- National Transportation Safety Board Justification for Other Than Full and Open Competition "Purchase of Transas USA NS4000 Electronic Charting Software (ECDIS)" 1. Program Office / Procurement Request Office of Marine Safety (MS), Major Investigations (MS-10) Estimated Value: $6,700.00 2. Nature of Action The purpose of this Justification for other than Full and Open Competition (JOFOC) is to provide documentation that explains why this specific requirement is intended to be awarded without competition to Transas USA for Transas NS4000: (1) AIS Transasponder 3; (2) 1st additional station; (3) additional station; (4) TX97 US Chart Folios; (5) TX 97 Professional Chart Maintenance (Annual); (6) USB Dongle. 3. Description of Requirement The NTSB Office of Marine Safety currently is in possession of Transas USA electronic charting (ECDIS) NS3000 and NS4000 software licenses. The NS3000 electronic charting which runs on Windows XP is being phased out. Our current license of Transas NS4000 and our 19 TX97 US Chart Folios which comprise hundreds of electronic charts only require updating to Windows 7. Marine Safety in the last decade chose Transas USA for electronic charting due to their holding a position of over 45% of the marine vessel marketplace. On those vessels which are involved in a marine casualty which carry Transas NS4000 ECDIS our investigators can download three months of charting voyage data for analysis. On those vessels not equipped with Transas charting our investigators can gather the vessel's AIS or GPS data and play back that information of our Transas NS4000 charting software. To purchase a different suite of electronic charting software with three stations and a complete North American chart folio would exceed the cost of updating our current NS4000 suite. • NS4000 - this is the operating software which uses the TX97 charts in vector format meeting the IMO shipboard requirements. • AIS Transponder 3 - this software displays both position and vessel identifying information on the electronic charts. • Additional Stations (licenses) - the Transas NS4000 and TX97 charts can be loaded on as many laptops as we require in MS, however the software will only play when a Transas USB dongle is inserted. One dongle is to be assigned to each investigative team. • TX97 Chart Folios (19) - comprising hundreds of charts which need to be reissued for Windows 7. • All electronic charts on vessels and in MS should be updated quarterly in an annual chart maintenance agreement. 4. Statutory Authority This justification is made pursuant to the requirements of 41 U.S.C. 253 (c)(1) and FAR 6.302-1, "Only one responsible source and no other supplies or services will satisfy agency requirements." Full and open competition need not be solicited when the supplies or services required by the NTSB are available from only one responsible source, and no other supplies or services will satisfy the NTSB's requirement. 5. Unique Qualifications / Circumstances of Requirement Based on Transas USA, Inc's unique technical qualifications as the software developer/vendor of our existing Transas NS4000 software, competition is not being solicited. 6. Efforts to Determine Only One Source The NTSB Office of Marine Safety investigators already use our existing NS4000 software and many investigators have recently completed training in ECDIS using the Transas USA software suite. 7. Contracting Officer's Determination I have reviewed this JOFOC, and determined that based on the information provided, that it is accurate and complete to the best of my knowledge and belief. The award will be made only if determined fair and reasonable and in the best interest of the Government. 8. Market Research Market research has been conducted at technical conferences, by site visits, through consultation with software vendor technical support staff and through the internet. 9. Other Pertinent Information MS-10 investigators have used NS4000 software in the past. The performance of the software has met or exceeded expectations. Technical support for the software has been responsive and high quality. 10. List of Interested Sources The NTSB is aware of other companies that could provide this unique service, however Transas is the only source that can update the current software that the NTSB uses. Transas has a significant market share in the marine industry and their charting software exceeds IMO specifications. 11. Efforts to Remove Barriers to Competition The NTSB will continue to monitor the market for responsible sources of this electronic charting software requirement. When it is determined that other than the Transas software will be used to satisfy this requirement, the available sources, if any, will be asked to provide requirements for competition. 12. Contracting Officer's Certification The Contracting Officer certifies that this justification is current, complete and accurate.
