Description
GENERAL SERVICES ADMINISTRATION North Branch, Real Estate Acquisition Division Justification for Other than Full and Open Competition Project # 3PA0210 U.S. Census Bureau Philadelphia, PA 1. Nature and/or description of the action being approved. The Government seeks approval to obtain a two (2) year lease extension with cancellation rights after the first year for the U.S. Census Bureau which is currently located at 833 Chestnut Street, Philadelphia, PA under Lease Number GS-03B-04335. This lease is set to expire on 12/5/2014. 2. Description of the supplies or services required to meet the agency's needs (including estimated value). The U.S. Census Bureau is scheduled to backfill the vacant GSA lease space in the Redactedilding in the fall of 2015. HoRedactedwever, this project is still in the dRedactedesign phase. Therefore, in order to protect occupancy their current lease number GS-03B-04335 requires a short term lease extension. The extension period will have cancellation rights after the first year which will allow for the Government to terminate this lease. This lease extension will provide adequate time for the design and construction of their new space in the Dow Building under Lease No. LPA12068. The U.S. Census Bureau current rental rate is $22.43/RSF. The rate for the extension period is $23.43/RSF. No improvements are required to the space during the lease extension period. The proposed rate is on the low end of the market. The total cost for this action is estimated to be: 22,902 X $23.42= $536,364.84 (annual) $536,364.84X 2 years = $1,072,729.68 total aggregate contract value 3. Identification of the statutory authority 41 U.S.C. 3304 (a) (1). Only one responsible source and no other supplies or services will satisfy the agency requirements. 4. Demonstration that the proposed contractor's unique qualifications or nature of the acquisition requires use of the authority cited. In accordance with 41 U.S.C. 3304 (a) (1), the agency's minimum needs can only be satisfied by unique supplies or services available from only one responsible source and no other type of property or services will satisfy the needs of the agency. This source can only satisfy the agency's needs due to this being a short term housing solution to protect occupancy while the agency's new space is designed and constructed. In addition, it would not be economically feasible to relocate this agency for such a short period of time. 5. Description of efforts made to ensure that offers are solicited from as many potential sources as is practicable. Market research was completed using Redacted Six (6) buildings were identified within the agency's delineated area that could potentially meet the U.S. Census Bureau's space requirement. Please see attached Market Research Report. In accordance with GSAM 570.106, this short term lease extension meets the criteria outlined in GSAM 570.405 which stated the Contracting Officer does not have to publicize lease extensions which meet the outlined criteria. Therefore, an advertisement for this leasing action was not posted on Fed Biz Opps due to this being a short term extension and that this requirement is being moved into vacant federally controlled lease space. 6. Determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable. The average fully serviced rental rates in Philadelphia, PA composite rental rates in this market range from $22.00-27.00/RSF for a fully-serviced lease, excluding tenant improvements. This market range was determined by utilizing market information from Redacted.The fully serviced rental rate for the extension period of the U.S. Census Bureau lease is $22.43/RSF. The extension period rate is on the low end of the market and is deemed to be fair and reasonable. 7. Description of the market research conducted Market research was conducted using REDACTED and recently awarded GSA leases for market comps. Please see attached Market Research Report. 8. Other facts supporting the use of other than full and open competition The Field Office has expressed no concerns with the lessor's performance and responsiveness under this lease contract. In accordance with the requirements of GSAM 517.207 (b), the lessor's performance under the lease has met the Government's expectations for quality performance. 9. List of any sources that expressed in writing an interest in the acquisition No other source has expressed in writing an interest in the acquisition. 10. Statement of actions the agency may take to remove or overcome any barriers to competition. This leasing action is for a short term leasing extension to protect occupancy while the agency's long term space is designed and constructed at the Redacted under Lease No LPA12068. The long term space is a part of a larger housing plan which backfills vacant GSA leased space. Upon expiration of the Dow building lease, if necessary and appropriate, a competitive leasing action will be initiated.
