- The Army Contracting Command - New Jersey (ACC-NJ), on behalf of Project Manager Soldier Weapons (PM SW), intends to issue a request for proposal (RFP) W15QKN-15-R-0011. This solicitation is to procure approximately 292,000 M4 Carbine (NSN: 1005-01-231-0973/Part Number 9390000 and M4A1 Carbine (NSN: 1005-01-382-0953/Part Number 12972700 built to print using the Technical Data Package (TDP). This procurement action will be a Full and Open competition in accordance with FAR 9.104-2(a), special standard of responsibility. The M4/M4A1 must be manufactured exclusively within the United States or its Territories. The M4/M4A1 Carbines provide the Department of Defense with compact, lightweight weapons that fire NATO 5.56mm ammunition from a 30-round magazine, mount the latest generation of fire control accessories and enablers, and provide increased protection and firepower in close quarters. The period of performance (POP) of the contract(s) will be for five (5) one-year ordering periods to cover FY16 - FY20 Army and Department of Defense (DoD) M4/M4A1 Carbine requirements. The anticipated contract minimum guarantee of $10,000.00 will apply to each contract and will be met with the first delivery. To meet this requirement for FY 2016 through 2020, the United States Government intends to award up to two (2) Indefinite Delivery Indefinite Quantity (IDIQ) Contracts with Firm-Fixed-Price Delivery Orders. This procurement will be awarded to the Offeror (s) whose proposal(s) represent the best value to the Government using Trade-Off Processes. The following will be provided as Government Furnished Material and Property: a. Operators Manual: (1) Technical Manual 9-100-319-10, June 2010, will be provided to be over packed with the M4/M4A1 Carbine. b. M68 Close Combat Optic: For Air Force requirements, (1) M68 Close Combat Optic, NSN 1240-01-576-6134, will be supplied to be over packed with each M4/M4A1. c. Ammunition: Ammunition will be supplied for use in testing. The contractor is responsible for timely notification of the contracting officer of their ammunition requirements, (DODIC AB57, M855A1 Cartridge, NSN 1305-01-559-3335, Quantity To Be Determined d. Availability of Government-Furnished Property and Schedule: The contractor will provide a delivery schedule to receive the property with monthly delivery rates. The Technical Data Package (TDP) for the M4/M4A1 is marked Distribution D and is controlled by International Traffic in Arms Regulations (ITAR). Once the solicitation is released, interested parties must mail/email a signed and approved DD Form 2345 Military Critical Technical Data Agreement along with a completed and signed AMSTA-AR Form 1350 Technical Data Request Questionnaire, and a completed and signed U.S. Government Non-Disclosure / Non-Use Agreement (forms included in solicitation documents). A copy of the company's State/Provincial Business License, Incorporation Certificate, Sales Tax Identification Form or other documentation which verifies the legitimacy of the company must accompany the DD Form 2345. Should the Government provide to a contractor, other than Colt's, Government-owned machinery, production equipment, facilities or plant at no cost or reduced cost, then an amount equivalent to the utilization value, as computed in accordance with applicable procurement regulations (FAR 52.245-9 Use and Charges), shall be added to the total contract price of the M4/M4A1 Carbine for the purpose of determining total royalty obligation payable to Colt Defense, LLC. Once all required documents have been received and verified, ACC-NJ will release the proprietary TDP by ground mail or upload to the Safe Access File Exchange (SAFE) site. All Offerors should send their mail account(s) charge number (UPS, FedEx, etc) with their TDP request to expedite delivery. In accordance with the license agreement between the US Government and Colt Defense, LLC, a royalty fee is applicable to a portion of the M4 and M4A1 manufactured by an entity other than Colt Defense, LLC, Colt's affiliate, or Colt's licensees. As such, an evaluated royalty amount will be added to the total evaluated price of Offerors other than Colt Defense, LLC, Colt's affiliate, or Colt's licensees. The royalty price adjustment will be calculated by applying a royalty rate of 5% to a portion of the acquisition price of the M4 and M4A1 weapon system, including FAT units. This PRE-SOLICITATION NOTICE is for information and planning purposes only and does not constitute a formal Request for Proposal (RFP). This PRE-SOLICITATION NOTICE is not to be construed as a commitment by the Government. This is not a solicitation and does not obligate the Government to issue a solicitation, nor will the Government be liable for any costs involved for submission of information in response to this notice. Release of an official solicitation is anticipated to occur towards the end of November 2014. Interested parties are encouraged to monitor FedBizOpps for the release of the solicitation.
