Attachment 2: Request for Sole Source Memo Format DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Activity: Department of Veterans Affairs, VISN 11, John D. Dingell VA Medical Center, Justification for Other Than Full and Open Competition to Drexel University, for small animal studies related to traumatic brain injury, including behavioral, cellular and molecular analyses. Purchase Request 553-15-1-081-0033. 2.Nature and/or Description of the Action Being Processed: This is a request for a new firm-fixed price purchase order for Drexel University (3141 Chestnut Street, Philadelphia, PA 19104-2875 215-993-8497) to perform small animal studies related to traumatic brain injury, including behavioral, cellular and molecular analyses. Data analyses (including statistics), preparation of manuscripts and presentation of data will be included. 3.Description of Supplies/Services Required to Meet the Agency's Needs: To perform small animal studies related to traumatic brain injury, including behavioral, cellular and molecular analyses. Data analyses (including statistics), preparation of manuscripts and presentation of data will be included. The period of performance is November 1, 2014 through September 30, 2015. Estimated cost is $23,006.00 ($150.00 per hour). 4.Statutory Authority Permitting Other than Full and Open Competition: ( X) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): a. Only One Responsible Source (FAR 6.302-1) -Drexel University has nearly 30 years of experience with small animal models of brain injury. It has the skills, experience and knowledge to design and implement the types of studies required to collect the necessary data and to assess the data. Its unique expertise with small animal modeling make it critical to the funded research program for which it will be collecting and analyzing data, which will be performed by Dr. Ramesh Raghupathi, a Drexel University faculty member. There are no other Universities with this particular experience. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: There are no other Universities with this particular experience therefore no other quotes were requested. 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: The rate of $150.00 per hour is fair and reasonable considering rates at other facilities range from $150 - $700 per hour for comparable services. Wayne State University charges $175.00 per hour for the same services. The price has also been deemed fair and reasonable based on the independently calculated IGCE of $23,006.00 ($150.00 per hour). 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: No market research was conducted since no other applicant has the unique experience to fulfill the particular needs of the current research program, considering Dr. Raghupathi's established association with a funded VA research program.
