Description
PDF of Combined Synopsis/Solicitation (i) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. (ii) The solicitation number is 146182. The solicitation is issued as a Request for Quote (RFQ). (iii) This solicitation and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-78. (iv) The corresponding NAICS code is 511210 and the small business size standard is $38.5 million. (v) List of contract line item number(s) and items, quantities and units of measure - 12 months of access to a software license or online database that provides drug pricing data, drug-to-drug interaction data, and therapeutic class data. Such data shall include wholesale price and other pricing data for all drugs approved by the Food and Drug Administration. Such data also shall include information on drug-disease contraindications, indications, geriatric precautions, and a medical lexicon. To be technically acceptable, the products quoted shall be brand name or equal to First DataBank Inc.'s National Drug Data File. Please see section viii for the "Brand Name or Equal" justification and requirements. (vi) Description of Requirement - The Department of Health and Human Services (DHHS) Office of Inspector General (OIG) has a requirement for 12 months of access to drug pricing data, drug-to-drug interaction data, and therapeutic class data to help: (1) provide OIG's Office of Audit Services with accurate background information during audits; (2) assist OIG's Consolidated Data Analysis Center and Office of Audit Services staff members perform data analysis work related to identifying potentially hazardous and/or fraudulent medical prescribing practices; and (3) support Medicare fraud investigations, new referrals for possible investigations, and criminal and/or civil litigation. (vii) The period of performance shall be from 01/26/2015 - 01/25/2016. (viii) The provision at FAR 52.212-1, Instructions to Offerors - Commercial Items (APR 2014), applies to this acquisition. (ix) The provision at FAR 52.212-2, Evaluation - Commercial Items (OCT 2014), applies to this acquisition. The Government will award a contract resulting from this synopsis/solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. Note: Quoters providing products that are equal to the criteria listed in section xiii, Brand Name or Equal, are hereby notified that an additional $65,000 will be assessed against the quoted price. This value is the estimated cost incurred by the Government to account for the federal labor to replace OIG's current Rx drug tables. (x) Offerors are to include a completed copy of the provision at FAR 52.212-3, Offeror Representations and Certifications - Commercial Items (DEC 2014), with its offer or acknowledge its listing in the System for Award Management (SAM) website. (xi) The clause at FAR 52.212-4, Contract Terms and Conditions - Commercial Items (DEC 2014), applies to this acquisition. (xii) The clause at FAR 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders - Commercial Items (DEC 2014), applies to this acquisition. The Contracting Officer has indicated the following clauses listed in paragraph (b) as applicable and are hereby incorporated by reference: (4) 52.204-10, Reporting Executive Compensation and First-Tier Subcontract Awards (JUL 2013); (8) 52.209-6, Protecting the Government's Interest When Subcontracting with Contractors Debarred, Suspended, or Proposed for Debarment (AUG 2013); (25) 52.222-3, Convict Labor (JUN 2003); (27) 52.222-21, Prohibition of Segregated Facilities (FEB 1999); (28) 52.222-26, Equal Opportunity (MAR 2007); (30) 52.222-36, Affirmative Action for Workers With Disabilities (OCT 2010); (39) 52.223-18, Encouraging Contractor Policies to Ban Text Messaging While Driving (AUG 2011); (43) 52.225-13, Restrictions on Certain Foreign Purchases (JUNE 2008); and (49) 52.232-33, Payment by Electronic Funds Transfer - System for Award Management (JUL 2013). (xiii) Brand Name or Equal - OIG requires the use of the First DataBank, Inc., National Drug Data File (NDDF) or equal. Essential characteristics of the NDDF include drug pricing data, drug-to-drug interaction data, therapeutic class data, data analysis modules (including the Drug-Disease Contraindications Module, the Indications Module, the Geriatric Precautions Module, and the Medical Lexicon Module), historical access to data analysis in the event of litigation, and compatibility with OIG database administration and data analysis procedures. Key characteristics of the data analysis modules, which associate prescription drug events with NDDF drug information, are essential and outlined below: • Drug-Disease Contraindications Module: This module assists OIG analysts in identifying potentially hazardous prescribing practices with warnings concerning the use of certain drugs in patients with specific health-related conditions and diseases, or patients who have had certain procedures or diagnostic tests. • Indications Module: This module provides information on medications that are known to be appropriate for a patient's condition, covering both labeled and unlabeled indications. • Geriatric Precautions Module: This module provides access to geriatric precaution information, including severity levels and contraindication formation. • Medical Lexicon Module: This module gives medical vocabulary relating drug products to various diagnoses and health-related concepts. (xiv) The clauses at FAR 52.232-40, Providing Accelerated Payment to Small Business Subcontractors (DEC 2013); HHSAR 352.203-70, Anti-Lobbying (MAR 2012); and HHSAR 352.222-70, Contractor Cooperation in Equal Employment Opportunity Investigations (JAN 2010), apply to this acquisition.
