Description
The purpose of this amendment is to incorporate the Health Insurance Portability and Accountability Act (HIPAA) Business Associate Agreement (BAA). This is added to the solicitation for informational purposes only. Signature at the time of contract award shall signify acceptance of the agreement. Contractors have requested the names and numbers of the current, incumbent contract employees. However, this information cannot be released. The specific contact information for the current Nurse Practitioners/Certified Nurse Midwives will not be released until after contract award. This would be a violation of the Privacy Act as their personal information would be distributed to an unspecified number of contractors and would not be encrypted. This information will be securely emailed to the awardee only after the award has been made. The contract employees will not be given the option to contact interested parties prior to award. There is a high number of responses to the Solicitation and the Request for Information. If the decision is left up to the employees, contractors that they do not contact may feel that they have not been given fair access to the same resources. Furthermore, all contractors are asked to cease and desist any attempts to contact these employees. Attempting to contact them during work hours is extremely disruptive to the clinic's operations and will not be tolerated. Not all interested parties have base access and permitting those who do to meet or speak with current employees would create an unfair competitive advantage. Contract employees have been briefed on their rights as provided by FAR Clause 52.222-17, included on page 9 of the solicitation, and that by giving one company an unfair advantage, it opens up the Government to a very lengthy protest, during which they will not be able to work and will not be paid. At this time, no contractors have contacted the current contract employees. The purpose of this message is to create a clear instruction on the subject.
