Attachment 2: Request for Sole Source Memo Format DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Activity: Department of Veterans Affairs, VISN 11, (553) Detroit VAMC, 4646 John R Street, Detroit, MI 48201. Order 553-15-1-237-0026. 2.Nature and/or Description of the Action Being Processed: This is a sole source request for a firm fixed price purchase order to Callibra Inc. 3.Description of Supplies/Services Required to Meet the Agency's Needs: Renewal of the Discharge 123 software license provided by Callibra, Inc (150 North Martingale, Suite 838, Schaumburg, IL 60173; phone 847-605-2125) at a cost of $5,199.96 for a period of performance of December 15, 2014 through December 14, 2015. This license renewal is required to keep the program up and running for discharge instructions to patients as they leave the facility after treatment. Callibra is a small business vendor. 4.Statutory Authority Permitting Other than Full and Open Competition: 41 USC §253(g), as implemented by FAR 6.302. (X) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; () (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): Callibra Inc is the OEM and only distributor of the software needed to run the system/program. There are other programs available; however, the cost of replacing this system is twice the cost of renewing the current software license. The licenses to run this software are proprietary and can only be provided by Callibra. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: A search of the internet found only one vendor available to provide the license. As stated above, Callibra is the only vendor able to provide the license needed to continue use of the discharge program. 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: The cost of $5,199.96 is considered fair and reasonable based on historical pricing. The price is identical to the price paid last year for same services from Callibra Inc ($5,199.96; PO 553C40108, sole source justification approved). 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: None. 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: None particular to this solicitation/requirement. 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: None 11.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: The market will be searched for all future needs in order to locate other available sources. 12.Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief. s/Signatures on file
