- This contract action was accomplished using other than competitive procedures because the procurement is awarded to a sole source under the Test Program for Certain Commercial Items (FAR 13.5). See posted J&A for further information. SINGLE SOURCE DETERMINATION 1. CONTRACTING AGENCY: Kansas City District, U.S. Army Corps of Engineers, Contracting Division, 601 E. 12th St., Kansas City, MO 64106. 2. DESCRIPTION OF ACTION: A new, singles source, firm-fixed-price (FFP) contract using non-expiring Civil Operations and Maintenance (O&M Civil, No Year) appropriations to acquire and fund law enforcement services for Stockton Lake Project. The period of performance for the contract in Stockton, Missouri will not exceed two (2) years, with a base year and a maximum of one option year; the appropriation will support the option period. 3. DESCRIPTION OF SERVICE: Law enforcement services including patrolling the area at specified times, upholding the law, and arresting law breakers for the Stockton Lake Project. Services will be obtained from the following law enforcement agency, under the Solicitaiton numbers listed below: Dade County Sheriff (Stockton Lake Project) 201 W Water St Greenfield, MO 65661 W912DQ-15-R-1008 Period of Performance and estimate details: Dade County - Base plus one option year ( 1 April 2015 to 31 March 2016 for the base, with the option period ending 31 March 2017); estimate of $48,500 per year for a total of $97,000; 4. AUTHORITY CITED: FAR 13.106-1(b), Soliciting from a single source. 5. REASON FOR AUTHORITY CITED: a. BACKGROUND: The NWK Lake Projects require increased seasonal law enforcement services on U.S. Government owned lands within its jurisdiction. Historically, these law enforcement services have been provided by a contract with the local Sheriffs' departments. The predecessor contract for this action is: Dade County MO - W912DQ-13-C-0054. The contract costs consist of labor for Sheriff's personnel, vehicle patrols, dispatch services, and administration services. The County Sheriff's Departments shall enforce all applicable Federal, state, county, civil, and criminal laws excluding those contained in Title 36 of the Code of Federal Regulations, Chapter III, nor shall they be empowered to enforce such regulations. The minimum requirements of these services are that the contractor be able to patrol the area at specified times, be able to uphold the law, arrest law breakers and prosecute within the counties, and be able to respond to an emergency in a timely manner. b. JUSTIFICATION: 1. Statutory authority to contract with the County Sheriff's Departments is required by state statutes. 2. The following are facts: i. 42 U.S. Code 1962d-5d - Authorization of Secretary of the Army to contract with States and political subdivisions for increased law enforcement services during peak visitation periods; authorization of appropriations - (a)The Secretary of the Army, acting through the Chief of Engineers, is authorized to contract with States and their political subdivisions for the purpose of obtaining increased law enforcement services at water resources development projects under the jurisdiction of the Secretary of the Army to meet needs during peak visitation periods. (b)There is authorized to be appropriated $10,000,000 per fiscal year for each fiscal year beginning after September 30, 1986, to carry out this section. ii. Missouri State Statute, Chapter 57, Section 109 states, 1. Every sheriff shall have the power to contract with the Secretary of the Army of the United States, acting through the Corps of Engineers, for the purpose of providing increased law enforcement services at or near water resources development projects, active or inactive, under the jurisdiction of the Secretary of the Army which are located within the county of the contracting sheriff. 2. No such contracts shall be for a period of more than two years. iii. All previous contracts for the NKW Lake Projects are with the County Sheriff's Departments listed above. iv. The contractor will be required to submit a quote for these services and the price reasonableness will be determined by the Contracting Officer. The Contracting Officer will also verify that the Department of Labor wage determinations are enforced for this contract. v. There is no competition anticipated for this procurement because there is only one (1) Sheriff per county. 3. Alternatives: Since by statute there is little competition, the only real alternative might be to award a contract to the State Highway Patrol. However, the local law enforcement has been more efficient in responding faster to emergencies at the Lake Project. In the past, when the Lake Projects have had to rely on the State Highway Patrol for an emergency, they have been slow in their responsiveness or were unable to support the Lake Project because they were busy with another issue (e.g. highway-type issues).
