Chapter VI: Other Than Full and Open Competition (OFOC) SOP Attachment 3: Request for Sole Source Justification Format >$150K DEPARTMENT OF VETERANS AFFAIRS Justification and Approval (J&A) For Other Than Full and Open Competition (>$150K) 1.Contracting Activity: Department of Veterans Affairs, VISN 04, Louis A Johnson Medical Center Surgical Services - Paul Carter 2237 # 540-15-1-022-0009 2.Nature and/or Description of the Action Being Processed: In order to solicit a contracting agreement with Vascular Surgery group to provide Vascular Specialty coverage at the facility. This is a new contract for hourly labor to provide clinic coverage at an hourly rate of pay. 3.Description of Supplies/Services Required to Meet the Agency's Needs: The Louis A. Johnson VA Medical Center requires the services of a vascular surgeon to provide clinic coverage one day per week, Mondays from 0800-1630 at an estimated rate of $205.82 per hour. The contractor will also provide onsite coverage Monday-Friday 0800-1630 and 24/7 on call coverage once personnel become available. The period of performance for this requirement will be for a 6 month time frame. An Independent Government Cost Estimate has been completed. 4.Statutory Authority Permitting Other than Full and Open Competition: ( ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; (X) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): This requirement is urgent and compelling, as recruitment for staff and contracting for locum tenens services have been unsuccessful over numerous attempts. The proposed contractor is a local medical group practice capable of providing services immediately upon contract award. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Agency has attempted to fill vacant FTEE through HR recruitment processes since July 2014 with no viable candidates. Also three attempts have been made to procure a locum tenens with no viable companies available. There are GSA contracts that have established locum tenens rates. There is salary information available through various websites like salary.com. Comparisons can be made to VA hourly rates. 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Market research was conducted and unsuccessful attempts were made to award a GSA task order. No other contractors exist locally to provide the required services of the agency. 9.Any Other Facts.Supporting the Use of Other than Full and Open Competition: N/A 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: Associated Specialists, Incorporated 11.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: The facility will continue to advertise and recruit to acquire a full-time employee to fulfill this role.
