- 52.212-1 Instructions to Offerors—Commercial Items. 52.212-3 Offeror Representations and Certifications—Commercial Items. SF-1449 This procurement is conducted pursuant to the authority of Federal Acquisition Regulation (FAR) Part 13, Simplified Acquisition Procedures; as supplemented with additional information included in this notice. Personal Services Contracts (Public Law 103-332), Department of the Interior and Related Agencies Appropriation Act, Title II, September 30, 1994, 108 Stat. 2530 as implemented by 25 U.S.C. 1638c). The Billings Area Indian Health Service (IHS) intends to award a fixed-price purchase order in response to Request for Quotation (RFQ) 10-12-021-JH to acquire One (1) Family Nurse Practitioner / PA Specialist ENT for the Blackfeet Service Unit, PHS Indian Hospital, Browning, MT and Heart Butte Clinic, Heart Butte, MT. The solicitation is restricted to 100% Small Business concerns. The Solicitation clauses and provisions are those in effect through Federal Acquisition Circular 2005-75. The associated North American Industry Classification System code is 621399 and the small business size standard is $7.0 million. Potential offerors are asked to submit an offer. If the Government exercises the options pursuant to Federal Acquisition Regulation (FAR) 52.217-9, Option to Extend the Term of the Contract (MAR 2000), the period of performance shall be extended in accordance with the following schedule: Year Option Period Option Year One (1) October 1, 2014, through September 30, 2015 B.3 PURPOSE OF THE CONTRACT The purpose of this acquisition is to contract for One (1) Family Nurse Practitioner / PA Specialist ENT Services at the Blackfeet Community Hospital, Browning, MT and Heart Butte Clinic, Heart Butte MT. B.4 WORK SCHEDULE Monday thru Friday from 8:00 A.M. 5:00 P.M. B.5 STATEMENT OF WORK (a) The contractor shall coordinate monthly Ear, Nose and Throat (ENT) Clinics at the Blackfeet Service Unit, PHS Indian Health Centers, Browning and Heart Butte, Montana. This involves working closely with the contract Otolaryngologists, Audiologist, and all appropriate medical staff at each Service Unit. (b) The contractor shall perform direct clinical services, which include but are not limited to: (1) Report in-depth medical histories by interviewing patients. (2) Perform and interpret complete examinations of the ears, nose and throat using otoscopy, otomicroscopy, audiometric test result, nasal speculums, nasalpharyngealscope, tongue depressors, and laryngeal mirrors, and report the findings of the evaluation. (3) Prescribe medical treatment of the diagnosis resulting from the ear, nose and throat evaluation. (4) Councils patients regarding recommendations and results of the evaluation. (5) Serves as a primary ENT consultant to the Physicians, Audiologist, and other appropriate staff at the service units. (6) Schedule appointments and perform referrals to the contract Otolaryngologists for those who are at risk for hearing loss and chronic ear, nose, and throat problems. (7) Assist contract Otolaryngologists with ENT Clinics, referral to other specialty clinics, and other subspecialties within the Otolaryngologists field. (c) The contractor shall perform in-service training to the Service Unit Physicians, and other medical personnel on pathology and treatment of ears, nose, and throat diseases as needed. (d) The contractor shall be available to teach nursing, pharmacy, physician assistant, and medical students in ENT Clinics during clinic rotations, as needed. (e) The contractor shall identify alternate resources for funding surgical care when services cannot be provided at the Blackfeet Indian Hospital and Heart Butte Clinic. (f) The contractor shall maintain a surgery log of all patients in need of surgery, have had surgery and a follow up treatment. (g) The contractor shall oversee the care and maintenance of all otologic equipment including appropriate safety checks. (h) The contractor shall determine equipment and supply needs for the ENT clinics at the Blackfeet Service Unit and the Heart Butte Clinic. (i) The contractor will be subjected to the same periodic Quality Assurance/Peer Review process at the Blackfeet Service Unit that is established in the Policy and Procedure for all health care providers either by an IHS Physician Supervisor or IHS contract Otolaryngologists. B.6 ADMINISTRATIVE OVERSIGHT: The supervisor defines the continuing assignment with procedures and methods to be used, priorities and deadlines. The supervisor helps the contractor with difficult or controversial aspects of the job requirement. The contractor uses initiatives in planning and carrying out the day-to-day workload. Final work is reviewed, as needed, for conformance to policies and regulations, timelessness and satisfaction on the supervisor. The following IHS employees