- Amendment No. Seven to A14PS00795: 1. The SF1442 is amended, Items 11, 13. 2. Attached are the Government's Responses to questions received for the Solicitation Package posted on FedBizOps. See Attachment A. 3. To include revision to Section F: F.1 FAR 52.211-10. 52.211-10 Commencement, Prosecution, and Completion of Work. As prescribed in 11.404(b), insert the following clause in solicitations and contracts when a fixed-price construction contract is contemplated. The clause may be changed to accommodate the issuance of orders under indefinite-delivery contracts for construction. COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK (APR 1984) The Contractor shall be required to (a) commence work under this contract within ten (10) calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than 605 calendar days.* The time stated for completion shall include final cleanup of the premises. (End of clause) F.2 52.211-12 Liquidated Damages Construction. As prescribed in 11.503(b), insert the following clause in solicitations and contracts: Liquidated Damages Construction (Sept 2000) (a) If the Contractor fails to complete the work within the time specified in the contract, the Contractor shall pay liquidated damages to the Government in the amount of $2,700.00 for each calendar day of delay until the work is completed or accepted. (b) If the Government terminates the Contractors right to proceed, liquidated damages will continue to accrue until the work is completed. These liquidated damages are in addition to excess costs of repurchase under the Termination clause. (End of clause) 4. To include FAR 52.233-4. 52.233-4 Applicable Law for Breach of Contract Claim. As prescribed in 33.215(b), insert the following clause: Applicable Law for Breach of Contract Claim (Oct 2004) United States law will apply to resolve any claim of breach of this contract. (End of clause) 5. Change in numbering in Section 152.05. See Attachment B. 6. To incorporate Clauses to Buy Indian Act. See Attachment C. 7. To include Forms in Section J.2 Forms: (d)Stand Form 24, Bid Bond (e)Standard Form LLL, Disclosure of Lobbying Activities (f)Standard Form 1413, Statement of Acknowledgement See Attachment D. 8. ALL OTHER TERMS AND CONDITIONS REMAINS THE SAME.
