- JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY 1. Contracting Activity:Department of Veterans Affairs (VA) Office of Acquisition Operations Technology Acquisition Center 23 Christopher Way Eatontown, New Jersey 07724 2. Description of Action: The proposed action is for a firm-fixed-price delivery order issued under the National Aeronautics and Space Administration (NASA) Solutions for Enterprise-Wide Procurement (SEWP) IV Government-Wide Acquisition Contract (GWAC), for the purchase of Imaging Business Machines LLC (IBML) PostScan Software and associated add-on components for searchable Portable Document Format (PDF) conversion. This requirement is in support of VA Financial Services Center (FSC) enterprise scanning operations. The period of performance for the software maintenance shall be 12 months from date of delivery order award for the base period with two 12 month option periods. 3. Description of Supplies or Services: This requirement is to procure brand name IBML PostScan software to be installed on a development server which will be used to develop and test scan jobs before moving them to the production server. VA FSC currently has a production license for this software. In addition, an add on component to the PostScan software is required to allow documents to be converted to searchable PDF to support requirements for a VA FSC customer. Associated annual maintenance support for the software will also be included in this procurement action. Software maintenance support services shall include software patches, upgrades, and telephone support from 8:00 AM to 5:00 PM, client's local time, Monday through Friday with a 4 hour response time. 4. Statutory Authority: The statutory authority permitting an exception to fair opportunity is Section 41 U.S.C. 4106(c)(2) as implemented by the Federal Acquisition Regulation (FAR) Subpart 16.505(b)(2)(i)(B), entitled "Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized". 5. Rationale Supporting Use of Authority Cited Above: This is a brand name justification in support of FAR 11.105, Items Peculiar to One Manufacturer. Based on extensive market research as described in paragraph eight of this document, it was determined that limited competition is viable among IBML resellers on SEWP for this brand name requirement. A contract was issued in 2013 to purchase/lease new production scanners for the FSC. The requirement was issued on a full and open basis for any manufacturer, or reseller, of high speed production scanners to submit a quote. As a result of this acquisition, IBML production scanners were added at the FSC. IBML's PostScan software is designed specifically to operate with the IBML hardware making it the only software that is capable of working with the existing scanning infrastructure currently in use at the VA-FSC. VA does not possess the proprietary technical data required to maintain and upgrade the IBML software that the FSC purchased in 2013. Failure to acquire the maintenance support for the software would leave VA without the necessary certified support needed to keep the software operational. The procurement of new software rather than renewing the maintenance support would result in substantial duplication of costs that would not be recovered through a new competitive acquisition. 6. Efforts to Obtain Competition: Market research was conducted, details of which are in the market research section of this document. It was determined however that limited competition is viable among authorized resellers for this brand name effort. In accordance with FAR 5.301 and 16.505(b)(2), this action will not be synopsized at award on the Federal Business Opportunities Page and the justification will not be made publicly available. In accordance with FAR 16.505(a)(4)(iii)(A), the justification will be posted with the request for solicitation on the NASA SEWP IV GWAC. 7. Actions to Increase Competition: Although the Government is limiting competition as a result of specifying a brand name item, there are several authorized resellers of IBML software maintenance support services on the NASA SEWP IV GWAC. Finally, in order to remove or overcome barriers to competition in future acquisitions for this requirement, the agency will work with the program office to perform additional market research so that other solutions can be considered. 8. Market Research: Market research was conducted in August 2014 by reviewing other similar software products that are currently available in the commercial market place. Specifically, VA subject matter experts looked at Banctec, Inc., Kodak, and Fujitsu brands software and determined that none of these products could seamlessly integrate into the existing VA network without access to IBML's proprietary information. Based upon this market research, it is in VA's best interest to continue to maintain the existing IBML software licenses, which meets all of FSC's current needs, rather than replacing them with brand new software licenses and subjecting FSC to unknown risks and additional costs associated with acquiring and rolling out another software product. Additional market research was conducted on August 19, 2014 by utilizing the Manufacturer Lookup Tool on the NASA SEWP IV GWAC website. The search identified seven authorized resellers of IBML products; two in Group A Value Added Resellers (VARs) and Computer System Original Equipment Manufacturers, two in Group B service-disabled Veteran-owned small business VARs, two in Group C small business VARS, and one in Group D VARs. 9.
