Description
•I. PURPOSE/DESCRIPTION This announcement constitutes a Notice of Contract Action (NOCA) by the Space and Missile Systems Center (SMC) Space Superiority Systems Directorate (SY), Contracting Office (SMC/SYK), Los Angeles Air Force Base, California. In accordance with FAR 6.302-1(a)(2)(iii)(B), the Space and Missile Systems Center's Space Superiority Systems Directorate (SMC/SY) intends to award a sole source Cost-Plus-Incentive-Fee/Cost-Plus-Fixed-Fee contract for Sustainment support of the Space Based Space Surveillance (SBSS) Block 10 System to The Boeing Company to ensure continuity of life cycle sustainment services for the Space Situational Awareness (SSA) mission area. The period of performance for this contract to include the base year and all options is 7 years, from approximately June 2015-June 2022. The contract will provide sustainment services for SBSS Block 10, which is currently provided by the SBSS MOR contract, FA8819-08-C-0006. The Boeing Company (Boeing) is currently performing all operations support, anomaly resolution, system modifications and upgrades for the SBSS Block 10 System. The aforementioned core sustainment support tasks are a collection of highly specialized services requiring a unique skillset and access to system technical data and source code for which the Government only has restricted rights. SBSS Block 10 provides unique services and unique Space Situational Awareness (SSA) capabilities that are in high-demand from the Joint Space Operations Center (JSpOC), National Air and Space Intelligence Center (NASIC), and other customers. Accordingly, the Government requires the incumbent contractor to continue performing highly specialized services and unique capabilities in order to meet high-volume, real-time mission requirements for the planned period of performance. The Boeing Company has been assessed as the only company capable of providing this service because it will avoid unacceptable schedule delays based on Boeing's exclusive data rights ownership. In accordance with FAR 5.207(c)(16)(ii), all responsible sources may submit a statement of capability, not to exceed 10 pages in length (a page is defined as 8.5 inch x 11 inch sheet, using 12 point Times New Roman font, with 1 inch top, bottom and side borders). The capabilities statement should address: (1) why the responding company can perform the work, (2) how the responding company can avoid unacceptable schedule delays, and (3) why the sole source justification is no longer applicable. Statements of capability, which shall be received within 15 calendar days (13 Mar 2015) by 3:00 PM Pacific Standard Time (PST) from the date of publication of this notice, will be considered by SMC/SYK. All responses must be submitted to the Government points of contact at the email addresses shown below. The Government will not recognize any costs associated with submission of information in response to this or previous notices. A determination by the Government not to open the requirement to competition based upon the responses to this notice is solely within the discretion of the Government. This notice does not constitute a Request for Proposal nor does it restrict the Government in any way to an ultimate acquisition approach. THIS IS NOT A REQUEST FOR PROPOSAL AND IS NOT TO BE CONSTRUED AS A COMMITTMENT BY THE GOVERNMENT. •II. SMALL BUSINESS CONSIDERATION The pertinent NAICS code for this announcement is 541712 with the applicable size standard of 1000 employees. Any business, regardless of size, in this area of expertise will be allowed to participate in the submittal of a Statement of Capability (SOC). Responses from small business and small disadvantaged business firms are highly encouraged and the Government encourages teaming/partnering. III. OMBUDSMAN Pursuant to AFFARS 5352.201-9101, an SMC Ombudsman has been appointed to hear and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. When requested, the SMC Ombudsman will maintain strict confidentiality as to the source of the concern. The existence of the SMC Ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. Further, the SMC Ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of protests or formal contract disputes. The SMC Ombudsman may refer the interested party to another official who can resolve the concern. Before consulting the SMC Ombudsman, interested parties should first address their concerns, issues, disagreements, and/or recommendations to the Contracting Officer for resolution.
