- Synopsis : Department of Veterans Affairs (VA), Network Contracting Office 22 has established a purchase order (PO) with Tony Demaria Electric for installation of Automatic Transfer Switches for VA Long Beach Healthcare System. The PO was issued to ensure continuity of care to our Veterans and to avoid the possibility of a service stoppage which could have proved injurious to Veterans. In accordance with FAR 6.302-2 and 41 USC 253(c)(2), a PO was issued for three months from date of award. This notice is not a request for proposals or information. Please direct any questions to Ryoko Foran at Ryoko.foran@va.gov. 1.Contracting Activity: Department of Veterans Affairs, Network Contracting Office 22, 4811 Airport Plaza Drive, Suite 600, Long Beach, CA 90815 2.Nature and/or Description of the Action Being Processed: In accordance with the VHA Standard Operating Procedure (SOP) for Other Than Full and Open Competition Procurements, the VA Long Beach Healthcare System (VALBHS) requests approval for firm-fixed price purchase order to Tony Demaria Electric, located at 131 West F Street, Wilmington, CA 90744. 3.Description of Supplies/Services Required to Meet the Agency's Needs: VALBHS needs three (3) Automatic Transfer Switches (ATS) installed for Building 126OP. The ATS allows the power coming from the life safety generators to enter the main switch gear and exit into the VA Medical Center. The current ATS are old and failing thus causing costly repairs and hospital power down time. The current ATS can cause a life threatening situation to the Electronics Shop employees. The employees that manually transfer the 12,000 volts have to stand in front of the blast doors to switch the power, and if the switch fails, it could blow up and cause loss of life and or serious injury to the employee. One of the switches has already failed causing a long period of power loss to the VALBHS. A long period of power loss could cause loss of life to a veteran during an operation procedure or a resuscitator that requires power to constantly ventilate a patient could fail. Expected action must occur for the protection of patients and employee as soon as possible. 4.Statutory Authority Permitting Other than Full and Open Competition: FAR 6.302-2 and 41 U.S.C. 253(c)(2): Unusual and Compelling Urgency 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): The contract is needed immediately as it will impact patient care and treatment. Delay in award of a contract would result in serious injury, financial or other, to the Government. It was found that the ATS, which allows adequate power to enter into the VALBHS needs to be replaced or rebuilt. The switches protect the amplifier`s circuit and support the main substation. Failure to replace the ATS gear will result in a catastrophic power failure to the entire building, causing severe damage to hospital grade equipment and could lead to extreme voltage issues that could possibly escalate. This would pose an extreme risk to patients, possibly loss of life, and risk to employees which directly affect patient care. It is critical that the ATS gear be replaced or rebuilt immediately to avoid any disastrous outcomes. Tony Demaria Electric is the only known company in the area that is familiar with the site conditions to complete the replacement of ATS for VALBHS. Based on previous experience with this company at VALBHS, they have the knowledge required to get the job done in a timely manner which has a minimal effect towards patient care. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Synopsis of this procurement action was not submitted to FedBizOpps due to the urgent need for these services, in accordance with FAR 5. 202(a)(2). The contracting office will provide the availability of the justification, in accordance with FAR 6.305(b). 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: Searches in eCMS and FPDS yield results for a purchase order VA262-14-P-4238 awarded to Tony Demaria Electric for emergency replacement of ATS for VALBHS in the amount of $XXXXXX. The ATS replacement on that purchase order was for two (2) ATS. Based on comparison with pervious purchase order VA262-14-P-4238, the estimated cost of $XXXXX is determined to be fair and reasonable. 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Due to the urgency of this requirement, minimal market research was conducted. The market research conducted was for the purposes of determining fair and reasonable pricing. 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: There are no other facts supporting the use of other than full and open competition. 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: No sources expressed an interest as stated in Section 6 above. 11.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: If similar services are required of a non-emergent nature in the future, the Contracting Officer will survey the market for other vendors interested in completing the services by reviewing GSA, FBO and other sources on the internet.
