Description
WAGE DETERMINATION-PORTAGE COUNTY, OH WAGE DETERMINATION-SANTA CLARA COUNTY, CA This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6 as supplemented with additional information included in this notice. The U.S. Coast Guard (USCG), Aviation Logistics Center (ALC), Medium Range Recovery (MRR) Contracting Branch intends to issue a Firm Fixed Price Purchase Order using the procedures of FAR Part 12 and Part 13. This Request for Quote HSCG3815QJ00066 incorporates provisions and clauses in effect through Federal Acquisition Circular (FAC) 2005-79. This announcement constitutes the only solicitation; firm-fixed-price quotes for the repair of the following item(s) are being requested and a written solicitation will not be issued. The North American Industry Classification System Code is 336413 and the size standard is 1,000 employees. This is an unrestricted procurement. The U.S. Coast Guard Aviation Logistics Center (ALC) plans to award one (1) purchase order. All responsible sources may submit a quote which shall be considered by the agency. Please see the Statement of Work (SOW) included below for detailed requirements. Schedule of Supplies/Services Description 1. Radar Radome Quantity 6 Each P/N: 70600-81853-101 Required Delivery: 90 days ARO The USCG does not own specifications, plans, and drawings and no other technical data will be included in this solicitation. All responsible sources may submit an offer for quantities listed or quantity price breaks which shall be considered by the agency. PACKAGING AND MARKING: Packaging, packing, and preservation shall be in accordance with ASTM D3951-98 (Re-approved 2004) Standard Practice for Commercial Packaging. Each package shall be individually labeled on the outside with Nomenclature, Quantity, Purchase Order Number, and Line Item Number. The internal packaging material shall be sufficient to prevent damage during shipment, handling, and storage. Delivery shall be to Commanding Officer, Aviation Logistics Center, Elizabeth City, NC 27909. Inspection and Acceptance shall be performed at destination by ALC's Receiving Section. Inspection and Acceptance shall be in accordance with 52.212-4 Contract Terms and Conditions-Commercial Items (Dec 2014) In addition, Inspection and Acceptance may be performed at destination by ALC's Quality Assurance representative in accordance with ALCINST 4855.4, Policy and Quality Assurance Procedures for the Receipt Inspection of New, Repaired and Overhauled Items from Vendors dated Aug 15, 2008. Copies of packing slips shall be affixed to the outside of the shipping container. Each item or unit must be individually packed in a separate box, carton, or crate. Each individual container shall be labeled on the outside with NSN, Part Number, Serial Number, Quantity, Nomenclature, Purchase Order Number, and Line Item. Bar coding is authorized but not required. Offers shall be able to provide necessary certifications including traceability to ensure parts are in airworthy condition, suitable for installation on an U.S. Coast Guard aircraft. The basis for award rests with the determination of fair and reasonable pricing and the ability to make an affirmative responsibility determination. STATEMENT OF WORK (SOW) FOR Radar Radome Repair 1.0 GENERAL 1.1 BACKGROUND This statement of work (SOW) is for the repair of six (6) Radar Radomes that are used on the U.S. Coast Guard (USCG) MH-60T aircraft The Radar Radomes is located on the nose of the MH60T aircraft. The intended use is to monitor weather on the MH60T aircraft that safeguard against the rescue concerns such as wind, snow, ice, or rain. This item is being replaced during aircraft PDM for normal wear and tear. 1.2 SCOPE Nomenclature P/N NSN QTY Repair/Rework Radar Radome 70600-81853-101 1560-01-HR2-2167 6 The components identified in the Description of Items or Services will be furnished to the contractor at the prices established at award for rework. All rework actions shall be in accordance with the OEM's commercial rework manuals and Federal Aviation Regulation Parts 43 and 145 or alternate standard approved in writing by USCG MH60T Engineering Branch. Components furnished hereunder shall be returned by the contractor in an airworthy condition and in all respects suitable for installation in U.S. Coast Guard (USCG) aircraft. Certification and documentation requirements apply. 1.3 OBJECTIVE Components furnished hereunder shall be returned by the contractor in an airworthy condition and in all respects suitable for installation in U.S. Coast Guard (USCG) MH-60T aircraft. U.S. Coast Guard Aviation Logistics Center (ALC) considers components ready for issue (RFI) upon acceptance. Certification and documentation requirements apply. 1.4 APPLICABLE DOCUMENTS Components shall be serviced in accordance with Federal Aviation Regulation Parts 43 and 145 or alternate standard approved in writing by the Engineering Division, USCG Aviation Logistics Center (ALC). Repair shall be accomplished in accordance with NAVAIR 01-1A-22 and Air Force T.O. 1-1-24 to ensure full compliance with performance standards. For the repair to the radar window area of the Radomes assembly; the repair Radomes shall be tested and certified to a Class B rating for transmission efficiency as outlined in the Radio Technical Commission for Aeronautics (RTCA). 