LIMITED SOURCES JUSTIFICATION ORDER >$3,000 FAR PART 8.405-6(g) This acquisition is conducted under the authority of the Multiple Award Schedule Program. The material or service listed in par. 3 below is sole source, therefore, consideration of the number of contractors required by FAR Subpart 8.4 - Federal Supply Schedules, is precluded for the reasons indicated below. Restricted to the following source: Provide original manufacturer's name for material or contractor's name for service. (If a sole source manufacturer distributes via dealers, ALSO provide dealer information.) Manufacturer/Contractor: Olympus American Inc. ?The requested material or service represents the minimum requirements of the Government. (1) AGENCY AND CONTRACTING ACTIVITY:Department of Veterans Affairs VISN 6 NCA_____________________ ___ ____ 27 Averill Dr.______________________ ______ Hampton, VA 23667 VISN:6 (2) NATURE AND/OR DESCRIPTION OF ACTION BEING APPROVED: This justification provides the rationale for contracting by other than full and open competition for endoscope video processors and light towers, to be awarded on a sole source basis to Olympus American, Inc, FSS schedule number V797P-2065D. (3) (a) A DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED TO MEET THE AGENCY'S NEED: The Fayetteville HCC will purchase video processors and light sources within Federal Supply Schedule (FSS), Contract Number V797P-2065D. (b)ESTIMATED DOLLAR VALUE: $ REDACTED (c)REQUIRED DELIVERY DATE: 6/1/2015 (4) IDENTIFICATION OF THE JUSTIFICATION RATIONALE (SEE FAR 8.405-6), AND IF APPLICABLE, A DEMONSTRATION OF THE PROPOSED CONTRACTOR'S UNIQUE QUALIFICATIONS TO PROVIDE THE REQUIRED SUPPLY OR SERVICE. 1The material/service must be compatible in all aspects (form, fit and function) with existing systems presently installed/performing. Describe the equipment/function you have now and how the new item/service must coordinate, connect, or interface with the existing system. The Fayetteville HCC currently owns Olympus Bronchoscopes, Laryngoscopes, Colonoscopes, Gastroscopes, Laparoscopes, Cytoscopes, and leases Olympus videoendoscopes as per VHA Deputy Undersecretary of Health for Operations and Management (DUSHOM) Memorandum "VHA National Standardization of Endoscopes" dated 12/06/2010. Olympus video processor processors and light towers are the only processors that can be used with the Olympus leased scopes. The station currently owns Olympus 180 series video processors and light sources, but are in the process of upgrading their leased endoscopes. The scope upgrade decision was made to comply with the DUSHOM goal, as stated in the 2010 memo, of providing videoendoscopes "preferably of the most recent generation." VISN-6 has determined the advanced capabilities of the most recent generation of Olympus videoendoscopes, such as 3D imaging and HD video feeds, will allow physicians to provide the best care to the Veterans receiving care in VISN-6. In order to upgrade to the Series 190 videoendoscopes, the current videoprocessors and light sources in use at each station must be upgraded from Series 180 to Series 190; Series 180 videoprocessors and light sources are not compatible with series 190 videoendoscopes. VISN-6, in accordance with the 2010 DURSHOM memo, has standardized its videoendoscope inventory. The standardization effort involved replacing all owned videoendoscopes with leased Olympus videoendoscopes. The station has purchased reprocessing and sterilization equipment designed to clean and sterilize Olympus scopes. No other vendor can fill this requirement without a requirement for the Fayetteville HCC to purchase or lease (as appropriate) new scopes, reprocessors for the scopes, and required accessories, representing a significant duplication of cost not expected to be recovered through competition. The cost to replace all scopes in the medical center would exceed $1,000,000.00. Disinfection systems cost at least $110,000.00 each, and steam sterilizers are approximately $162,000 each. Reprocessors, with the required components to interface with scopes manufactured by particular brands, cost approximately $140,000.00. All pricing is based on FY12 and FY13 purchases, and quotes received in FY14. The total approximate cost to replace the stations scope inventory and required reprocessing/sterilization equipment is $1.9M. (5) DESCRIBE WHY YOU BELIEVE THE ORDER REPRESENTS THE BEST VALUE CONSISTENT WITH FAR 8.4 TO AID THE CONTRACTING OFFICER IN MAKING THIS BEST VALUE DETERMINATION: Each manufacturer's video processing systems and light sources are proprietary and only interface with scopes made by that manufacturer. The cost to replace the scopes, the sterilizers, and reprocessing equipment represents a significant cost to the Fayetteville HCC and is not cost effective. The cost of the videoprocessors and light sources, which are available on the Olympus FSS schedule, has been determined to be fair and reasonable as per FAR 8.404(d). (6) DESCRIBE THE MARKET RESEARCH CONDUCTED AMONG SCHEDULE HOLDERS AND THE RESULTS OR A STATEMENT OF THE REASON MARKET RESEARCH WAS NOT CONDUCTED: A sources sought notice was posted to GSA eBuy to determine if other vendors were capable of providing video processors and light sources capable of interfacing with Olympus scopes. Nine responses stating the equipment was not available on the vendor's schedules were received. A single vendor, Olympus, replied stating the equipment was available through their schedule. The NAC MedSurg catalog was queried, and Olympus was the sole vendor providing the requested equipment. (7) ANY OTHER FACTS SUPPORTING THE JUSTIFICATION: None. (8) A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS THAT LED TO THE RESTRICTED CONSIDERATION BEFORE ANY SUBSEQUENT ACQUISITION FOR THE SUPPLIES OR SERVICES IS MADE: When the video processors and light towers require replacement, in 8-10 years, the market will be surveyed to determine if Olympus technology continues to offer the most technologically advanced solution that enhances Veteran healthcare at the VISN-6 facilities. At that date, it is likely the sterilization systems and reprocessors will also require replacement, and a competitive solicitations could be issued for the scopes, required accessories, and scope maintenance system. ?
