- SOW INTRODUCTION THIS IS A PRE-SOLICITATION NON-COMPETITIVE (NOTICE OF INTENT) SYNOPSIS TO AWARD A CONTRACT OR PURCHASE ORDER WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME). The National Institute on Drug Abuse (NIDA), Station Support Contracts and Simplified Acquisitions Branch (SS/SA) on behalf of the National Institute of Neurological Disorders and Stroke (NINDS) intends to negotiate and award a contract without providing for full and open competition (Including brand-name) to Tecniplast USA for Cage Wash Equipment Services. NORTH AMERICAN INDUSTRY CLASSIFICATION SYSTEM (NAICS) CODE The intended procurement is classified under NAICS code 811219 with a Size Standard of $20.5 million. REGULATORY AUTHORITY The resultant contract will include all applicable provisions and clauses in effect through the Federal Acquisition Circular (FAC) 05-78, dated December 26, 2014. This acquisition is conducted under the procedures as prescribed in FAR subpart 12-Acquisition of Commercial Items and FAR subpart 15-Contracting by Negotiation at an amount exceeding the simplified acquisition threshold ($150,000). STATUTORY AUTHORITY This acquisition is conducted under the authority of 41 U.S.C. 3304(a)(1) under provisions of the statutory authority of FAR Subpart 6.302-1(a)(2) - Only one responsible source and no other supplies or services will satisfy agency requirements. DESCRIPTION OF REQUIREMENT The contractor shall provide a comprehensive service agreement for the cage and bottle processing equipment listed in the Statement of Work (SOW). The contractor shall honor the existing warranty on the three (3) pieces of equipment listed in the SOW (IWT Tunnel Washer, Serial # 011165; IWT Rack Washer, Serial # 901469; IWT Multi-Magic Semi-Automatic Bottle Processor, Serial # 551122) which expires on November 30, 2015 and is supplemented by a Silver Service Agreement. Background The National Institutes of Health (NIH) is the nation's leading medical research agency and the primary Federal agency whose mission is to seek fundamental knowledge about the nature and behavior of living systems and the application of that knowledge to enhance health, lengthen life and reduce illness and disability. The National Institutes of Health is comprised of 27 Institutes and Centers. The National Institute of Neurological Disorders and Stroke (NINDS), is one of those member institutes. The NINDS' mission is to seek fundamental knowledge about the brain and nervous system and to use that knowledge to reduce the burden of neurological disease. Purpose and Objectives The purpose of this acquisition is to award a multi-year service agreement for the cage and bottle processing equipment listed in and according to the specific requirements outlined in the Statement of Work (SOW). Period of Performance The Period of Performance (PoP) will begin on April 1, 2015 and will include a base year, with four (4) option years, according to the following yearly breakdown: Base YearApril 1, 2015 thru March 31, 2016 Option Year 1April 1, 2016 thru March 31, 2017 Option Year 2April 1, 2017 thru March 31, 2018 Option Year 3April 1, 2018 thru March 31, 2019 Option Year 4April 1, 2019 thru March 31, 2020 It is anticipated that this award will be a Fixed Price Incentive Firm. Project Description Please refer to the attached Statement of Work for complete details and specifications. Other Important Considerations The manufacturer stipulates only Tecniplast USA technicians are manufacturer trained and certified and therefore the only field engineers permitted to service Tecniplast cage-wash equipment CONTRACTING WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME) DETERMINATION The determination by the Government to award a contract without providing for full and open competition is based upon the market research conducted as prescribed in FAR Part 10-Market Research, specifically the review and evaluation of the responses to the sources sought notice published in the FedBizOpps on January 30, 2015, synopsis number HHS-NIH-NIDA-SSSA-SBSS-2015-112, entitled NINDS Division of Intramural Research (DIR) Effort to Purchase CageWash Equipment Services. Due to the highly technical nature of the equipment being serviced, the potential loss of life that could occur if technicians unfamiliar with Tecniplast's proprietary equipment are utilized, and manufacturer stipulations that state only Tecniplast USA technicians are manufacturer trained and certified and therefore the only field engineers permitted to service Tecniplast cage-wash equipment it has been determined that there are no other sources besides the manufacturer that can service the subject equipment. Tecniplast is the intended source for this award. CLOSING STATEMENT This synopsis is not a request for competitive proposals. However, interested parties may identify their interest and capability to respond to this notice. Responses to this notice shall contain sufficient information to establish the interested parties' bona-fide capabilities for fulfilling the requirement and include: unit price, list price, shipping and handling costs, the delivery period after contract award, the prompt payment discount terms, the F.O.B. Point (Destination or Origin), the Dun & Bradstreet Number (DUNS), the Taxpayer Identification Number (TIN), and the certification of business size. All offerors must have an active registration in the System for Award Management (SAM) www.sam.gov." A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement. All responses must be received by March 13, 2015 and must reference number HHS-NIH-NIDA(SSSA)-15-157.
