Description
Approved Sole Source Justification PLEASE READ THIS ENTIRE NOTICE CAREFULLY AS IT CONSTITUTES THE ONLY NOTICE THAT WILL BE ISSUED. This is a combined synopsis and solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6 as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. Request For Quotation (RFQ) number is N66604-15-Q-0167. The Naval Undersea Warfare Center Division, Newport (NUWCDIVNPT) intends to award a firm fixed price purchase order for the annual renewal of HyperWorks and PBS Professional Software Maintenance (Part No.: HW-STD-MNT - LMX based HyperWorks Units - Maintenance; Qty.: 2) for perpetual commercial licenses on two (2) servers in the Advanced Scientific and Engineering Computation Center (ASECC). NUWCDIVNPT has used HyperWorks and PBS software and maintenance since 2002 and renewal of this software maintenance ensures the ASECC receives uninterrupted use of the latest software updates, patches, and user hotline support. This is a follow on to Purchase Order N66604-14-P-0011 with Altair Engineering, Inc. Altair Engineering, Inc. is the sole owner and developer of the proprietary software including all software maintenance and support. As such, this requirement will be awarded to Altair Engineering, Inc. on a sole source basis; no substitutions allowed (see attached sole source justification). Interested parties may identify their interest and capability to respond to the requirement. The period of performance is from date of award through October 31, 2015. F.O.B. Destination, Naval Station Newport, RI. 02841. This procurement is solicited on an Unrestricted basis. The North American Industry Classification System (NAICS) Code for this acquisition is 511210. The Small Business Size Standard is $38,000,000. Incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-77. The provision at FAR 52.212-1 Instructions to Offerors--Commercial Items applies to this solicitation. The provision at FAR 52.212-3 (ALT 1), Offeror Representations and Certifications--Commercial Items applies to this solicitation. FAR 52.212-4, Contract Terms and Conditions--Commercial Items, FAR 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders-Commercial Items, and DFARS 252.212-7001, Contract Terms and Conditions Required to Implement Statutes or Executive Orders Applicable to Defense Acquisitions of Commercial Items apply. This requirement will be awarded to the Offeror with the lowest price technically acceptable (LPTA) quote. The following addenda or additional terms and conditions apply: Defense Priorities and Allocations System (DPAS) rating is DO-C9. In accordance with FAR 39.204(d), an exception to Section 508 applies; items are located in spaces frequented only by service personnel for maintenance, repair or occasional monitoring of equipment. Offers should include price and delivery terms and the following additional information: point of contact information (including phone number and email address) and contractor cage code.
