Attachment B: Request for Sole Source Memo Format DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Activity: Department of Veterans Affairs, NCO 0 4, VA Pittsburgh Medical Center. Justification for Other than Full and Open Competition: Full Service Contract for Philips Anesthetic units ; Transaction # 646-15-1-068-0015; Phillips Medical Systems, Medical Field Support Center, 3000 Minuteman Road, Andover, MA 01810-1099 2.Nature and/or Description of the Action Being Processed: VA Pittsburgh has the following equipment: (3) Anesthesia Gas Module M1026B; (10) Intellivue Modular Monitors. These pieces of equipment require regular maintenance, scheduled and unscheduled. Philips Medical Systems will provide onsite service for repair needed for IntelliVue G5 Gas Module and Anesthetic gas Module ¦service will entail Philips technicians to come onsite for any regular preventive maintenance or repairs at VA Pittsburgh Healthcare System's University Dr. 3.Description of Supplies/Services Required to Meet the Agency's Needs: One year service and parts for IntelliVue G5 Gas Module model number M1019A and Anesthetic Gas Module model number M1026B. Length of contract is base year plus four (4) option years. 4.Statutory Authority Permitting Other than Full and Open Competition:. (x ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): a. Only One Responsible Source (FAR 6.302-1) -Philips Medical Systems, the original equipment manufacturer, is best suited for the service needed because of their experience and knowledge with servicing anesthesia equipment. All of the equipment is proprietary to Philips; therefore, third party parts are not permitted for repairs and Philips Medical Systems would be supplying parts in any case. Similarly, all the software needed for the maintenance upkeep and diagnostic service is exclusive to Philips Medical Systems. In order for maintenance or repair to take place, the technician must be qualified to service each piece of equipment. The training for service on each piece of equipment is beyond the scope of training for in-house biomedical technicians and a competent third party vendor would need to be called in for any required service. Philips is uniquely and solely qualified to perform any service to these pieces of equipment. Philips has unique knowledge of these units and has a history with our anesthesia equipment as they have manufactured it, installed it, and maintained it. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Obligatory intent to sole source to be published. 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Philips Medical Systems, the original equipment manufacturer is proprietary; therefore, third party parts or service are not permitted for repairs on Philips Medical Systems.
