- This announcement is a notice of intent to extend an existing contract on a sole source basis to EGL Construction, Inc., 5417 Dailey Ave., El Paso, TX 79905-1720, for the Refuse Collection and Disposal Services contract at White Sands Missile Range (WSMR), New Mexico. The proposed contract action will extend the performance period of Contract W9124Q-11-D-0123 by six months under the provisions of statutory authority 10 U.S.C. 2304(c)(1) as implemented by FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. The estimated dollar value of this action is approximately $406,388.23 for the period of performance of 1 September 2014 through 28 February 2015. The Government's intent is to extend the current services with EGL Construction in order to continue performance of the required services until the fully competitive follow-on contract can be solicited, negotiated, and awarded. Award to any other source at this time would negatively impact WSMR's ability to perform its mission. These services are needed on a continuous basis to support the mission of WSMR. Award to any other source would negatively impact WSMR's ability to maintain a healthy and clean environment for the workforce. Any delay or intermediate change of contractor will result in adverse health and safety conditions for all personnel if refuse is left stagnant on the Installation which would be in direct violation of the Code of Federal Regulations 40 CFR 243.202-1 and OSHA Regulation 1910.1419(a)(4) Waste Disposal. This would cause the Government to incur significant costs for environmental violation fines, pest removal, and the initial pickup service and dumping fees on the new contract. Comments should be submitted to the contracting office by email to: monica.e.barrera.civ@mail.mil, no later than 20 August 2014 at 4PM MDT. Comments submitted for consideration of other methods will not be evaluated. This notice of intent is not a request for competitive quotations. A determination by the Government not to compete this proposed procurement based upon responses to this notice is solely within the discretion of the Government.
