- SOW This is a notice of the Government's intent to solicit and a sole source award (base with one option year) to bioMérieux, Inc. ("BioMerieux"), 100 Rodolphe St, Durham NC 7712-9402 for Most Probable Number (MPN) Cards. BioMerieux is the only known source disposable test cards that are also proprietary to the developer. The Tempo® system has been validated for use in the three Technical Service Laboratories (TSLs) according to the ISO17025 accreditation standards of the labs, and is published as an official method in the Microbiological Lab Guidebook. No other test system is validated or can be used. The FSIS TSLs perform regulatory testing of meat, poultry and egg products for the presence of food borne pathogens and sanitary indicator organisms. Enumeration of sanitary indicator organisms requires the use of MPN test cards as part of the official regulatory method. To meet these test requirements, the TSLs need MPN test cards compatible with the automatic platform validated for use as part of FSIS regulatory methodology. The contractor shall supply the TSLs with the following test cards: • Enterobacteriaceae (EB) • Coliform (CC) • Yeast/Mold (Y/M) • Aerobic Count (AC) • E. coli (EC) • Lactic Acid Bacteria (LAB) • Staphylococcus aureus (STA) • TEMPO Quality Control Kit There is no other product on the market that can be utilized with the system that is composed of hardware and software proprietary to the developer, BioMerieux. The supplying vendor is the sole source distributor for this equipment and there is no other vendor or manufacturer who can provide comparable equipment. This procurement will be conducted under the authority of FAR 6.302-1, only one responsible source and no other supplies or services will satisfy agency requirements. Authority: 41 U.S.C. 253(c)(1). The items will be shipped to our three Eastern Labs located in Athens GA, Saint Louis MO, and Alameda CA. It is anticipated that this procurement will be conducted as a Commercial Item acquisition under FAR Part 12. This is not a request for quotations or an announcement of a forthcoming solicitation. Request for copies of this solicitation will not be honored or acknowledged. The Government does not intend to pay for information received. All interested parties must respond within ten (10) business days from the date of this notice. Written responses must provide clear and concise documentation indicating your firms capability to provide the unit. Verbal responses are not acceptable and will not be considered. When responding to this announcement, respondents should refer to Announcement AG-3A94-S-14-0154. If after September 2, 2014, no viable responses have been received in response to this announcement, USDA/FSIS shall negotiate solely with BioMerieux.
