COMBINED SYNOPSIS/SOLICITATION WebSupport Services (I)This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice and in accordance with the simplified acquisition procedures authorized in FAR Part 13. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. (II)This solicitation is issued as a request for quotation (RFQ). Submit written quotes on RFQ Number NRMA00001500594 PMF (III)The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-79. (IV)This solicitation is being issued as a Total Small Business Set-Aside. The associated NAICS code is 519130. The small business size standard is 500 Employees. (V)This combined solicitation/synopsis is for purchase of the following commercial item(s)/services: CLIN 00001: Purchase subscription to a web services that will provide Congressional Information Web Services. (VI)Description of requirements is as follows: National Oceanic Atmospheric Administration (NOAA) Congressional Information Web Service Statement of Work I.PURPOSE The intent of this Request for Proposal and resulting contract is to obtain a subscription to a web service that will provide email alerts and timely and searchable information about congressional news and schedules, in-depth information on the policy-making process - especially the federal budget and appropriations process, legislative tracking, a searchable Congressional Record, congressional member profiles, and a documents manager for this information. II.BACKGROUND The Formulation and Congressional Analysis Division, under the Chief Financial Officer (CFO) in the National Oceanic and Atmospheric Administration's (NOAA) Office of Oceanic and Atmospheric Research (OAR), has a mission to further OAR's strong reputation for accurate, non-biased science on Capitol Hill and to other constituents while providing expert customer service to OAR's laboratories and programs through timely responses to queries, pro-active development of materials, and strategic leadership. The work of this division includes actions such as reviewing, analyzing, and tracking legislation, drafting testimony for hearings, and informing scientists and managers of congressional action. To complete this work, the division requires a web service that will provide timely, accurate, and searchable information regarding congressional actions, legislation, and congressional members. III.SCOPE OF SERVICES To assist in performing its many responsibilities, DOC - NOAA - OAR - CFO office requires a single (password protected) web service that offers all of the following information content, tools and features. Capabilities of this web service must include all of the following TASKS: 1. Five (5) licensed users in DOC - NOAA - OAR along with onsite training and support (by request). 2.The ability for all users to create and easily update personal search lists (i.e. bill numbers, laws, members, floor votes and committees). a.Users must be able to use saved lists in creating e-mail alerts, vote and member reports and for searching all available content, including global searching. 3.The ability for each registered user to create and update custom e-mail alerts so they receive new information pertinent to their interest areas based on their delivery preferences (including same-day availability). a.Alert options must include keywords, bills, committees, subcommittees and members. b.E-mail results must be stored online for two weeks. c.Each user must have the ability to combine separate alerts into a single e-mail alert to be delivered daily (by e-mail) at the times of their choosing (e.g., 5am, 7am, 9am, 11am, 1pm, 3pm, 5pm, 7pm, 9pm and 11pm EST). 4.The ability for each registered user to annotate documents, create personal folders, save specific documents and add notes for future reference. 5.Round-the-clock, comprehensive and nonpartisan reporting on all major congressional activity, action, floor activity, markups, hearings, and conference committee negotiations. a.On average, not counting recess or major holidays, provider must offer an average of 30-50 copyrighted stories daily. b.Users must be able to search news content dating back to the 1990s by keywords, bill numbers, members, committees, subjects and date. 6.Round-the-clock advanced tracking of events around Washington and including congressional hearings and other action on Capitol Hill. a.Event listings must include dates, times, locations, agendas, contact information and witnesses (when applicable) with a searchable archive dating back to the 1990s. b.Event listings must integrate with electronic calendars (google) and have an automatic e-mail feature alerting users of any changes to selected events (i.e. date, time, location). c.Must include a full-text database of committee and subcommittee hearing transcripts, searchable and alertable by keyword, bill number, member, and committee since the 1990s. 7.A online weekly publication offering in-depth stories on the congressional policy-making process with integrated access to the status of appropriations, vote charts, sidebar stories, profiles of members coded in the story, bill status charts and related documents. a.Must include a searchable archive of prior stories dating back to 1985. 8.Access to comprehensive biographies of every member of Congress. a.Biographies must provide a detailed 3-4 page summary of the member's background, their view in Washington and overview of their district. b.Full bio must include staff contact information (with office locations, titles, responsibilities, e-mail addresses and phone numbers), social media, descriptions on their states and districts, voting and electoral histories, committee assignments, government contract data, grant information, major employers, legislative priorities, interest group ratings, recent news, bills sponsored and cosponsored, floor votes, amendments offered, floor speeches and committee amendments offered. c.Must provide the ability for users to build custom member reports for select members and profile sections. 