will assist the Contracting Officer's Representative (COR) in monitoring the contract and will be designated as an alternate in absent of the supervisor. The responsibility of the Indian Health Service is to supervise, monitor and ensure that the contractor is adequately performing the request services, duties and responsibilities in accordance with the Statement of work and performance standards for which they were hired to accomplish. B.7 KNOWLEDGE REQUIRED BY THE POSITION: (a) The work consist of a broad general practice of medicine, involving diagnosis and treatment of outpatients with an extremely wide variety of physical and emotional problems and includes the broad functions of medicine, education, prevention, cure and rehabilitation, in addition to the practice within the specialty of ENT. (b) Contractor will be required to possess a thoroughly knowledge of medicinal therapy and Pharmacological practices and a comprehensive understanding of otorhinlaryngological diseases. (c) A DEA license with current certifications for BLS is also required. B.8 PHYSICAL DEMANDS: Work is essentially sedentary with some walking, standing, carrying of books, files, etc. Travel by automobile from Blackfeet Service Unit, Browning, MT to Heart Butte, MT is required to make site visits in coordination with ENT Physician Services. B.9 WORK ENVIRONMENT: The work environment involves every day risk associated with offices,hospital and clinic environments and settings and automobile travel, including but not limited to, exposure cathode ray tube computor montitors, potential for repetitive motionsyndrone from keyboard use, hazardous weather, long periods of sitting and animals the road. Visits to the hospital and clinic setting may include exposure to communical disease. Where required, necessary personal protective equipment will be supplied. Situations arise, such as interactions with angry individuals, which may invoke stress. Work may require irregular or long work environments. B.10 SUPERVISION: The Supervisor will monitor workload to determine that the major duties as listed in the statement of work are addressed. SUPERVISOR: Joe E. Gray, MD, Clinical Director ALTERNATE: Thomas Herr, MD, CMO B.11 GUIDELINES: The contractor uses legislative (Federal, State and Tribal), agency policy statements, accreditation body standards, national professional standards that may be either specific or non-specific. These guidelines require continuous interpretation, adaptation to rural, trans-culter setting, and application to conform to changes in the health care field and the needs of the Indian Health Service. The contractor responsible for interpreting the legislation and policy and for developing specific standards, policies and guidelines for the Billings Area Indian Health Service. B.12 COMPLEXITY: Work requires substantial depth of analysis to broad range of health care functions (i.e., administration, education, research aand clinical practice). The contractor identifies issues and analyzes the interrelationships between the broad functions of health care and ENT, and predicts trends that will impact Indian Health Service. Work invovles major area of uncertainty such a continuing changes in health care standards of practice, ENT program and role evaluation, new technological developments, increasingly coomplex legislation and regulation requirements, staffing utilization options,and budget constraints. The contractor solves problems that have potential political and culture effects and that are interrelated with activities of other sectors of the health care delivery system. The contractor must remain continually up-to-date on changing legislation, technology and the role of the ENT Physicain Assistant in order to impliment solution to problems or to meet established standards. Complexity of the contract requirements is enhanced by the numbers of varieties health care disciplines, federal, state, local, and tribal representatives interfaced; diversity of the population served; remotness of the facilities and programs; and the variety of number of health care problems facing the serviced population. B.13 GOVERNMENT FURNISHED PROPERTY : The following will be provided by the Billings Area Office of Healthcare Programs: Desk/Work Area, Specialized audiology equipment and supplies needed to perform and deliver audiology and hearing aid services at each Service Unit. The Department will provide orientation to the Contractor as to their specific duties and responsibilities. The Department is responsible for getting the Contractor access and clearances to all pertinent computer services necessary to carry out his/her duties. If necessary, authority to use a General Services Administration (GSA) vehicle, for Official purpose only. The Contractor will be required to provide evidence of motor vehicle