- DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Activity: Network 23 Contracting Office (NCO 23) - Sioux Falls, 2501 W. 22nd Street, Sioux Falls SD 57105; 636-14-4-8038-0052. 2.Nature and/or Description of the Action Being Processed: Establishment of a sole source, firm-fixed price contract to access the Iowa On-line Warrants and Articles (IOWA) Criminal Justice Information Network with the Iowa Department of Public Safety for the Department of Veterans Affairs, VA Health Care System (VAHCS) located in Iowa City, Iowa. The contract will consist of a Base Year commencing 7/1/2014 for a total estimated contract price of $4,320.00. 3.Description of Supplies/Services Required to Meet the Agency's Needs: Services are required for access to the Iowa On-line Warrants and Articles (IOWA) Criminal Justice Information Network and the National Crime Information Center (NCIC) databases to conduct inquiries on databases for wanted persons; missing persons; protective orders, sex offenders, stolen property, including vehicles and guns; motor vehicle registration; driver license; criminal history records and administrative messages. The IOWA training staff will instruct and certify VA Police Enforcement personnel in the use of the IOWA System, audit IOWA system agencies for compliance in state and federal policies and regulations, certify software for use with the IOWA System and expand the network with access to new databases and capabilities. The IOWA system will provide authorized VA Police Service employees access to traffic record and criminal justice databases through a dedicated telecommunications network. The estimated base year contract cost is $4,320.00 and an estimated total contract cost of $21,600.00. The anticipated period of performance is from 7/1/2014 through 6/30/2015 and will include four (4) option year renewals. 4.Statutory Authority Permitting Other than Full and Open Competition: 41 USC §3304(a)(1), as implemented by FAR 6.302-1. (X) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): In accordance with Iowa Administrative Code, Section 661, Public Safety Department, Chapter 8, Criminal Justice Information, 8.101, only federal, state, or local criminal justice agencies within Iowa are eligible for access to the IOWA system. http://search.legis.state.ia.us/nxt/gateway.dll/ic?f=templates&fn=default.htm The IOWA system provides access to databases from various state agencies within Iowa, from the Federal Bureau of Investigation's National Crime Information Center (NCIC), and from the motor vehicle departments of other states nationally through the National Law Enforcement Telecommunications System (NLETS). Information on an international basis is also provided by NCIC and NLETS through interfaces to Canadian Police Information Centre and to INTERPOL. The NLETS system also provides administrative message traffic between Iowa criminal justice agencies and criminal justice agencies throughout the United States. The IOWA system allows criminal justice agencies to: a.Access nationwide computerized banks of information such as wanted, missing, and unidentified persons; stolen vehicles; stolen articles; stolen boats; stolen guns and stolen securities. b.Access driver license and motor vehicle information in-state as well as out-of-state. c.Exchange criminal history information on a national basis. d.Communicate by use of administrative messages with other criminal justice agencies worldwide. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Access to this information is restricted to government criminal justice agencies located in the state of Iowa. Market research efforts included internet research and discussions with the VA requestor and vendor. No other vendor is capable of providing access to this restricted and regulated service. Only the Iowa Department of Public Safety is capable of providing the required services. 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: The Contracting Officer will determine the price to be fair and reasonable. 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Market research did not identify any other vendors capable of providing services for the Iowa City VA Health Care System. 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: This service is strictly regulated by the State of Iowa. Only federal, state, or local criminal justice agencies within the state of Iowa are eligible for access to the IOWA system. 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: See Section VI above. 11.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: This service is strictly regulated by the Government and the current barrier cannot be removed at this time. 12.Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