2.0 SPECIFIC REQUIREMENTS/TASKS A DD Form 1577-2, Unserviceable (Repairable) Tag-Material, or a CG-1577-A (11-90), Unsatisfactory Report Tag, will be attached to each Not Ready for Issue (NRFI) component describing faults. Components shall be repaired to correct the specific fault(s) identified. Components shall also be inspected by the vendor to determine any defects not identified by the Government and repaired within the firm-fixed prices established herein. The contractor shall also perform a visual and technical inspection in accordance with the current applicable Component Maintenance Manual (CMM) to correct all additional deficiencies found. This shall include replacement of broken parts and the removal of any foreign matter or corrosion. Corroded parts shall be replaced, except in those cases where removal of corrosion from a part will not impair the efficiency or safe operation of the part. Corrosion removal and treatment of affected areas will be accomplished in accordance with the OEM specifications (or best commercial practices if not addressed by the OEM). Parts found to be defective shall be replaced as specified in the OEM's current procedures or as otherwise authorized in writing by U.S. Coast Guard, Aviation Logistics Center, MRR Engineering Division. In all cases, replacement parts shall be new. A copy of the contractor's work order, listing all replacement parts, shall be provided for each component. The contractor shall maintain a copy of replacement part certification documentation for inspection by the Government for a minimum of 24 months after delivery. ALC considers components ready for issue (RFI) upon acceptance. Components determined to be non-RFI upon installation may be returned to the contractor with deficiencies described in a Quality Deficiency Report (QDR). Services shall be performed only by Federal Aviation Administration (FAA) AND OEM approved OR USCG-approved contractors. USCG approval must be in writing and be available upon request to the Contracting Officer. The contractor shall: - Comply with the certification/documentation requirements specified herein. - Attach certifications/documentation to the outside of the shipping container. 3.0 QUALIFIED PERSONNEL The Contractor shall provide qualified personnel to perform all requirements specified in this SOW. 3.1 CORROSION The Coast Guard aircraft operate primarily in a saltwater environment and are subject to corrosion. Corrosion is expected on equipment to be repaired under this contract. During inspection and functional test, the presence of corrosion in any component or subcomponent thereof shall constitute reason for a more thorough disassembly and inspection. Should corrosion be found, disassembly shall be made only to the extent necessary to remove corrosion or replace the part affected. Corrosion removal and treatment of affected areas shall be accomplished in accordance with the OEM's current specifications and drawings. 3.2 REPLACEMENT PARTS Parts found to be defective shall be replaced as specified in the OEM's current procedures or as otherwise authorized in writing by U.S. Coast Guard, Aviation Logistics Center, MRR Contracting Officer. In all cases, replacement parts shall be new. A copy of the contractor's work order, listing all replacement parts order shall be provided for each component. The contractor shall maintain a copy of replacement part certification documentation for inspection by the Government for a minimum of 24 months after delivery. 3.3 ENVIRONMENTAL REQUIREMENTS. All parts must be thoroughly cleaned IAW applicable Component Maintenance Manuals or FAA Advisory Circular 43-205, Guidance for Selecting Chemical Agents and Processes for Depainting and General Cleaning of Aircraft and Aviation Products, to ensure they are as free as practicable of all hazardous dust to include hexavalent chromium, cadmium, lead, etc., prior to being returned to ALC. ALC may take random samples of parts to ensure they are free as practicable of all hazards. Information on these hazards can be found in Occupational Safety and Health Standards 1910.1025 (lead), 1910.1026 (Hexavalent Chromium) and 1910.1027 (Cadmium). 4.0 OTHER APPLICABLE CONDITIONS Environmental Requirements. The Contractor's written notification shall include the following information at a minimum purchase order number, line item number, nomenclature, national stock number, part number, and a brief description supporting the determination. The Contracting Officer will provide disposition instructions via modification within thirty (30) calendar days after receipt of notification. The Contractor shall be entitled to compensation for teardown and evaluation only and shall invoice against the "Teardown and Evaluation" line item specified within the order at Description of Items or Services. 