9.Detailed fact files on members of Congress including birthdays, birthplaces, education, minorities, pronunciation guide, religions, spouses, women members, photo directory, phone, fax, rooms, web, e-mail addresses, committee rosters, seniority, military veterans, chamber seating chart, YouTube House & Senate hub, next election dates, district maps and updated congressional calendar. 10.A searchable database that includes email alerts and is updated daily, and includes every bill introduced in Congress and the various versions of each since the 1990s. The database must include the ability to search by keywords, bill numbers, members, committees, sponsors, chamber, legislative stage, date introduced, bill version date, appropriation bills and fiscal year. 11.A database providing status and chronologies of every bill in Congress dating back to the 1990s. a.Must include the ability to track all draft appropriation and authorization bills for the coming year prior to introduction. b.Capabilities must allow for e-mail alerts to be sent to users for same-day bill action based on keywords, bill number, committee, sponsors, co-sponsors, chamber, legislative stage and date introduced. c.Legislative histories must include links to relevant information such as amendment text, news, analysis and government reports (e.g., CBO, GAO and CRS). 12.A full-text, searchable database that includes e-mail alerts and is updated daily by 9am, and includes the official Congressional Record dating back to the 1990s. a.Must contain an abstract and allow option to search the record by keywords, bill numbers, members, publication date, chamber, Congressional Record page numbers, amendment number and Congressional Record categories (Senate Legislative Action, Senate Bills Introduced, Senate Amendments Introduced, Senate Co-Sponsors Added/Withdrawn, Senate Speeches and Inserts, Senate Reports Filed, Senate Procedural Matters, Senate Executive Communications, Senate Treaties and Nominations, House Legislative Action, House Bills Introduced, House Amendments Introduced, House Co-Sponsors Added/Withdrawn, House Speeches and Inserts, House Reports Filed, House Procedural Matters, House Executive Communications, Daily Digest (Senate and House)). 13. Daily electronic newsletter, delivered by 7 am EST, that tracks and analyzes the federal budget and appropriations process. a.The newsletter must include updates on the status of appropriations along with in-depth news and analysis and links to source documents outlining appropriation bills and earmarks. 14. A full-text, database that includes public laws dating back to the 1990s, searchable by keywords, bills, sponsors, cosponsors, words in Act name, bill enactment date and Public Law/Statutes citations. Must include full text of all public laws dating back to 1807. 15. Ability to track the impact of pending bills on current law, including links within the text of pending bills directed to the section of U.S. Code that it would modify. Ability to create custom e-mail alerts to notify users of bills that would modify certain laws that are being tracked. IV.BILLING AND PAYMENT The service will bill DOC - NOAA - OAR - CFO for the price of the contract for a period of 12 months. V.PERIOD The government anticipates awarding a fixed-price contract for a period for 12-twelve months for date of award. VI.PLACE OF PERFORMANCE The subscription will be a web-based service, with staff willing to travel to Silver Spring, Maryland, for a training session. (VII)Date(s) and place(s) of delivery and acceptance: Period of performance shall be for a period for 12-twelve months from the date of award. NOAA - Office of Oceanic and Atmospheric Research, Floor 11, 1315 East West Hwy, Silver Spring MD. (VIII) FAR 52.212-1, Instructions to Offerors -- Commercial Items (APR 2014), applies to this acquisition. This is a best value acquisition. The offerer will submit a quotation for the items in Section (V). NOTICE TO OFFERORS: Instructions for submitting quotations under this request for quote must be followed. Failure to provide all information to aid in the evaluation may be considered non-responsive. Offers that are non-responsive may be excluded from further evaluation and rejected without further notification to the quoter. In addition to written price quotes, offers are instructed to provide: 1. Submit quotations to the office specified in this solicitation at or before the time specified in the solicitation. At a minimum the contractor shall provide the following information: a) Point of contact name, telephone and E-mail address. b) DUNS Number 4. Provide all evaluation criteria in accordance with 52.212-2 in this package. 5. Complete and return Representation by Corporations Regarding an Unpaid Delinquent Tax Liability or a Felony Conviction Under Any Federal Law (Class Deviation) with quote. (IX) FAR 52.212-2, Evaluation - Commercial Items (OCT 2014), applies to this acquisition. Paragraph (a) is hereby completed as follows: 1) Price: Be sure to carefully address all elements in this RFQ so that your quotation can be fully evaluated. 2) Past Performance - Your RFQ should include at least three past performance references (include names and phone numbers and point of contact). Past performance will be evaluated in terms of timeliness, customer service and general professionalism. 3) Experience - please provide summaries of experience from past services. Offers will be evaluated based on price and the factors set forth in paragraph (a), and award will be made to the firm offering the best value to the Government. (X) OFFEROR REPRESENTATIONS AND CERTIFICATIONS-COMMERCIAL ITEMS (DEC 2014). The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically via the System for Award Management (SAM) website accessed through http:// www.acquisition.