Attachment A - HVAC Equipment List - SECHQ1-14-Q-0234 Attachment 2 - Pricing Schedule - SECHQ1-14-Q-0234 Attachment J-5 Credit Release Attachment J-4 OF306 Attachment J-3 Contractor Data Form Attachment J-2- Contractor Personnel NDA SECTION J ATTACHMENTS - Non-Disclosure Forms and On-Boarding/Clearance Documents Attachment 1-Statement of Work (SOW)/Requirements, Provisions & Clauses - SECHQ1-14-Q-0234 This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. Written proposals are required (oral offers will not be accepted). Submission of proposals must be in accordance with FAR 52.212-1, Instructions to Offerors - Commercial Items. The Government will award a hybrid firm-fixed price and time & materials/labor hour contract resulting from this solicitation to the lowest priced technically acceptable proposal from a responsible offeror. Please include CAGE Code, DUNS, Tax Identification Number, FOB Point (FOB Destination is required), and Discount Terms in your response. (i) Contract line item numbers and items, quantities and units of measure are provided in Attachment 2, Pricing Schedule. The period of performance and place of delivery and acceptance are provided below. (ii) Solicitation number SECHQ1-14-Q-0234 is issued as a Request for Quotation (RFQ). (iii) Solicitation number SECHQ1-14-Q-0234 incorporated provisions and clauses are those in effect through Federal Acquisition Circular FAC 2005-76, effective 25 August 2014. (iv) This is an unrestricted acquisition (i.e. no set-aside). The NAICS code for this procurement is 238220 Plumbing, Heating, and Air-Conditioning Contractors, Size Standard $14.0 Million. (v) Quoters shall provide firm-fixed pricing for monthly HVAC/AC preventive maintenance service and fully-burdened Time & Materials/Labor Hours hourly rates and prices in support of repair and emergency repair services in support of the New York Regional Office in accordance with Attachment 1, Statement of Work. The format for pricing is provided in Attachment 2, Pricing Schedule. (vi) Description of requirements for the items to be acquired: The Securities and Exchange Commission (SEC) intends to award a non-personal services hybrid Firm-Fixed Price and Time & Materials/Labor Hour contract to provide HVAC/AC Inspection and Preventive Maintenance Services on a monthly basis and Repair/Emergency Repair Services, as needed, in support of the New York Regional Office. (vii) The anticipated contract's period of performance will be for one (1) base year effective November 1, 2014 through October 31, 2015 with four (4) option years. Place of Delivery is as follows, unless otherwise indicated at the time of contract: U.S. Securities and Exchange Commission, New York Regional Office, Brookfield Place, 200 Vesey Street, Suite 400, New York NY 10281-1021. Delivery is FOB Destination. The anticipated date of contract award is September 22, 2014. The Government reserves the right to award one contract or make no award. (viii) FAR 52.212-1, Instructions to Offerors-Commercial, applies to this acquisition. Quoters may obtain full text versions of these clauses electronically at http://farsite.hill.af.mil/. Parties responding to this solicitation who believe they can provide HVAC inspection and maintenance services may submit their quote in accordance with their standard commercial practices (e.g., on company letterhead, formal quote form, etc.) but must include the following information: a. The Solicitation Number SECHQ1-14-Q-0234; b. The time and date specified in the solicitation for receipt of quotes; c. Price and any discount terms in accordance with Attachment 2, Pricing Schedule Format. Note that price quote shall be separate from Vendor's technical approach & capabilities and past performance. d. "Remit to" address, if different than mailing address; e. A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the quoter shall complete electronically). Note: If your firm's completed electronic representations and certifications are available on System for Award Management (SAM), it is not necessary to provide a copy with your quote; f. A copy of System for Award Management (SAM) registration (see https://www.sam.gov/portal/public/SAM/) or a copy of System for Award Management application; g. Acknowledgment of Solicitation Amendments, if applicable; h. Narrative addressing capability to provide the HVAC services in accordance with the requirements herein and in the Attachment 1, SOW, and past performance information, including three (3) references (identifying the following items: a. Name of Agency/Organization; b. Contract number; c. Contract type; d. Total contract value; e. Description of contract work; f. Contracting officer (or similar representative), telephone #, and email address) for contracts performed within the past 2 years that are similar in size and scope to this requirement. i. A statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Quotes that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration; and j. Period for acceptance of quotes. The Quoter agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation. (ix) The provision at FAR 52.212-2, Evaluation - Commercial Items (Jan 1999), applies to this acquisition as follows: 52.212-2 Evaluation-Commercial Items (Jan 1999) (a) The Government will award a contract resulting from this solicitation to the lowest priced technically acceptable (LPTA) proposal from a responsible offeror. Each offer must meet the technical evaluation criteria listed below in order to be determined technically acceptable. 1. Technical Approach and Capabilities The degree to which the Quoter's proposed solution and capabilities will meet the Government's requirements as described in the Statement of Work (SOW) and the extent to which the Quoter's solution is feasible and Quoter possesses the capabilities to successfully perform the requirements especially with the type of SEC equipment listed and to include the ability to obtain required clearances and insurance and any service warranties. The Government will also evaluate the extent to which the risks associated with the inspection and maintenance program are identified and mitigated against in the Quoter's proposed solution. 2. Past Performance The Government will evaluate the relevance, breadth and quality of the Quoter's recent past performance on similar type of work. The Government will determine the quality of the Quoter's past performance based on the past performance references provided in the Quoter's submission and/or other information obtained from references provided by the Quoter, as well as other relevant past performance within the most recent two (2) years, information obtained from other sources known to the Government. A Quoter without a record of past performance or for whom information on relevant past performance is not available will be evaluated as neutral. (b) A written notice of award or acceptance of a quote, mailed or otherwise furnished to the successful quoter within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. (x) FAR 52.212-4, Contract Terms and Conditions-Commercial Items (May 2014), applies to this acquisition. (xi) FAR 52.212-5, Contract Terms and Conditions Required To Implement Statutes or Executive Orders-Commercial Items (Jul 2014), applies to this acquisition. (xii) Contract financing arrangements are not applicable. Commercial warranty applicable. The following FAR clauses apply to this procurement: 52.216-1 Type of Contract (Apr 1984). The Government contemplates award of a hybrid Firm-Fixed Price and Time & Materials/Labor Hour contract. Additional FAR Clauses are listed in Attachment 1, Statement of Work (SOW). WAGE DETERMINATION (WD): WD #2005-2375 (Rev. #14), dated 07/26/2014 will be used for this request. The wage determination can be viewed at www.wdol.gov. (xiii) Defense Priority and Allocations System (DPAS) is not applicable. (xiv) The due date and time for Quotes is September 16, 2014 at 2:00 pm local time (Eastern). Late quotes may not be accepted. Quotes shall be delivered via email to Tammy Oliver, olivert@sec.gov and D'Jaris Gladden, gladdend@sec.gov. (xv) All questions concerning this RFQ shall be submitted in writing to Tammy Oliver at olivert@sec.gov and D'Jaris Gladden at gladdend@sec.gov, no later than 2:00 p.m. Eastern Time (Eastern), September 12, 2014. Questions will not be answered orally. E-mail submission of questions is required. Questions submitted after the specified time/date may not be addressed.
