Description

DEPARTMENT OF VETERANS AFFAIRS Sole Source Justification and Approval For Other Than Full and Open Competition VA251-14-Q-0469 1. Contracting Activity: Department of Veterans Affairs, VISN 11, (506) VA Ann Arbor Health System, Ann Arbor, Michigan. The Medicine Service requires a service that requires Justification for Other Than Full and Open Competition for "Full Service" service plan for the leased Olympus Scopes. 2. Nature and/or Description of the Action Being Processed: The VA Ann Arbor Healthcare System requests the approval of a Service Contract with Olympus to support our Endoscopy Section. 3. Description of Supplies/Services Required to Meet the Agency's Needs: Service for 47 GI Video Endoscopes, 6 Video Bronchoscopes, l 0 EUS Scopes, and 31 Electronics. Value: $201,680 per year. Base Plus three option year periods to match up with scopes lease. Aggregate value is $806,720.00. Period of Performance : Base Year September 2014-September 2015, Option Year ? September 2015-September 2016, Option Year II-September 2016-September 2017, Option Year III-September 2017-September 2018. 4. Statutory Authority Permitting Other than Full and Open Competition: 41 USC ?253(g), as implemented by FAR 6.302-1: ( X ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5. Demonstration that the Contractor' s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): Prior to FY 2014 Service Contract our Endoscopy Unit utilized Olympus scopes. Without the service agreement we would be unable to have Olympus fully repair our scopes within 24-48 hours, we did not have technical support, and had no onsite back up for our endoscopes which is essential for the care of our Veterans. a. Only One Responsible Source: Olympus is the only vendor authorized to procure parts, and repairs for their scopes. They do not sell their specific part to anyone and if other parts are used the VA then has liability with any recourse that could happen during a. 6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: In the event that Medicine Service at the VAAAHS determines that there are other sources existing that can meet the particular characteristics of this product, that vendor(s) will be contacted to determine feasibility of obtaining their product. 7. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: In FY 2014 we utilized a service contract with Olympus for the fair and reasonable price of $237,261. Additionally last year a review of the price paid for an Olympus Service Agreement approximately 2 years ago by another VISN 11 facility/Detroit VAMC indicates a similar percentage bases (service agreement to lease) cost to that being quoted for this procurement. Because of the Base Plus three option years Olympus has given a further discount and the cost is at $201,680 per year. 8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: The market has been searched via internet. As described in Section VI above, market research, in accordance with FAR Part 10, was conducted by synopsis of the proposed acquisition, advising industry of the pending acquisition and soliciting inquiries from interested parties and systems have been reviewed to determine these are the best to fit our need. 9. Any Other Facts Supporting the Use of Other than Full and Open Competition: None particular to this solicitation/requirement. 10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: None. 11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: None 12. Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