liability insurance covering bodily injury and property damage to protect the Contractor and the Government against third party claims arising from the operation off all GSA vehicle used In connection with the contract. The Contractor shall provide coverage of at least $200,000 per Person and $500,000 per occurrence for bodily injury and $20,000 per occurrence for property damage. The Contractor shall comply with the requirements of FAR subpart 51.2, 41 CFR101-39, CFR 102-34, and the operator's packet furnished with each vehicle. B.14 COMPUTER SECURITY: Pursuant to the Federal Information Security Management Act of 2002 (FISMA), the contractor will be required to complete a course in Computer Security Awareness Training (CSAT). This training must be completed annually by all employees including all contractors, volunteers, students, and summer externs. The Contractor will be required to comply with the Federal Information Processing Standards Publication (FIPS PUB) Number 201, "Personal Identity Verification of Federal Employees and Contractors" and the associated Office of Management and Budget (OMB) implementation guidance for personal identity verification for all affected contractor and subcontractor personnel. Access/clearance to all pertinent computer systems, including completing a Business Partner Interconnection Security Agreement (BPISA), should be coordinated with the Site Manager. B.15 CONTRACTING OFFICER AUTHORITY: Authority to negotiate changes in terms, conditions, or amounts cited in this contract is reserved to the Contracting Officer. B.16 CONTRACTING OFFICER'S REPRESENTATIVE (COR): The COTR shall be responsible for: (1) Monitoring the Contractors technical progress, including surveillance and assessment of performance and recommending technical changes; (2) Interpreting the Statement of Work; (3) Technical evaluation as required; (4) Technical inspections and acceptance; and (5) Assisting the Contractor in the resolution of technical problems encountered during performance of this contract. Box 13509, Albuquerque, N.M. 87192-3509 B.18 REPORTING REQUIREMENTS: The Contractor shall provide the Contracting Officer with evidence that payment of employment taxes has been made 15 days after each quarter. B.19 PRO-CHILDREN ACT OF 1994 The Contractor certifies that it will comply with the provisions of Public Law 103-227, Pro-Children Act of 1994, which imposes restrictions on smoking where federally funded children's services are provided. B.20 CHILD CARE NATIONAL AGENCY CHECK AND INVESTIGATION (CNACI) A CNACI must be completed for all Indian Health Service (IHS) contract personnel within the Billings Area. Public Law (P.L.) 101-630, Indian Child Protection and Family Violence Prevention Act, requires the IHS to conduct a criminal history background investigation on all contractors performing services in IHS facilities. The character and background investigations and Fingerprints must be taken as part of the pre-employment process and must be before the contractor is allowed to work. Will be conducted by the Administrative Officer, Timothy Davis at the Blackfeet Service Unit. B.21 SPECIAL CONTRACT REQUIREMENTS: Contractors cannot serve as expert witnesses in any suite against the Federal Government. Many of the IHS patients receiving services may only speak their native language and/or reside on a Native American Reservation, therefore, the Contractor must demonstrate sensitivity to cross-cultural and language differences. The Privacy Act of 1974 mandates that the Contractor maintain complete confidentiality of all administrative, medical and personnel records, and all other pertinent information that comes to his/her attention or knowledge. The Privacy Act carries both civil and criminal penalties for unlawful disclosure of records. Violation of such confidentiality shall be cause for adverse action. All IHS regulations and policies to these Acts shall be enforced. The Contractor shall comply with IHS facility infection control and safety procedures, practices and standards. Federal Tort Claims Act coverage for medical related claims is extended to the individual providing. However, the services must have been performed within the scope of the personal services contract. The following factors shall be used to evaluate offers: 1. Medical Professional Licensure= 35 POINTS. Potential contractors must submit a copy of State license with the price quote. 2. Resume = 30 POINTS. Potential contractors must submit resume with price quote. 