Attachment 2: Request for Sole Source Memo Format DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Activity: 2.Nature and/or Description of the Action Being Processed: A firm fixed price sole source purchase order will be awarded for the procurement of Minnesota Valley Testing Laboratories (MVTL) water testing service, to provide legionella potable water testing service for the MVAHCS per VHA directive 1061. Service (collection, measuring temperature, pH and chlorine for each sample) purchase is cost per day - estimated 6 days to complete. This is a procurement request to comply with the directive requirements. A VISN contract is being worked on for FY 15 quarters 2-4 legionella testing with option years. 3.Description of Supplies/Services Required to Meet the Agency's Needs: MVTL will be providing the testing bottles and laboratory services to meet the legionella testing requirements. The specific paragraph must be cited. Most likely, only the -1 or -2 authorities will be cited. Please be aware that failure to adequately plan for future requirements does not constitute appropriate use of the unusual and compelling urgency statutory authority. The ELITE Program certifies labs that are able to find Legionella in a water sample by culture. Appropriate culture protocols include water sample treatment, isolate identification, and characterization. The VA and CDC require Legionella testing be performed in an Elite Certified laboratory. Over 20 ELITE certified lab web sites were reviewed and no other lab provided field collection in this area. 5.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: The Contracting Officer will determine the price to be fair and reasonable. 6.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: We reviewed and discussed pricing with MVTLs, it is comparable with industry standard pricing. Pricing is fair and reasonable. 7.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Market research was conducted per item 6 above. Time requirements did not permit soliciting several contractors for capability and/or price. 8.Any Other Facts Supporting the Use of Other than Full and Open Competition: NA 9.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: MN Valley Testing Laboratories, Inc. 10.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: This is to provide mission essential needs until a long term contract may be solicited, competed and awarded. 11.Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
