- This contract action was accomplished using other than competitive procedures because a statute exists that expressly authorizes or requires that the acquisition be made from a specific source or through another agency (FAR 6.302-5); specifically, Sole source awards under the 8(a) Program. See posted J&A for further information. 1. In accordance with FAR 19.811-1 Sole Source award IAW 10 U.S.C. 2304(c) (5), MICC Riley is seeking an award for Solicitation W911RX-14-R-RNGE as other than full and open competition. 2. Description of Action/Services or Supplies: QTR Range: (2) loudspeakers, (1) lightning protection rod, (2) Red and (2) white LED area lights mounted on 6- 35' utility poles with 25' exposed 10' bury, that are to be install on the QTR range. The (6) poles would need to be installed so the security lighting can cover the firing line doing night operations, after firing is completed. All wiring shall be buried in conduit and lighting protection standards will be followed. The pole locations will be marked by the range personnel. The range personnel will provide access to the tower and power supply for installation. Outline of principal features does not limit the responsibility of the Contractor to furnish all plant, labor, equipment, materials, and transportation and perform all work required by the plans and or the specifications. KDR Range: The project will include all material and labor to install (16) one-way loudspeakers at the 1000-meter target back wall and connected into the existing system. A Market Survey/Sources Sought was complete in July 2104 to determine industries capabilities. Market Survey was completed to identify sources as well as an estimated cost for the requirement. Please see Market Research for details. The results concluded that there are at least two (2) 8a entities that could perform the task within the specified time and price range as noted on the government's IGCE. Section 8(a) of the Small Business Act (15 U.S.C. 637(a)) established a program that authorizes the Small Business Administration (SBA) to enter into all types of contracts with other agencies and award subcontracts for performing those contracts to firms eligible for program participation. The SBA's subcontractors are referred to as quote mark 8(a) contractors. quote mark (b) Contracts may be awarded to the SBA for performance by eligible 8(a) firms on either a sole source or competitive basis. 3. Proposed Source: The SBA have conducted an analysis of this requirement in accordance with the provisions setforth in Title 13 of the Code of Federal Regulations (13 C.F.R. 124.504(c)), Adverse Impact. The results of the analysis revealed that no small business was performing the requirement at the time this requirement was offered to the 8(a) BD Program, as this is a new requirement. On August 15th, 2014, the SBA provided an acceptance letter. The assigned SBA Requirement Number is 0766/14/406557/01. Pursuant to the executed Partnership Agreement, the US Department of the Army is authorized to negotiate directly with the 8(a) BD Participant. SBA reserves the right to be present at an Agency's negotiations with the 8(a) BD Participant. Brunow Contracting provided company capabilities to include, past performance, specialty,profession certifications, and primary clients. 4. Rationale for Sole Source Award: Brunow Contracting is an Economically Disadvantaged Woman Owned HUBZONE 8(a) Certified Small business. The result of the Market Survey in July 2014 determined that Brunow is competitive, reasonable, and has the ability to complete the project. It is the best interest of the government to award as a sole source to Brunow Contracting in order to meet timelines. IAW 19.800(e), for acquisitions above the simplified acquisition threshold, the contracting officer shall consider 8(a) set-asides or sole source awards before considering small business set-asides.
