- Pursuant to FAR 13.016‐1(b), the Department of Health and Human Services (DHHS), Program Support Center, Acquisition Management Services, on behalf of the DHHS, Supply Service Center (SSC), Perry Point, Maryland intends to negotiate and award a purchase order on a sole source basis to Life Technologies, 3175 Staley Road, Grans Island, New York 14072 for a ABI7500 Fast Dx Polymerase Chain Reaction Instrument and service agreement. Life Technologies is the manufacturer. The Department of Health and Human Services (HHS), Program Support Center, Acquisition Management Services located at the Supply Service Center, Perry Point Maryland wishes to award a purchase order on a sole source basis to Life Technologies Corporation. Justification: The Medical Identification and Treatment Systems-Critical Reagents Program (MITS-CRP) supports the Warfighter, federal agencies, and the Joint Program Executive Office for Chemical Biological Defense (JPEO-CBD) under the Department of Defense (DoD). The DoD MITS-CRP solicited, competed and identified the laboratory equipment and supplies to pursue its mission. For seamless integration and continuity, the DHHS embraced the same methodology as DoD MITS-CRP. The adoption of MITS-CRP analysis capability by the DHHS program depends on the utilization of the same laboratory instruments - namely, Life Technologies' 7500 Fast DX Real-Time Polymerase Chain Reaction Instrument. There are no known authorized resellers of this product, and Life Technologies is the manufacturer. Life Technologies is the only responsible source to provide the necessary hardware and e maintenance to support the mission of the DHHS. These facilities across CONUS will be serviced by the logistical operations at the SSC, Perry Point. The justification is I/A/W FAR 6.302-1(b)(1) 'Unique Source'. Logic also exists for a justification residing in 6.302-1(a)(2) 'Follow On'. The clause at FAR 52.212-4, Contract Terms and Conditions - Commercial Items, applies to this acquisition. The clauses at FAR 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders - Commercial Items, applies to this acquisition.
