- Description
- The National Institute of Standards and Technology (NIST) intends to negotiate, on a Sole Source basis, under authority of Far 6.302-1 with Tenzi KFT, of Budapest, Hungary, for the acquisition of UV-365 Irradiance Meters and UV-365 Excitation Sources to be used in the Optical Technology Division at NIST, Gaithersburg, Maryland. These parts were previously custom - made and supplied by TENZI for NIST under PO# SB1341-10-SU-1010 and SB1341-11-SU-0856 in support of the CCG projects for the US Air Force for the development of UV 365nm irradiance measurement standards and field - level night vision radiometer prototypes. NIST cites FAR 6.302-1 (a)(ii)(A) and (B) (see excerpt below) as the primary rationale for Sole Source Determination. (ii) Supplies maybe deemed to be available only from the original source in the case of a follow-on contract for the continued development or production of a major system or highly specialized equipment, including major components thereof, when it is likely to award to any other source would result in: a) Substantial duplication of cost to the Government that is not expected to be recovered through competition, or b) Unacceptable delays in fulfilling the agency's requirements. Sole Source determination is based on the requirement that the new irradiance meters and excitation sources must be compatible to the system TENZI previously developed for NIST and to satisfy the uniformity requirements of the applications and calibrations of the UV LED sources. TENZI KFT is the only known vendor capable of supplying the required devices. The North American Industry Classification Code (NAICS) code for this acquisition is 333314, and the size standard is 500 employees. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. No solicitation package will be issued. This notice of intent is not a request for competitive quotations. However, responses received by December 16, 2014 will be considered by the Government.
