- In furtherance of the Federal Prison Industries, Inc. (FPI) Board of Directors' emphasis to pursue the creation of inmate jobs without mandatory source, this notice announces the intent of the Board to approve FPI to seek additional work in commercial market services, beyond the seven categories of work presently approved, to enable FPI to pursue potential growth opportunities in distribution, logistics, packaging and other services. This proposal will allow FPI to pursue additional commercial service work to provide more inmates with job training opportunities. In 1998, FPI received approval from its Board of Directors to provide commercial market services. To date, the Board has approved several categories: 1) work that is currently being performed outside the United States; 2) services with a recognized labor shortage that causes companies to outsource work to foreign companies; 3) new services that a company otherwise intends to contract outside the United States; and 4) services that were performed by non-Federal Bureau of Prisons inmates (such as District of Columbia inmates) for non-Federal agencies; 5) service work for state and local governments; 6) service work that would be economically unfeasible to perform without the availability of inmate labor, i.e., new work that would otherwise not be done; and in 2013, a seventh category: work opportunities related to recycling. Additional service opportunities remain since they may not fit the current framework of one of the previously approved criteria. The Board therefore announces its intention to approve a proposal broadening FPI's existing commercial market service categories to cover other potential service opportunities that do not fit one of the previous categories. Fully utilizing FPI's ability to identify additional work will assist FPI in its goal to create more inmate jobs. FPI's pursuit of these services should not hinder the development of the domestic market, and FPI will continue to ensure it remains sensitive so that no single industry will bear an undue burden as a result of its efforts. This additional opportunity in commercial market services allows FPI to fully and effectively utilize its current capacity and capabilities while creating more skills training opportunities for inmates. Interested parties are invited to comment on this notice. Comments will be due within 30 days of the date of publication in the FedBizOpps. All comments received in response to this announcement will be provided to FPI's Board of Directors in their entirety. These comments will be reviewed by the Board prior to making a final decision to proceed, adding the broader pursuit of CMS as outlined herein.