4.2 PLACE OF PERFORMANCE The primary place of performance will be the Contractor's facilities. Stickers should be applied as shown in the photos included as Attachment 1. • "Warning Radio-Frequency Radiation Hazard" (Danger within 25 feet of antenna when in Radiate condition) 1 each per Radar Radome • "Drain Hole - Do not plug" 1 each per Radar Radome • "Do not paint" 2 each per Radar Radome 7.0 CONTRACTOR FURNISHED PROPERTY The Contractor shall furnish all facilities, materials, equipment and services necessary to fulfill the requirements of this contract, except for the Government Furnished Resources specified in SOW 6.0. 8.0 GOVERNMENT ACCEPTANCE PERIOD The COR will review deliverables prior to acceptance and provide the contractor with an e-mail that provides documented reasons for non-acceptance. If the deliverable is acceptable, the COR will send an e-mail to the Contractor notifying it that the deliverable has been accepted. 9.0 GOVERNMENT FURNISHED RESOURCES The Government will provide the following property to the Contractor for work required under this contract: Radar Radome NSN: 1560-01-HR2-2167 P/N: 70600-82843-101 The Government will not authorize funding for the fabrication of any jigs, fixtures or tooling to facilitate this repair. The Government will not furnish any drawings, parts, hardware, specifications, tooling, fixtures, jigs or any other repair documents required to repair the aircraft doors. 10.0 DELIVERIES The Coast Guard desires early deliveries therefore early shipments are encouraged at no additional costs to the Government. If the Contractor fails to deliver by the expected delivery date established within the purchase order and nonperformance is not covered by an excusable delay, FAR 52.212-4(f), Excusable Delays, the Contracting Officer may negotiate consideration for delinquent deliveries on behalf of the Government. Discounts negotiated in consideration for delinquent deliveries will be reflected in a modification to the purchase order. 11.0 MATERIAL INSPECTION AND RECEIVING REPORT At the time of each delivery, the Contractor shall prepare and furnish a properly completed Form DD250, Material Inspection and Receiving Report or commercial shipping document which will be used by the Government as a packing slip. The form shall include the following: Nomenclature, National Stock Number, Part Number, Quantity, Purchase Order Number, and Line Item Number. One copy of the packing slip shall be placed on the outside of the container. 12.0 PACKAGING, HANDLING, AND PRESERVATION The ALC is a supply depot therefore material will be stored and transshipped to various users. The container shall be packed and labeled suitable for shipment via land, air or sea. The Contractor shall ensure that all components, when packed in shipping containers or packaging, will be capable of being transported on standard transportation systems, commercial or military carriers. The Contractor shall preserve, pack, and package in approved shipping containers to ensure complete delivery at destination without damage or deterioration of the supplies due to the hazards of shipping, handling, or storage. The Contractor agrees that any item damaged in shipment from the Contractor will be repaired inclusive of this contract. The Contractor agrees to notify the Contracting Officer of the existence of any damaged and unusable shipping containers. Packaging, handling, shipping, and transportation procedures shall be in accordance with ASTM D3951-10 (2010) Standard Practice for Commercial Packaging; latest revision shall apply. If commercial practices cannot adequately protect and preserve the equipment, the Contractor shall package, handle, ship and transport components in accordance with MIL-STD-2073-1D Standard Practice for Military Packaging; latest revision shall apply. 12.1 MARKING OF SHIPMENT Shipments shall be marked in accordance with MIL-STD-129R, Military Marking for Shipment and Storage; latest revision shall apply. • Each component shall be individually packed in a separate approved shipping container. • The internal packing material shall be sufficient to prevent damage during shipment, handling, and storage. Preservation and protection shall be provided to prevent corrosion, deterioration or decay during warehouse storage for a period of one (1) year. • Packaging material shall not consist of the following: popcorn, shredded paper, Styrofoam of any type, or peanut packaging. • Each container shall be labeled on the outside with National Stock Number, Part Number, Serial Number, Nomenclature, Quantity, Contract Number, Task Order Number and Line Item Number. • Packing List and Certification/Documentation shall be placed on the outside of individual containers. • Each container shall be marked with a notice of warranty. The notice must include a brief statement that a warranty exists, the substance of the warranty, the duration of the warranty, and who to notify if the supplies are found to be defective. • When responding to an Aircraft on Ground (AOG) situation, the Contractor shall mark the outside of the shipping container "AOG" in letters not less than 2" high. 12.2 PLACE OF DELIVERY Unless otherwise specified in writing by the Contracting Officer, all deliveries against the resulting contract shall be shipped to the address listed below: U.S. Coast Guard (Z50100) Aviation Logistics Center 1664 Weeksville Rd Receiving Section, Bldg. 63 Elizabeth City, NC 27909-5001 12.3 F.O.B POINT The FOB Point for shipments under this contract is F.O.B. origin. Pricing shall include all applicable customs, duties, taxes, and shipping charges. 