- Exception to fair opportunity, J&A, FAR 16.505 Justification for an Exception to Fair Opportunity to extend the period of performance and total estimated cost within the authority of FAR Part 16.505(b)(2)(i)(C). This authority was utilized to extend the period of performance of the current Task Order. The Task Order implements the USAID Mexico Justice and Security Program, the USAID project under the Merida Initiative, a bilateral initiative of the highest priority for the Government of Mexico (GOM) and the United States Government (USG) to promote security and the rule of law in the region. This TO supports the implementation of the 2008 constitutional amendment that mandates Criminal Justice Reform (CJR) throughout Mexico. This activity was to be replaced by the procurement of a new activity by the end of Fiscal Year (FY) 2013. However, certain protests during the procurement process have delayed the new activity which is currently in the work plan development stage and is not expected to begin activities until at least December 2014. Meanwhile, the constitutional deadline of June 2016 for the GOM to implement the CJR, critical to the Merida-related reforms, is rapidly approaching. The GOM is accelerating the pace of the CJR implementation and has requested increase support from USAID. The extension of the TO with MSI is necessary to most economically and efficiently main USAID's level of effort until the new activity is operational and meet CJR goals previously scheduled and planned to take place in the months of October and November 2014. The extension will also allow for mobilization of the new activity and proper transition to the new activity during the November-December 2014, to ensure that there is no potential lapse in delivering this critical assistance to the GOM.
