Description
DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1. Contracting Activity: The U.S. Department of Veterans Affairs, Amarillo Contracting Office, Network Contracting Activity 18, located at 7201 I-40 West, Suite 100, Amarillo TX 79106 proposes to enter into a firm-fixed price contract on the basis of justification for other than full and open competition (OTFOC) for the VA El Paso Healthcare System, Network Contracting Activity 18, located at 5001 N. Piedras Street, El Paso, Texas 79930. The 2237# is 756-15-1-045-0001. 2. Nature and/or Description of the Action Being Processed: The VA El Paso Healthcare System is requesting the sole source purchase of maintenance, repair and software support for the Government -Owned Stellaris Phacoemulsification Unit by Bausch & Lomb, Inc. 30 Enterprise Suite 450, Aliso Viejo, CA 92656, phone number 636-226-3251. 3. Description of Supplies/Services Required to Meet Agency's Needs: Maintenance, Repair and Software Support for the government owned Stellaris Phacoemulsification Unit with (8) BL3170 Stellaris Ultrasound Hand pieces located in VA El Paso Healthcare System. This equipment is considered mission critical and imperative to patient care. The service renewal contract period of performance is required from October 1, 2014 - September 30, 2015 for the Base Year with potential of four additional Option Years (10/1/2015 - 9/30/2016, 10/1/2016 - 9/30/2017, 10/1/2017 - 9/30/2018, 10/1/2018 - 9/30/2019). The estimated value of this acquisition is $80,575. 4. Statutory Authority Permitting Other Than Full and Open Competition: IAW FAR 6.302-1 -- Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements: per FAR 6.302-1. (X) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability, or Expert Services per FAR 6.303-3; ( ) (4) International Agreement per FAR 6.304-4; ( ) (5) Authorized or Required by Statute per FAR 6.304-5; ( ) (6) National Security per FAR 6.304-6; ( ) (7) Public Interest per FAR 6.304-7; 5. Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): Bausch & Lomb, Inc. is the Original Equipment Manufacturer (OEM) and has proprietary rights on all hardware, software, services and repairs for the Stellaris Phacoemulsification Unit currently used at the VA El Paso Healthcare System. The original equipment was purchased under IFCAP PO 756-A0235 at the VA El Paso Healthcare System on September 26, 2007 for $107,000. The delivery did not occur until September 2009, and included an extended warranty. Additionally, a sole source letter on company letterhead, dated February 26, 2014, was received by this office from Bausch & Lomb representative, Gale Dias, and can found in the eCMS Briefcase, Tab P02. 6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: A search was made against current FSS contracts via the NAC Contract search tool, GSA Advantage, VETBIZ, and the internet which resulted in no potential sources being found other than the manufacturer - Bausch & Lomb, Inc. 7. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: The anticipated price to the Government is $16,115.00 (see chart below) for the Base Year commencing in FY15 is as follows: QUANTITYPART NO.DESCRIPTIONUNIT PRICEEXT. PRICE 1BL12110Stellaris Anterior Deluxe System$6,875.00$6,875.00 Dates:10/1/2014 - 9/30/2015 Serial #:SYS00160 8BL3170Stellaris Ultrasound Hand Pieces$1,155.00$9,240.00 Dates:10/1/2014 - 9/30/2015 Serial #:USH15155, USH16380, USH04977, USH03467, USH19849, USH20991, USH17246, USH19773 Total:$16,115.00 Additionally, the Option Year's ICGE and contractor's pricing will be compared and further evaluated to ensure that overall pricing is not imbalanced. *Previously, a Base plus Two Option year sole source contract, VA258-P-0611, was awarded for this location commencing on October 1, 2011. The negotiated cost was $14,650 per year and remained unchanged throughout the entire contract. Furthermore, all things taken into consideration (i.e., cost of living, lodging, gas, older government-owned equipment, etc.), an net increase of $1,465 per year approximately three years later is determined as minimal. Thus, the cost of the repair service for the Stellaris Phacoemulsification Unit is considered to be fair and reasonable based upon previous purchase order history of pricing or repair services of similar type items IAW FAR 13.106-3(a)(2)(ii). 8. Any Other Facts Supporting the Use of Other than Full and Open Competition Market Research Was Not Conducted: Market research included FSS schedules and open market sources of available repair services; however, other repair services are unable to meet the government's requirements. The Government's minimum requirement for schedule and technical capability for this service is satisfied only by Bausch & Lomb, Inc. 9. Any Other Facts Supporting the Use of Other than Full and Open Competition: Delay in award could possibly cause additional problems if the VA loses power, or a computer bug infects the software - potentially leading to personal data lost and/or stolen. 10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: A Sources Sought Notice was posted upon FBO website, dated February 26, 2014, and zero sources submitted any such information in response. 11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: The proposed contract is a recurring type proprietary purchase/service. This action currently allows the VA El Paso Healthcare System to continue these services uninterrupted. Due to above, the NCO is unable, at this moment, to compete the requirement concerning future endeavors. However, the local acquisition team will necessitate its due diligence and continue to perform expanded market research with the internet tools readily available to provide the latest changes, if any, for current market conditions. 12.
