Description
This notice is being published in accordance with Federal Acquisition Regulation (FAR) Part 5.101 requiring the dissemination of information for proposed contract actions. This is a notice of intent to award a sole-source contract and is not a request for competitive proposals. The United States Navy's Military Sealift Command (MSC) intends to issue a sole-source, firm-fixed-price contract to Appleton Marine, Inc. (AMI) for fabrication of a hydraulic cylinder for the crane system on the M/V KELLIE CHOUEST. AMI is the Original Equipment Manufacturer (OEM) of this crane. The hydraulic cylinder on the crane is no longer functional, and MSC is responsible for replacing it. The OEM, AMI, is reasonably the only vendor capable of providing the specific hydraulic cylinder necessary. AMI retains all data rights to the design and specifications of the hydraulic cylinder and the overall crane system. Further, the crane is vital equipment on the vessel and failure of this system represents significant risk to the crew. Accordingly, ensuring the hydraulic cylinder procured is compatible and safe to operate with the crane system already in place on the vessel is imperative to the overall safety of the vessel and crew. Finally, because the crane is such a vital part of the ship's safe operation and its overall mission, it is in the best interest of the Government to procure the needed hydraulic cylinder with the least risk of inoperability or failure. Since the OEM is inherently best suited to provide the needed part and represents the lowest risk of potential failure, it is in the Government's best interest to procure the hydraulic cylinder from AMI. This procurement is being issued using the Simplified Acquisition Procedures, FAR Part 13. The authority for the sole source procurement is cited at FAR 13.106-1. This notice of intent is not a request for competitive proposals. However, all responsible sources may submit a capability statement demonstrating the ability to provide the requested items or exception to the intent to purchase on a sole source basis, which shall be considered by the Government if received by Friday, 19 September 2014 at 12:00 p.m., local time, Washington D.C. Written responses to this synopsis shall contain sufficient documentation to establish a bonafide capability to fulfill the requirement. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. A determination not to compete this requirement, based upon responses to this notice, is solely within the discretion of the Government. MSC will not be responsible for any costs incurred by interested parties in responding to this notice. The Government is not obligated to and will not pay for any information received from potential sources as a result of this synopsis.