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (p) of this provision. (a) Definitions. As used in this provision- "Economically disadvantaged women-owned small business (EDWOSB) concern" means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business eligible under the WOSB Program. "Forced or indentured child labor" means all work or service- (1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or (2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties. "Highest-level owner" means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner. "Immediate owner" means an entity, other than the offeror, that has direct control of the offeror. Indicators of control ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees. "Inverted domestic corporation", means a foreign incorporated entity that meets the definition of an inverted domestic corporation under 6 U.S.C. 395(b), applied in accordance with the rules and definitions of 6 U.S.C. 395(c). "Manufactured end product" means any end product in Federal Supply Classes (FSC) 1000-9999, except- (1) FSC 5510, Lumber and Related Basic Wood Materials; (2) Federal Supply Group (FSG) 87, Agricultural Supplies; (3) FSG 88, Live Animals; (4) FSG 89, Food and Related Consumables; (5) FSC 9410, Crude Grades of Plant Materials; (6) FSC 9430, Miscellaneous Crude Animal Products, Inedible; (7) FSC 9440, Miscellaneous Crude Agricultural and Forestry Products; (8) FSC 9610, Ores; (9) FSC 9620, Minerals, Natural and Synthetic; and (10) FSC 9630, Additive Metal Materials. "Place of manufacture" means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture. "Restricted business operations" means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate- (1) Are conducted under contract directly and exclusively with the regional government of southern Sudan; (2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization; (3) Consist of providing goods or services to marginalized populations of Sudan; (4) Consist of providing goods or services to an internationally recognized peacekeeping force or humanitarian to promote health or education; or (6) Have been voluntarily suspended. "Sensitive technology"- (1) Means hardware, software, telecommunications equipment, or any other technology that is to be used specifically- (i) To restrict the free flow of unbiased information in Iran; or (ii) To disrupt, monitor, or otherwise restrict speech of the people of Iran; and (2) Does not include information or informational materials the export of which the President does not have the authority to regulate or prohibit pursuant to section 203(b)(3) of the International Emergency Economic Powers Act (50 U.S.C. 1702(b)(3)). "Service-disabled veteran-owned small business concern"- (1) Means a small business concern- (i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and (ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran. (2) Service-disabled veteran means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service connected, as defined in 38 U.S.C. 101(16). "Small business concern" means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR Part 121 and size standards in this solicitation. "Small disadvantaged business concern", consistent with 13 CFR 124.1002, means a small business concern under the size standard applicable to the acquisition, that- (1) Is at least 51 percent unconditionally and directly owned (as defined at 13 CFR 124.105) by- (i) One or more socially disadvantaged (as defined at 13 CFR 124.103) and economically disadvantaged (as defined at 13 CFR 124.104) individuals who are citizens of the United States; and (ii) Each individual claiming economic disadvantage has a net worth not exceeding $750,000 after taking into account the applicable exclusions set forth at 13 CFR 124.104(c)(2); and (2) The management and daily business operations of this definition. "Subsidiary" means an entity in which more than 50 percent of the entity is owned- (1) Directly by a parent corporation; or (2) Through another subsidiary of a parent corporation. "Veteran-owned small business concern" means a small business concern- (1) Not less than 51 percent of which is owned by one or more veterans (as defined at 38 U.S.C. 101(2)) or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more veterans; and (2) The management and daily business operations of which are controlled by one or more veterans. "Women-owned business concern" means a concern which is at least 51 percent owned by one or more women; or in the case of any publicly owned business, at least 51 percent of its stock is owned by one or more women; and whose management and daily business operations are controlled by one or more women. "Women-owned small business concern" means a small business concern- (1) That is at least 51 percent owned by one or more women; or, in the case of any publicly owned business, at least 51 percent of the stock of which is owned by one or more women; and (2) Whose management and daily business operations are controlled by one or more women. "Women-owned small business (WOSB) concern eligible under the WOSB Program" (in accordance with 13 CFR part 127), means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States. A liability is not finally determined if there is a pending administrative or judicial challenge. In the case of a judicial challenge to the liability, the liability is not finally determined until all judicial appeal rights have been exhausted. (B) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded. (ii) Examples. (A) The taxpayer has received a statutory notice of deficiency, under I.R.C. §6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights. (B) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. §6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights. (C) The taxpayer has entered into an installment agreement pursuant to I.R.C. §6159. The taxpayer is making timely payments and is in full compliance with the agreement terms.
