI) is fully destroyed making it unreadable and unable to be reconstructed. If there is reasonable cause to believe there has been incidental disclosure, Contractor will promptly investigate and report to the Contracting Officer the Contractor's determinations regarding any alleged or actual unauthorized use or disclosure, promptly resolve any problems identified by the investigation and if requested, submit a formal response to an allegation of unauthorized disclosure. Submission of a bid constitutes acknowledgement that hazardous waste receptacle bags will not be opened in performance of contract and all Privacy and Confidentiality requirements will be enforced.
