- Attachment 2: Request for Sole Source Memo Format DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Activity: Department of Veterans Affairs, VISN 11, Aleda E. Lutz VA Medical Center 1500 Weiss St., Saginaw, MI 48603 2.Nature and/or Description of the Action Being Processed: Maintenance contract to cover one annual preventive maintenance inspection (PMI) to verify calibration/operation of MEDRAD injector, corrective maintenance to cover repairs as needed and to provide software updates/upgrades as available. This equipment is used in conjunction with our Toshiba CT Scanner located in the radiology department. 3.Description of Supplies/Services Required to Meet the Agency's Needs: Contractor shall supply all supervision, labor, travel, equipment, parts and supplies to provide one annual preventive and any corrective maintenance services as required to keep Saginaw's MEDRAD dye injector, 1ea, est. annual cost $5405.00 (Model: Stellant D, SN: 29743, EE21969) and the attached OSC/CS mounting arm and bracket, 1ea, est. annual cost $627.00 (SN: 1.273E+10) fully functional and within manufacturers standards of calibration and operation. Annual preventive maintenance date to be determined upon award of contract. Estimated cost for the base year is $6,032.00. Aggregate total cost for the base year contract with four (4) contract option years is $33,3330.60. 4.Statutory Authority Permitting Other than Full and Open Competition: (X) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): Only One Responsible Source (FAR 6.302-1) - The Stellant Dye Injector, manufactured by MEDRAD, uses proprietary and copyrighted software designed specifically for the use and calibration of the dye injector. This is a highly specialized piece of medical equipment which uses software available only to MEDRAD authorized, trained and licensed field service representatives used in conjunction with our CT scanner. Bayer/MedRad is the only vendor capable of providing the supplies and services described in section III. The warranty is affected if other technicians than Bayer /MEdRad service the equipment. The warranty is affectd if replacement parts are utilized other than Bayer / MedRad parts. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Annual review of existing equipment operation and periodic maintenance has shown that MedRad is still the only OEM authorized vendor that can provide maintenance and calibration services for the MedRad dye injector. 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: Annual increases in price have been nominal over the life of the equipment. As the age of the equipment increases, commensurate maintenance costs may increase to maintain the full function of the equipment for the full expected lifespan of the equipment, which is still far less than complete replacement of the system. Consistent, periodic maintenance and calibration of the equipment will keep repairs and other maintenance costs down. Bayer / MedRad is the only vendor that can provide the services without voiding the warranty. Pricing is in line with last year's pricing of $6,032.00. 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Market research is ongoing and consists of evaluation of previous years' service charges and reliance upon historical maintenance costs and service rate increases of similar equipment. No other vendor can provide the services required for the MedRad / Bayer dye injector. 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: N/A 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: N/A 11.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: This method of awarding follow-on contact is not considered a barrier to competition.
