Failure to comply may result in disqualification. This will be a Firm Fixed Price (FFP) order. This acquisition will utilize Lowest Price Technically Acceptable (LPTA) procedures. Technical tradeoff will not be made and no additional credit will be given for exceeding acceptability. Award will be made to the acceptable Offeror with the lowest evaluated price, which is deemed responsible in accordance with the Federal Acquisition Regulation and whose Quote conforms to the solicitation requirements. The solicitation requirements include all stated terms, conditions, representation and certifications, and other information required by this solicitation. The Government reserves the right to award without discussions. Therefore, each initial offer should contain the Offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if determined necessary by the Contracting Officer. The Government may reject any Quote that is evaluated to be unrealistic in terms of requirements, contract terms and conditions, or an unrealistically high or low price when compared to Government estimates, such that the Quote is deemed to reflect an inherent lack of competence or failure to comprehend the complexity and risk of the requirement. Technical acceptability will be evaluated on all Quotes. Only those Quotes determined to be technically acceptable, either initially or as a result of discussions, will be considered for award. Then, price will be evaluated and the Quotes will be listed from lowest to highest price based on the total evaluated price and technical acceptability. Award will be made to the lowest evaluated priced quote meeting the acceptability standards. TECHNICAL EVALUATION STANDARD: The contractor shall address the following factors: •1. Factor 1 - Technical Capability - Offeror shall clearly demonstrate its approach to technical ability to meet the requirements of CLIN/Line Items/Statement of Deliverables, based on meeting the requirements of the Request for Quote, quantity, quality and timeliness of delivery. •2. Factor 2 - Price - The Offeror shall complete CLIN pricing on page one (1) of this solicitation. In addition to the completed CLIN pricing on page one (1), the Offeror shall provide sufficient price information to allow the Contracting Officer to determine the completeness and reasonableness of the Offerors prices. DISCUSSIONS: If during the evaluation period it is determined to be in the best interest of the Government to hold discussions, Offeror responses to clarifications/discussion notices will be considered in making the source selection decision. AWARD DECISION: The award decisions will be made as follows: Step One - Determine Technical Acceptability. The technical evaluation, Factor 1, stated above, will assess the Offerors capability to satisfy the Government's requirement. The Government will evaluate all technical capability Quotes received by the required date/time. The Technical Capability factor will receive a rating of acceptable or unacceptable. If any factor is rated unacceptable, the entire Quote is rendered technically unacceptable, and the Quote will be removed from the competitive range. Only Quotes deemed technically acceptable (either initially or as the result of discussions) will be considered for award. The ratings are defined in the following table. Rating Description Acceptable Quote clearly meets the minimum requirements of the solicitation. Only those Quotes determined acceptable, either initially or as a result of discussion will be considered for award. Unacceptable Quote does not clearly meet the minimum requirements of the solicitation. Quotes with an unacceptable rating will not be considered for award. •(1) Step Two - Evaluate Price. The Offeror's Price Quote will be evaluated, for award purposes, based upon the total price proposed as annotated under Factor 2 - Price. •(2) Step Three - Award Decision. Award will be made the lowest priced, technically acceptable Offeror, subject to a positive responsibility determination in accordance with FAR Part 9 and conformance of the Offeror's Quote to the terms and conditions of the solicitation. Statement of Deliverables Office of the Staff Judge Advocate (OSJA) Total Eclipse Professional Voice Reporter Version (Vox) Bundle System C-1. Background: In 2007, the Marine Corps made a transition from using stenographer court reporters to using Voice Recognition trained court reporters to produce a transcribed records of trial, using the Dragon Natural Speaking software. C-1.1. The Office of the Staff Judge Advocate (OSJA), Marine Corps Base, Quantico, VA has a requirement to purchase the Total Eclipse Professional Voice Reporter Version (VoX) Bundle System. Eclipse VoX is a newer version of the software that is currently being used by the stenographers and will be able to seamlessly create or merge records of trial as they are recorded by both the stenographers and voice recognition. Other types of computer assisted transcription software are not compatible with stenography software and would cause significant delays in producing a court transcript by virtue of the time needed to perform formatting and integration operations. C-2. Scope This requirement is in direct support of the court reporter section of the OSJA, Marine Corps Base Quantico, VA. They are in need of 2 laptops equipped with dual channel court-reporting microphones and compatible sound device (card) along with and the Total Eclipse Professional Voice Reporter Version (Vox) Bundle System software. Current USMC training for court reporters dictates the use of voice recognition software in the court-room to produce transcripts of courts-martial and other administrative proceedings (e.g. officer non-judicial punishment and administrative separation hearings). Stenography is no longer the method used to produce a transcription and is not an option. The current hardware and software provided through NMCI is deficient, and prone to technical malfunctions due to the remote software update processes NMCI uses. It is common for licensing and technical issues to deprive court reporters of their voice recognition software on a bi-weekly basis, and restoring the software comes at a loss of the customized vocabulary dictionaries that are essential to the efficient function of the software. As a result, court reporters routinely resort to "free typing": they will record the proceedings using a single channel mask into a digital recorder, then they will listen to their own voice in their office and type what they are essentially dictating to themselves. This process is actually faster than using the NMCI provided software, but remains slower than the ability sought: to be able to use a computer in court to do voice recognition, and thus be able to come out of court with the 80% solution that Dragon combined with Vox provides. In addition to being outside the norms established by HQMC for the use of voice recognition as the method to deliver transcripts (when the NMCI software fails), the current system is so inefficient that court reporters in fact perform their duties faster when free typing. At the same time, the proven efficiency of the hardware and software combination of the eVerbatim solution, as currently used by the court reporter section in Camp Pendleton and Okinawa, will allow the court reporters to deliver an accurate transcript faster. This will in turn allow for a faster turnaround throughout the military justice system, resulting in better service to the Commanders that rely on Quantico's court reporters. C-3. Tasks C-3.1. Hardware maintenance. It is requested that the laptops come with a 3 year warranty. C-3.2.1. The Contractor shall provide telephonic support during regular business hours. C-3.2 Software maintenance.
