- JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY 1. Contracting Activity:Department of Veterans Affairs (VA) Office of Acquisition Operations Technology Acquisition Center 23 Christopher Way Eatontown, New Jersey 07724 2. Description of Action: The proposed action is for the procurement of two RadiantOne Virtual Directory Server (VDS) Context Edition - Non-Production Test/Development licenses and Radiant Logic RadiantOne Premium Annual Maintenance and Support. This requirement is in support of the Department of VA Office of Information and Technology and Product Development. This proposed action will be a Firm-Fixed-Price Delivery Order issued under the National Aeronautics and Space Administration (NASA) Solutions for Enterprise-Wide Procurements (SEWP) IV Governmentwide Acquisition Contract (GWAC). The period of performance for this requirement is 12 months from January 1, 2015 to December 31, 2015 with three 12-month option periods. 3. Description of the Supplies or Services: The proposed action is for the purchase of two RadiantOne VDS Context Edition - Non-Production Test/Development licenses and Radiant Logic RadiantOne Premium Annual Maintenance and Support. The Radiant Logic RadiantOne VDS licenses operate on a federated identity platform which enables authentication and specific authorization for identity management and context-driven applications. The VDS licenses are designed specifically to solve data integration challenges for non-disruptive deployments in high volume, high complexity identity environments, without customization. The Radiant Logic RadiantOne Premium Annual Maintenance and Support includes initial access to product upgrades, productivity enhancements, versions, releases, workarounds, bug fixes, and security/functional patches to licensed product(s). The support shall be available via e-mail, web, phone and data knowledge base to support maintenance and troubleshooting. 4. Statutory Authority: The statutory authority permitting an exception to fair opportunity is Section 41 U.S.C. 4106(c)(2) as implemented by the Federal Acquisition Regulation (FAR) Subpart 16.505(b)(2)(i)(B), entitled "Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized". 5. Rationale Supporting Use of Authority Cited Above: This is a brand name justification in support of FAR 11.105, Items Peculiar to One Manufacturer. Radiant Logic or authorized resellers can meet VA's requirements. In April 2013, VA procured three (3) production and two (2) Non-Production software licenses with associated maintenance and support. The Radiant Logic RadiantOne VDS software provides identity aggregation lightweight, proxy-based integration, subsystem integration for homogeneous identity sources and complete integration for a fully integrated, merged system. Furthermore, Specialized Access Control Service (SAC) has been established to standardize and centralize the control of end-user access to VA Systems, data, and other resources. SAC is "fine grained access control" that is tightly integrated with the "coarse grained access control" provided by the Provisioning Service. Both the Provisioning and SAC services have been developed, tested, and deployed using the Radiant Logic RadiantOne VDS brand name software licenses. Two additional Non-Production software licenses are required so that the pre-production environment will maintain compatibility with the multi master replication high availability model in production. The pre-production environment must match the production environment to ensure the solution is properly tested prior to deployment. The purchase of a different brand, such as the Oracle Virtual Directory or IBM Integrator, would not allow for interoperability among existing systems due to the proprietary nature of each product and would not allow Identity and Access Management (IAM) to meet the objective of testing solutions in pre-production prior to deployment. Furthermore, this lack of proper testing will lead to serious disruptions in the ability of a large user population to efficiently streamline and automate the granting and removing of electronic permissions to VA data, services, technology systems, and resources, as well as to enforce both coarse and fine grain control policies. Specifically, the negative impacts of this degradation in service include a reduction or suspension of the support services that will be experienced by the current and planned customers of the Provisioning and SAC customers which include Veterans, beneficiaries, employees, contractor affiliates, and internal VA users. 6. Efforts to Obtain Competition: Market research was conducted, details of which are in the market research section of this document. It was determined that limited competition is viable among authorized resellers for this brand name effort. In accordance with FAR 5.301 and 16.505(b) (2), this action will be synopsized at award on the Federal Business Opportunities (FBO) page and the justification will be made publicly available. In accordance with FAR 16.505(a)(4)(iii)(A), the justification will be posted with the request for solicitation on the NASA SEWP IV GWAC. 7. Actions to Increase Competition: Although the Government is limiting competition as a result of specifying a brand name item, there are authorized resellers of the requested software licenses and maintenance on the NASA SEWP IV GWAC. In order to remove or overcome barriers to competition in future acquisitions for this requirement, the agency will work with the program office to perform additional market research so that other solutions can be considered. 8. Market Research: The Government's technical experts conducted market research to ascertain the ability of any other source, other than a Radiant Logic reseller, that can provide the aforementioned services. VA technical experts conducted market research in November 2014 by researching other similar brand name items. Specifically the Government reviewed software support from Oracle Virtual Directory Service product and the IBM Directory Integrator product. The IAM team determined that the products in this space remain proprietary, and as such, solutions must be developed according to the specifications outlined by the product to be utilized, as opposed to a universal standard whereby any product can by utilized with a solution developed to that standard. Simply said, solutions developed with one product cannot be utilized with a different product, without customizing the solution for utilization with the target product. Additional market research was conducted by utilizing the Product Verification tool on the NASA SEWP website. The search identified six authorized Radiant Logic resellers; one Value Added Reseller (VAR) and Computer System Original Equipment Manufacturer from Group A, one Service-Disabled Veteran-Owned Small Business VAR from Group B, three small business VARs from Group C, and one large business VAR from Group D. 9.