3. Past Performance Information = 35 Points. The offeror must demonstrate its Company's record of successful performance in past contracts and/or jobs, Government and/or commercial. Each offeror will be evaluated on its performance under existing and prior contracts/jobs. In evaluating past performance the Government may also use information from its own files, information provided by the offeror, or from any other sources it deems appropriate. Offerors will be given the opportunity to clarify information concerning the relevancy of an offeror's past performance information, and any adverse past performance information to which the offeror has not previously had an opportunity to respond. Offerors shall provide, at a minimum, three (3) references for their most recently performed contracts in which similar or the same services were performed by the offeror preferably within the last two (2) years from the date of proposal submission. Upon request, the Contracting Officer will provide full text copies of the FAR and HHSAR provision and clauses. The provision and clauses may also be accessed electronically at http://www.arnet.gov and http://www.hhs.gov/oamp/policies/hhsar.doc. In addition, the Contractor shall submit a complete copy of FAR 52.212-3 with its offer. Contractors intending to conduct business with the Federal Government must register with The System for Award Management (SAM) database prior to award. ACCEPTANCE PERIOD: Your quote must stipulate that it is predicated upon all the terms and conditions of this RFQ. In addition, it must contain a statement to the effect that it is firm for a period of at least 60 days from the date of receipt by the Government. B.25 52.204-3 TAXPAYER IDENTIFICATION (OCT 1998) (a) Definitions. "Common parent," as used in this provision, means that corporate entity that owns or controls an affiliated group of corporations that files its Federal income tax returns on a consolidated basis, and of which the offeror is a member. "Taxpayer Identification Number (TIN)," as used in this provision, means the number required by the Internal Revenue Service (IRS) to be used by the offeror in reporting income tax and other returns. The TIN may be either a Social Security Number or an Employer Identification Number.(b) All offerors must submit the information required in paragraphs (d) through (f) of this provision to comply with debt collection requirements of 31 U.S.C. 7701(c) and 3325(d), reporting requirements of 26 U.S.C. 6041, 6041A, and 6050M, and implementing regulations issued by the IRS. "Facsimile proposal," as used in this provision, means a proposal, revision or modification of a proposal, or withdrawal of a proposal that is transmitted to and received by the Government via facsimile machine. (2) "Service-disabled veteran" means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16). "Small business concern" means a concern, including its affiliates that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR Part 121 and the size standard in paragraph (a) of this provision. "Veteran-owned small business concern" means a small business concern- (1) Not less than 51 percent of which is owned by one or more veterans (as defined at 38 U.S.C. 101(2)) or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more veterans; and (2) The management and daily business operations of which are controlled by one or more veterans. "Women-owned small business concern" means a small business concern- (1) That is at least 51 percent owned by one or more women; or, in the case of any publicly owned business, at least 51 percent of the stock of which is owned by one or more women; and (2) Whose management and daily business operations are controlled by one or more women. (d) Notice. (1) If this solicitation is for supplies and has been set aside, in whole or in part, for small business concerns, then the clause in this solicitation providing notice of the set-aside contains restrictions on the source of the end items to be furnished. (2) Under 15 U.S.C. 645(d), any person who misrepresents a firm's status as a small, HUBZone small, small disadvantaged, or women-owned small business concern in order to obtain a contract to be awarded under the preference programs established pursuant to section 8(a), 8(d), 9, or 15 of the Small Business Act or any other provision of Federal law that specifically references section 8(d) for a definition of program eligibility, shall- (i) Be punished by imposition of fine, imprisonment, or both; (ii) Be subject to administrative remedies, including suspension and debarment; and (iii) Be ineligible for participation in programs conducted under the authority of the Act. (End of provision) B.28 52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000) (a) The Government may extend the term of this contract by written notice to the Contractor within __45___ days provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least _45____ days before the contract expires. The preliminary notice does not commit the Government to an extension. (b) If the Government exercises this option, the extended contract shall be considered to include this option clause.