13.0 GOVERNMENT ACCEPTANCE Final inspection and acceptance will be by the USCG ALC Receiving Department. 14.0 WARRANTY The Contractor's standard commercial warranty, including extended warranties, provided to the Government at no additional cost, shall apply to this SOW. 15.0 INVOICING INSTRUCTIONS Electronic submission of invoices is encouraged. Invoices may be submitted electronically at ALC-Fiscal@uscg.mil. (Jun 2006) (a) Prohibitions. Section 835 of the Homeland Security Act, 6 U.S.C. 395, prohibits the Department of Homeland Security from entering into any contract with a foreign incorporated entity which is treated as an inverted domestic corporation as defined in this clause, or with any subsidiary of such an entity. The Secretary shall waive the prohibition with respect to any specific contract if the Secretary determines that the waiver is required in the interest of national security. (b) Definitions. As used in this clause: Expanded Affiliated Group means an affiliated group as defined in section 1504(a) of the Internal Revenue Code of 1986 (without regard to section 1504(b) of such Code), except that section 1504 of such Code shall be applied by substituting `more than 50 percent' for `at least 80 percent' each place it appears. Foreign Incorporated Entity means any entity which is, or but for subsection (b) of section 835 of the Homeland Security Act, 6 U.S.C. 395, would be, treated as a foreign corporation for purposes of the Internal Revenue Code of 1986. Inverted Domestic Corporation. A foreign incorporated entity shall be treated as an inverted domestic corporation if, pursuant to a plan (or a series of related transactions)- (1) The entity completes the direct or indirect acquisition of substantially all of the properties held directly or indirectly by a domestic corporation or substantially all of the properties constituting a trade or business of a domestic partnership; (2) After the acquisition at least 80 percent of the stock (by vote or value) of the entity is held- (i) In the case of an acquisition with respect to a domestic corporation, by former shareholders of the domestic corporation by reason of holding stock in the domestic corporation; or (ii) In the case of an acquisition with respect to a domestic partnership, by former partners of the domestic partnership by reason of holding a capital or profits interest in the domestic partnership; and (3) The expanded affiliated group which after the acquisition includes the entity does not have substantial business activities in the foreign country in which or under the law of which the entity is created or organized when compared to the total business activities of such expanded affiliated group. Person, domestic, and foreign have the meanings given such terms by paragraphs (1), (4), and (5) of section 7701(a) of the Internal Revenue Code of 1986, respectively. (c) Special rules. The following definitions and special rules shall apply when determining whether a foreign incorporated entity should be treated as an inverted domestic corporation. (1) Certain stock disregarded. For the purpose of treating a foreign incorporated entity as an inverted domestic corporation these shall not be taken into account in determining ownership: (i) Stock held by members of the expanded affiliated group which includes the foreign incorporated entity; or (ii) Stock of such entity which is sold in a public offering related to an acquisition described in section 835(b)(1) of the Homeland Security Act, 6 U.S.C. 395(b)(1). (2) Plan deemed in certain cases. If a foreign incorporated entity acquires directly or indirectly substantially all of the properties of a domestic corporation or partnership during the 4-year period beginning on the date which is 2 years before the ownership requirements of subsection (b)(2) are met, such actions shall be treated as pursuant to a plan. (3) Certain transfers disregarded. The transfer of properties or liabilities (including by contribution or distribution) shall be disregarded if such transfers are part of a plan a principal purpose of which is to avoid the purposes of this section. (d) Special rule for related partnerships. For purposes of applying section 835(b) of the Homeland Security Act, 6 U.S.C. 395(b) to the acquisition of a domestic partnership, except as provided in regulations, all domestic partnerships which are under common control (within the meaning of section 482 of the Internal Revenue Code of 1986) shall be treated as a partnership. (e) Treatment of Certain Rights. (1) Certain rights shall be treated as stocks to the extent necessary to reflect the present value of all equitable interests incident to the transaction, as follows: (i) warrants; (ii) options; (iii) contracts to acquire stock; (iv) convertible debt instruments; and (v) others similar interests. (2) Rights labeled as stocks shall not be treated as stocks whenever it is deemed appropriate to do so to reflect the present value of the transaction or to disregard transactions whose recognition would defeat the purpose of Section 835. (f) Disclosure.
