Description
(i) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. (ii) The solicitation number is OS144589. The solicitation is issued as a Request for Quote (RFQ). (iii) This solicitation and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-74. (iv) The corresponding NAICS code is 812930 and the small business size standard is $38.5 million. (v) List of contract line item number(s) and items, quantities and units of measure - N/A (vi) Description of Requirement - The U.S. Department of Health and Human Services (HHS), Office of the Secretary, Office of Medicare Hearings and Appeals (OMHA) in Miami, Florida, requires on-site, secured, 24/7 parking at its facility at 100 SE 2nd Street. (vii) The parking access shall be available at the dates below - Base Period: 01/01/2015 - 06/30/2015 Option Period 1: 07/01/2015 - 12/31/2015 Option Period 2: 01/01/2016 - 06/30/2016 Option Period 3: 07/01/2016 - 12/31/2016 (viii) The provision at FAR 52.212-1, Instructions to Offerors - Commercial Items (APR 2014), applies to this acquisition. (ix) The provision at FAR 52.212-2, Evaluation - Commercial Items (OCT 2014), applies to this acquisition. The Government will award a contract resulting from this synopsis/solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. Additionally, FAR 52.217-5, Evaluation of Options (JUL 1990), applies to this acquisition. (x) Offerors are to include a completed copy of the provision at FAR 52.212-3, Offeror Representations and Certifications - Commercial Items (NOV 2014), with its offer or acknowledge its listing in the System for Award Management (SAM) website. (xi) The clause at FAR 52.212-4, Contract Terms and Conditions - Commercial Items (MAY 2014), applies to this acquisition. (xii) The clause at FAR 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders - Commercial Items (OCT 2014), applies to this acquisition. The Contracting Officer has indicated the following clauses listed in paragraph (b) as applicable and are hereby incorporated by reference: (4) 52.204-10, Reporting Executive Compensation and First-Tier Subcontract Awards (JUL 2013); (8) 52.209-6, Protecting the Government's Interest When Subcontracting with Contractors Debarred, Suspended, or Proposed for Debarment (AUG 2013); (25) 52.222-3, Convict Labor (JUN 2003); (27) 52.222-21, Prohibition of Segregated Facilities (FEB 1999); (28) 52.222-26, Equal Opportunity (MAR 2007); (30) 52.222-36, Equal Opportunity for Workers with Disabilities; (39) 52.223-18, Encouraging Contractor Policies to Ban Text Messaging While Driving (AUG 2011); (43) 52.225-13, Restrictions on Certain Foreign Purchases (JUN 2008); and (49) 52.232-33, Payment by Electronic Funds Transfer - System for Award Management (JUL 2013). The Contracting Officer has indicated the following clauses listed in paragraph (c) as applicable and are hereby incorporated by reference: (1) 52.222-41, Service Contract Labor Standards (MAY 2014); and (2) 52.222-42, Statement of Equivalent Rates for Federal Hires (MAY 2014). (xiii) Sole Source Justification - OMHA is currently leasing office space from Jones, Lang and LaSalle at 100 SE 2nd Street, Miami, Florida 33131. The building has a garage facility that is available to tenants for a monthly fee, and the garage facility is owned and administered only by the City of Miami Parking Authority (MPA). OMHA provides parking spaces to the Supervisory Administrative Law Judges; visitors; and visitors/employees with handicap accessibility. Because the City of Miami Parking Authority garage located at the OMHA facility at 100 SE 2nd street is the only secured, structured facility providing 24/7 access, located at the same address as the agency, it is the only viable option for parking services. The facility must be secured by either a gate or an attendant because OMHA government employees, primarily Supervisory Administrative Law Judges, are at a higher security risk. They carry valuable equipment and any PII documentation removed from the office must be secured. No other garage is located on-site. Travel from the garage to the OMHA facility is secure and ensures the safety of the Supervisory Administrative Law Judges and the equipment/documents they carry, especially those documents related to cases, hearings, and litigation. (xiv) The clauses at FAR 52.217-9, Option to Extend the Term of the Contract (MAR 2000); FAR 52.232-40, Providing Accelerated Payment to Small Business Subcontractors (DEC 2013); HHSAR 352.203-70, Anti-Lobbying (MAR 2012); and HHSAR 352.222-70, Contractor Cooperation in Equal Employment Opportunity Investigations (JAN 2010), apply to this acquisition.
