Description

JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY 1.Contracting Activity: Department of Veterans Affairs (VA) Office of Acquisition Operations Technology Acquisition Center 23 Christopher Way Eatontown, NJ 07724 2. Description of Action: The proposed action is for a firm-fixed-price Delivery Order to renew CommVault Software Premium Support Coverage currently licensed software in use at the Department of Veterans Affairs (VA) Financial Services Center (FSC). The proposed effort will be awarded under the National Aeronautics and Space Administration (NASA) Solutions for Enterprise-Wide Procurement (SEWP) IV Government-Wide Acquisition Contract (GWAC). The period of performance for this requirement is a base period of 12 months, with no option periods. 3. Description of Supplies or Services: The proposed action is to procure CommVault Software Premium Support Coverage for the software that is currently licensed at the VA FSC. The warranty and maintenance support services include 24x7x365 remote technical support, access to a team of Support Engineers, and access to the CommVault e-Support Portal. Included in the support coverage is also access to software patches, updates, hotfixes, product enhancements and new releases. 4. Authority Cited: The statutory authority permitting an exception to fair opportunity is Section 41 U.S.C. 4106(c)(2) as implemented by the Federal Acquisition Regulation (FAR) Subpart 16.505(b)(2)(i)(B), entitled "Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized". 5. Rationale Supporting Use of Authority Cited Above: Based on the market research detailed below, the Government anticipates limited competition for the aforementioned brand name requirement. This is a brand name justification in support of FAR 11.105, Items Peculiar to One Manufacturer. This acquisition specifies that CommVault brand name warranty and maintenance support be provided. VA does not possess the proprietary technical data required to maintain and upgrade the CommVault software appliances that have been in use at the FSC for several years. Failure to acquire the warranty and maintenance support for these appliances would leave VA without the necessary certified support needed if/when system problems occur. The procurement of new software rather than renewing the warranty and maintenance support would result in substantial duplication of costs that would not be recovered through a new competitive acquisition. 6. Efforts to Obtain Competition: Market research was conducted, details of which are in the market research section of this document. Limited competition among CommVault authorized resellers is anticipated for the required warranty and maintenance support services. In accordance with FAR 5.301 and 16.505(b)(2), this action will be synopsized at time of award on the Federal Business Opportunities Page and the justification will be made publicly available. In accordance with FAR 16.505(a)(4)(iii)(A), the justification will be posted with the request for quote on the NASA SEWP IV GWAC. 7. Actions to Increase Competition: The Government will continue to conduct market research to ascertain if there are changes in the market place that would enable future actions to be competed. 8. Market Research: Market research was conducted in July 2014 to ascertain if other products could satisfy VA's requirements. Specifically, VA subject matter experts looked at Carbonite Backup and GlobalDataVault brands. These brands could not operate in the current environment due to interoperability and capability issues. The CommVault software has proprietary information that these other software brands would not have access to and, although they perform maintenance services similar to those required for this effort, they would not be able to meet FSC's requirements without the proprietary information. Based upon this market research, it is in VA's best interest to continue to maintain the existing CommVault brand name software licenses, which meets all of FSC's current needs, rather than replacing them with brand new software licenses. Additional market research was conducted using the product verification tool on the NASA SEWP website to search for resellers of the required brand name warranty and maintenance support services. Currently there are 21 SEWP venders that offer the required services; three Value Added Resellers (VARs) and Computer System Original Equipment Manufacturers in Group A, four service-disabled Veteran-owned small business VARs in Group B, seven small business VARs in Group C, and seven VARs in Group D. 9.
